Gov. Code § 84308 Regulations: To promote transparency and fairness in the governmental decision-making process,
there are rules to prevent public officials from being unfairly influenced by contributors to their campaigns. The type of
activity these laws were enacted to limit is often referred to as “pay-to-play,” and is governed in California by
Government Code section 84308. Parties to any proceedings involving a “license, permit, or other entitlement for use,”
as that term is defined in the Political Reform Act, pending before the City Council must disclose any campaign
contribution over $500 (aggregated) within the preceding 12 months made by the party, their agent, and those required
to be aggregated with their contributions under Gov. Code § 82015.5. The disclosure must include the amount
contributed and the name(s) of the contributor(s). "G.C. § 84308 Regulations Apply: Yes" on this agenda indicates that
the item is subject to these regulations.

Recommended Action:
Hear the presentation on the roles, duties, and processes related to City of Chula Vista
commissions, including general rules applicable to City boards and commissions, open
meeting requirements (Brown Act), and public records (California Public Records Act).

Recommended Action:
Adopt a resolution, amending Planning Commission Resolution No. 2025-04 to add a
condition of approval for Design Review Permit DR22-0025 pertaining to affordable
housing while maintaining all other findings and conditions contained in the Planning
Commission Resolution No. 2025-04.
7.2 Tentative Map to Subdivide Two Parcels into Seven Parcels at the Shops at San Miguel
Ranch Site (TM24-0003)
Location: 2310, 2314 2318, 2322, 2326, 2330 and 2334 Proctor Valley Road (APNs:
595-030-57, 595-030-58, 595-030-59, and 595-030-60)
Environmental Notice: The project was reviewed for compliance with the California
Environmental Quality Act (CEQA) and determined that the project was adequately
covered in the previously certified Final Environmental Impact Report for Eastlake
Volume 1 (EIR 81-03; SCH:80121007 certified by City Council Resolution No. 11918 on
January 29, 1985) in that the project is within the scope of the program approved in
1985, and that Program Environmental Impact Report adequately described the project
for the purposes of CEQA. No further environmental review is required.
Recommended Action:
Continue to a date certain of February 11, 2026.

6.1 Comprehensive Code Update - Consideration of Amendments to the
Chula Vista Municipal Code
Notice of the hearing was given in accordance with legal requirements,
and the hearing was held on the date and no earlier than the time
specified in the notice.
Senior Planner Mallec gave a presentation on the item, and Deputy
Director of Development Services Bridgeford, Principal Civil Engineer
Campos, and Code Enforcement Manager Catacutan assisted in
responding to questions.
Chair Leal opened the public hearing.
Chris Naumann, Chula Vista resident, commented on permit fees.
There being no further members of the public who wished to speak, Chair
Leal closed the public hearing.

Chula Vista Municipal Code section 2.25.110 (C) allows board/commission/committee members, by a
majority vote, to excuse a fellow board, commission, or committee member’s absence from a meeting for any

deemed to have vacated his or her membership, unless the member’s absence is excused by a
majority vote of the other members. An absence is only recorded as “excused” upon receipt of a member’s

Planning Commission’s Duties
Chula Vista Municipal Code –2.42.020 –Functions and Duties
In accordance with Charter Section 604, the Planning Commission shall have the power and duty to:
1.Recommend to the City Council, after a public hearing, the adoption, amendment, or repeal of a Master Plan or any part thereof for the physical development of the City;
and
2.Exercise such functions with respect to land subdivisions, planning and zoning as may be prescribed by ordinance.
Additionally, the Planning Commission shall have the power and duty, in accordance with CVMC 21.02.030 to:
1.Approve Major Certificates of Appropriateness and Historic Designations.
2.Uphold the goals and policies of the General Plan related to historic preservation.
3.Carry out the purpose and intent of CVMC Title 21, Historic Preservation.
4.Assist staff in the development and maintenance of a certified historic preservation program that carries out the provisions of the certified local government program.
5.Approve designations of historical resources to the City of Chula Vista Register of Historical Resources.
6.Recommend to City Council delistings from the City of Chula Vista Register of Historical Resources.
7.Grant or deny applications for permits for major alterations of historical resources.
8.Grant or deny appeals from decisions of the Zoning Administrator for applications of minor alterations of historical resources.
9.Make recommendations to City Council on applications for participation in City-approved historic preservation incentive programs including but not limited to the Mills
Act Property Tax Abatement Program.
10.Advise the City Council and other boards, commissions and committees as necessary on historic preservation issues.
11.Perform other functions as appropriate to safeguard the City’s historic, aesthetic, social, economic, political and architectural past.(Ord. 3539 §1(K), 2022; Ord. 3211 §15,
2011).

Chula Vista Municipal Code –2.25.110 –Attendance requirements –Excused Absences
An office is deemed vacated if a member has three consecutive unexcused
absences from regular meetings.
Absences may be excused for the following reasons:
Illness; business commitments; pre-planned vacation with notice;
funeral/religious services; unscheduled emergency; any other reason where
seven (7) days’ notice provided
The B/C/C must vote to excuse absences –a member may vote to excuse
their own absence.

FAQ –Adding Agenda Items
Q: How do I get an item added to the agenda?
A: The Chair, staff, or a majority of the B/C/C can add an item to the agenda.
Option 1:The individual can ask the Chair to consider including the item on the next agenda. Be careful only to email the Chair, staff liaison, and secretary. Emailing or discussing with a majority of the B/C/C may lead to a potential Brown Act violation.
Option 2:Individual members can request consensus under the Member Comments section of the agenda to add an item to a future agenda. The matter cannot be discussed at that time –the B/C/C can only decide whether to add the item to future agenda.

FAQ –Meeting Procedures
Q: How do I make a motion?
A: Depending on the situation, the following are examples of how to
make a motion, after hearing public comments and being recognized
by the Chair:
“I move approval of Item 5.”
“I move to add an item to next month’s agenda to discuss XYZ.”
“I move to [insert action].”
Be sure to make your motion clear so that the public, staff, and B/C/C know exactly
what the vote pertains to. Refrain from saying “so moved” –the action can be easily
misunderstood.

Q: Can the B/C/C direct the staff or secretary to produce summary or
verbatim minutes?
A: No. The form of the minutes is decided by the City Council via the Chula
Vista Municipal Code. In addition, the Charter and Municipal Code prohibit
B/C/Cs from directing the work of staff. The City Council minutes are also
prepared in the same form.
Many B/C/Cs have audio recordings of the meetings posted on their websites, if
members or residents would like to listen to the full discussion.

Recommendations to Council

agenda, but the B/C/C or staff can “briefly respond” to comments or questions,
request information from staff, or place the item on a future agenda for discussion.
Examples of acceptable responses:
“I would like to request consensus of the B/C/C to add this item to the next meeting
agenda. At that time, can staff please provide additional information regarding the
matter?” Discussion among the B/C/C must be limited to whether to add the matter to the
agenda –no discussion of the matter brought forward can take place at that time.
“Staff, do you know the answer to the speaker’s question about the timing of the budget
preparation?” Staff can respond with a brief explanation of the timeline. Any further
discussion about the budget or B/C/C recommendations should be added as an item on a
future agenda.

FAQ –Public Speakers
Q: How should the B/C/C address speakers who may be disruptive, critical
of the B/C/C’s or staff’s work, or just plain rude?
A: Brown Act provisions protect the public’s right to attend, observe, and participate in meetings. B/C/Cs cannot prohibit public criticism of policies, procedures, programs or services of the City or the acts or omissions of the B/C/C itself.
Tips:
The B/C/C members should always listen and make an effort to understand the concerns and statements of all public speakers.
A simple “Thank you for your comments. The next speaker is…” is a sufficient reply.
The time allotted to public speakers is an opportunity for them to voice their opinion. B/C/C members are not obligated to engage in discussion or respond to questions.
Members may ask follow up questions, if desired, but should be mindful of the speaker time limit to ensure all speakers have equal opportunity to speak.

Recommended Action
Adopt a resolution, amending Planning Commission Resolution No. 2025-04 to add a condition of approval
for Design Review Permit DR22-0025 pertaining to affordable housing while maintaining all other findings
and conditions contained in the Planning Commission Resolution No. 2025-04.
SUMMARY
Design Review Permit DR22-0025, also known as Urbana 2.0, includes a 208-unit multifamily building with
a rooftop pool deck/terrace and underground parking structure, and was approved by the Planning
Commission on December 11, 2024. This item (PLN 26-0005) adds a condition of approval to comply with
tenant relocation regulations for any existing low income units being demolished, pursuant to State Law.
HOUSING IMPACT STATEMENT
The subject properties are not designated in the General Plan’s Housing Element as ones that would
contribute toward the City’s allocation for addressing regional housing needs; however, the Project enhances
the City’s overall housing inventory through the addition of 208 market-rate multifamily residential units.
The Project is not required to provide affordable housing units in accordance with the City’s Balanced
Communities Policy or Chula Vista Municipal Code (CVMC) Chapter 19.91 because the application was
submitted prior to the adoption of either policy.
ENVIRONMENTAL REVIEW
The proposed Project has been reviewed for compliance with the California Environmental Quality Act
(“CEQA”), and it has been determined that the Project was adequately covered and addressed in the

previously certified Final Environmental Impact Report for the Urban Core Specific Plan (“UCSP”)(EIR 06-
01; SCH #2005081121; certified by City Council Resolution No. 2007-097 on April 26, 2007) in that the
Project is within the scope of the program approved in 2007, and that Program Environmental Impact Report
adequately described the Project for the purposes of CEQA. No further environmental review is required.
DISCUSSION
Project Description
On December 11, 2024, the Planning Commission unanimously approved (7-0) Design Review Permit DR22-
0025 for the Urbana 2.0 project. The approved project consists of 208 market-rate multifamily residential
units, including a rooftop pool deck/terrace and underground parking. The unit breakdown includes 4 walk-
up studio units, 94 studio units, and 110 one-bedroom units, with unit sizes ranging from 355 to 657 square
feet. The project also involves demolition of an existing 28-unit apartment building currently located on the
site.
Prior Condition Modification
On May 14, 2025, Planning Commission approved modifications to Condition Numbers 23 and 28, reducing
the required public-right-of-way dedication from 11 to nine (9) feet for consistency with the project plans,
and providing the appropriate improvement method for fire access roads and driveways pursuant to a
previously issued directive from the City Engineer, respectively.
Condition Addition
Following the latest approval, Staff identified that a condition of approval regarding Government Code
Section 66300/Senate Bill 330 (Housing Crisis Act of 2019) with respect to the demolition of the existing
apartment building was inadvertently not included as part of the current approved Resolution. Because the
units are currently occupied and may be deemed protected, Senate Bill 330 in part requires the proposed
housing development to conduct an analysis and provide at least the same number of units of equivalent size
and at an affordable rent or affordable housing cost. Senate Bill 330 also mandates protections for existing
residents, including affording tenants the right to stay until six (6) months before construction, offering a
comparable unit at an affordable rent (Right of First Refusal), and paying relocation benefits for no-fault
evictions tied to development. Although the applicant is required to comply with this requirement
independent of adding the condition, staff is including the condition to address any future change in property
ownership should that occur. This condition of approval ensures that the obligation to comply with the
Government Code remains clear and enforceable. To guarantee that the required units are protected and
replaced within the proposed Project, Staff proposes the following, added Planning Conditions:
1. The applicant shall meet the requirements of Government Code Section 66300 et seq., otherwise
known as the Housing Crisis Act of 2019, regarding determination and replacement of protected
units on the project site. Any affordable housing obligation required pursuant to this condition
shall be satisfied through a regulatory agreement with project owner, to be recorded in the
official records of San Diego County prior to building permit issuance.
2. All other conditions of approval of Resolution No. 2025-04 shall remain in full force and effect.

CONCLUSION
The overall Project is consistent with the 2007 UCSP Final EIR and is a permitted use in the UC-2 subdistrict
within the UCSP. The proposed condition addition ensures that existing units are protected and replaced
within the proposed Project and will continue to support the goals of the Urban Core Specific Plan. Therefore,
staff recommends the Planning Commission adopt the proposed resolution (Attachment 2) approving the
added Planning conditions, while maintaining all other findings and conditions contained in the prior Project
approvals.
DECISION-MAKER CONFLICT
Staff has reviewed the property holdings of the Planning Commission members and found no property
holdings within 1,000 feet of the boundaries of the Project Site. Consequently, this item does not present a
disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2,
Section 18702.2(a)(7) or (8) for purposes of the Political Reform Act (Cal. Gov’t Code §87100, et seq.).
Staff is not independently aware of nor has been informed by any Planning Commission member of any other
fact that may constitute a basis for a decision-maker conflict of interest in this matter.
FISCAL IMPACT
There are no current or ongoing fiscal impacts to the General Fund or the Development Services Fund
resulting from this action. All costs incurred processing this application are borne by the Applicant.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHULA
VISTA AMENDING PLANNING COMMISSION RESOLUTION NO. 2025-04 TO
ADD CONDITIONS TO DESIGN REVIEW PERMIT DR22-0025 TO COMPLY
WITH GOVERNMENT CODE SECTION 66300 ET SEQ., OTHERWISE KNOWN
AS THE HOUSING CRISIS ACT OF 2019
WHEREAS, on September 14, 2022, a duly verified application for a Design Review
Permit was filed with the City of Chula Vista Development Services Department by Urbana 2.0,
LLC (“Applicant”); and
WHEREAS, the property that is the subject of this Resolution is owned by Carmel Oaks
Del Mar, LLC (“Property Owner”) and is located in the UC-2 (Gateway) subdistrict of the Urban
Core Specific Plan (“UCSP”) area, at 355-365 H Street, and is otherwise identified by Assessor’s
Parcel Numbers 568-450-50 and 568-450-51, totaling approximately 0.94 acre (the “Project Site”);
and
WHEREAS, the subject property is designated in the Chula Vista General Plan as a mixed-
use transit focus area; and
WHEREAS, the Applicant requested approval to construct a seven-story, 208-unit
multifamily residential building with a rooftop pool deck/terrace and underground parking
(“Project”); and
WHEREAS, pursuant to Chula Vista Municipal Code (“CVMC”) 19.14.582(B), a public
hearing before the Planning Commission is required for Design Review applications proposing
more than 200 residential units; and
WHEREAS, the Project was reviewed for compliance with the California Environmental
Quality Act (“CEQA”) and it was determined that the Project was adequately covered and
addressed in the previously certified Final Environmental Impact Report for the Urban Core
Specific Plan (EIR 06-01; SCH #2005081121; certified by City Council Resolution No. 2007-097
on April 26, 2007) in that the Project is within the scope of the program approved in 2007 and that
Program Environmental Impact Report adequately described the Project for the purposes of
CEQA; and
WHEREAS, City staff recommended approval of the Consistency Evaluation for the

the exterior boundaries of the property at least 10 days prior to the hearing; and
WHEREAS, on Wednesday, May 14, 2025 the Planning Commission approved a

Planning Commission to consider the proposed Condition No. 7, and the hearing was thereafter

WHEREAS, the Planning Commission has reviewed and considered all materials for the
proposed resolution amendment.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Chula
Vista that it hereby approves the resolution amendment with the following added planning
conditions:

apply to any fees, dedication, reservations, or other exactions which have been given notice
similar to this, nor does it revive challenges to any fees for which the statute of limitations
has previously expired.
EXECUTION OF RESOLUTION OF APPROVAL
The Property Owner and Applicant shall execute this document signing on the lines provided
below, indicating that the Property Owner and Applicant have each read, understood, and
agreed to the conditions contained herein and will implement the same. Upon execution,
this document shall be signed and returned to the City’s Development Services Department.

CONSEQUENCE OF FAILURE OF CONDITIONS
If any of the foregoing conditions fails to be met, or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fails to be so implemented
and maintained according to their terms, the City shall have the right to revoke or modify all
approvals herein granted; deny or further condition issuance of all future building permits;
deny, revoke, or further condition all certificates of occupancy issued under the authority of
approvals herein granted; institute and prosecute litigation to compel their compliance with
said conditions; or seek damages for their violation. Failure to satisfy the conditions of this
permit may also result in the imposition of civil or criminal penalties.
INVALIDITY; AUTOMATIC REVOCATION
It is the intention of the Planning Commission that its adoption of this Resolution is
dependent upon the enforceability of each and every term, provision, and condition herein
stated and that in the event that any one or more terms, provisions, or conditions is
determined by a Court of competent jurisdiction to be invalid, illegal, or unenforceable, this

Resolution and the permit shall be deemed to be automatically revoked and of no further

Added Conditions
1.The applicant shall meet the requirements of Government
Code Section 66300 et seq.,otherwise known as the Housing
Crisis Act of 2019,regarding determination and replacement of
protected units on the project site.Any affordable housing
obligation required pursuant to this condition shall be satisfied
through a regulatory agreement with project owner,to be
recorded in the official records of San Diego County prior to
building permit issuance.
