Meeting Date 08/14/25 ITEM TITLE: RESOLUTION OF THE TRAFFIC SAFETY COMMISSION OF THE CITY OF CHULA VISTA ESTABLISHING A TIME LIMITED LOADING ZONE ALONG FIFTH AVENUE BETWEEN FLOWER
STREET AND E STREET, AND THAT SCHEDULE VI OF THE REGISTER MAINTAINED IN THE OFFICE OF THE CITY ENGINEER BE AMENDED TO REFLECT THESE CHANGES SUBMITTED BY: City Traffic Engineer
In autumn of 2024, the owner of Hawking Charter School, located at 489 E Street, submitted a request for a time-restricted loading zone along Fifth Avenue. The proposed loading zone would be designated for passenger loading and unloading only, with a three-minute time limit along approximately 150 feet of on-street parking curb (parallel) in the City of Chula Vista right-of-way.
Parking would be restricted in this zone from 7:00 AM to 4:00 PM on school days (See Attachment 1, Location Plat). RECOMMENDATION: That the Traffic Safety Commission concur with staff and establish a time-restricted loading zone along Fifth Avenue between Flower Street and E Street, and that
Schedule VI of the register maintained in the Office of the City Engineer be amended to reflect these changes. DISCUSSION:
The California Vehicle Code (CVC) authorizes local jurisdictions to regulate parking and curbside
activity in the interest of traffic safety and operational efficiency. Under CVC §22500, stopping or parking in certain locations may be restricted to prevent traffic hazards or congestion. Additionally, CVC §22507 allows local authorities to adopt ordinances or resolutions to establish time-restricted zones, including passenger loading and unloading areas.
In autumn of 2024, Hawking Charter School (the “owner”), located at 489 E Street, formally
requested the establishment of a time-restricted passenger loading zone along Fifth Avenue between Flower Street and E Street.
The proposed loading zone would prohibit general parking and allow passenger loading and unloading only, with a maximum duration of three minutes per vehicle, from 7:00 AM to 4:00 PM
on school days. These time restrictions aim to minimize congestion and reduce double-parking
near the school.
City staff evaluated the request and found that the proposed loading zone meets the intent of the CVC and supports enhanced safe traffic circulation in front of the school. This stretch of Fifth Avenue experiences high vehicle and pedestrian activity during morning arrival and afternoon
dismissal periods.

The proposed time-limited parking is described in the table below. Per the City of Chula Vista Municipal Code Section 10.52.330, upon approval of the proposed time-limited parking by the Traffic Safety Commission, Schedule VI of the register maintained in the office of the City

OF THE CITY OF CHULA VISTA ESTABLISHING A TIME-LIMITED LOADING ZONE ALONG THE EAST SIDE OF FIFTH AVENUE, BETWEEN FLOWER STREET AND E STREET, AND TO ACCORDINGLY AMEND SCHEDULE VI OF THE REGISTER OF SCHEDULES MAINTAINED IN THE
OFFICE OF THE CITY ENGINEER WHEREAS, the east side of Fifth Avenue, between Flower Street and E Street (“Subject Parking Area”) currently permits unrestricted parallel parking throughout the day, including school hours; and
WHEREAS, the current parking regulations at the Subject Parking Area are based on standard City of Chula Vista on-street parking allowances for local streets without special restrictions; and
WHEREAS, in autumn of 2024, Hawking Charter School (the “owner”), located at 489 E Street, submitted a request for Time-Limited Loading Zone to facilitate safe passenger loading and unloading during school hours; and WHEREAS, the requested change is intended to reduce congestion and prevent double
parking during morning arrival and afternoon dismissal periods; and WHEREAS, staff has investigated the current parking regulations at the Subject Parking Area and observed high-volume drop-off and pick-up activity with limited curbside space; and
WHEREAS, as a result of its investigation, staff recommends that the current parking regulations be revised to establish passenger loading and unloading only, with a 3-minute time limit, from 7:00 AM to 4:00 PM on school days along the east side of Fifth Avenue, between Flower Street and E Street.
NOW, THEREFORE, BE IT RESOLVED that the Traffic Safety Commission of the City of Chula Vista does hereby establish a Time-Limited Passenger Loading and Unloading on School Days Only along the east side of Fifth Avenue, between Flower Street and E Street, for the affected on-street parking spaces. Also, per the City of Chula Vista Municipal Code Section
10.52.330, Schedule VI of the register maintained in the office of the City Engineer shall be

AVENUE BETWEEN ‘E’ STREET AND ‘L’ STREET FROM 30 MPH
TO 25 MPH, AND THAT SCHEDULE X OF THE REGISTER MAINTAINED IN THE OFFICE OF THE CITY ENGINEER BE AMENDED TO REFLECT THE ADJUSTED SPEED LIMIT

Staff completed a review of roadway segments based on Engineering and Traffic Surveys (E&TS) prepared in accordance with the California Vehicle Code (CVC) that have since initially
expired and may qualify as a residence or business district. According to the CVC, a prima facie
speed limit of 25 mph can be posted on road segments in business or residence districts without an E&TS. Therefore, staff recommends that the existing posted speed limit on First Avenue between ‘E’ Street and ‘L’ Street (the “Segment”) of 30 mph be reduced to 25 mph based on it being a residence district (see Attachment 1, Location Map).
RECOMMENDATION: That the Traffic Safety Commission reduce the existing 30 mph speed limit on the Segment to a prima facie speed limit of 25 mph based on meeting the definition of a residence district.
DISCUSSION:
The California Vehicle Code (CVC) establishes minimum and maximum prima facie speed limits for all streets in the State. The minimum default prima facie speed limit is 25 miles per hour (MPH) and the maximum speed limit is 65 MPH. An engineering and traffic survey
(E&TS) is required to change the prima facie limit and/or update various speed limits in the City.
The CVC requires that local agencies review changes in local speed limits every five to seven years to determine whether the existing street segment speed limits require updating due to the age of the engineering and traffic survey or due to changes in roadway and traffic conditions. In
addition, the CVC sets a prima facie speed limit of 25 MPH on roads in business or residence
districts. The definitions for business and residence districts in the CVC have a few caveats, but generally, the CVC defines a residence district as a road with at least 13 separate dwellings on one side
within a quarter mile or at least 16 separate dwelling houses on both sides within a quarter mile.

Physical Conditions The following summarizes the conditions along the Segment:
• Classification – Class II Collector
• Length/Width – 1.71 miles and 38’ to 40’ wide
• Average Daily Traffic: 2,935
• Number of Lanes: One travel lane (1 per direction)
• Existing Speed Limit – 30 mph
• Striping – Two lanes of traffic
• Parking – Parking is allowed along both sides
• Horizontal Alignment – Straight
• Fronting Dwellings per ¼ Mile (135/1.71 mi) – 19.7
• Longest Uninterrupted Segment – 0.46 miles
The Segment includes more than 16 dwellings per quarter mile, which meets the definition of a residence district per the CVC. In addition, because the entire Segment is 40 feet or less wide, has one traffic lane in each direction, and has not more than one half mile of uninterrupted
length, it meets the definition of a local road per the CVC. Therefore, the Segment as a
residence district cannot be considered a “speed trap” in accordance with the CVC. CONCLUSION:
When speed limits are appropriately established the following objectives are achieved:
• Meaningful, unambiguous enforcement
• Voluntary public compliance
• Clear identification of the unreasonable violator
• Elimination of unjustifiable “tolerances” of higher speed travel Should the City Council reduce the speed limit to 25 mph, Schedule X of the register maintained in the office of the City Engineer be amended to reflect the speed limit decrease:
• First Avenue between ‘E’ Street and ‘L’ Street, reduced speed limit from 30 mph to 25 mph.
FISCAL IMPACT:
The establishment of the speed limit would require the posting of new speed limit signs and speed limit pavement legends. This work will be funded by an existing Traffic Engineering Capital Improvement Project, TRF-0332, Signing and Striping Program.
