RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA LEVYING THE ASSESSMENTS AND
COLLECTIBLES FOR FISCAL YEAR 2025-26 FOR OPEN
SPACE DISTRICT 20 ZONE 5
WHEREAS, prior to the adoption of this Resolution, the City Council caused the
formation of various districts under and pursuant to state law; and
WHEREAS, pursuant to Article 4, Chapter 1, part 2 of Division 15 of the California
Streets and Highways Code, also known as “Landscaping and Lighting Act of 1972” and Chula
Vista Municipal Code Chapter 17.07, Spicer Consulting Group, LLC has prepared and filed, on
behalf of and under the direction of the City Engineer, the Annual Open Space Districts
Engineer’s Report (Engineer’s Report) for all existing Open Space Maintenance Districts in the
City; and
WHEREAS, on May 20, 2025, Council approved the Engineer’s Report and set July 8,
2025, as the date for the public hearing; and
WHEREAS, the proposed assessments for fiscal year 2025-26 are as follows:

(1) The Projected Revenue are preliminary figures based upon the prior year's EDU assignments and the Proposed Rates for Fisc al Year 2025-26.
WHEREAS, the City Council of the City of Chula Vista held a public hearing on the
date and time set for such hearing; and
WHEREAS, all interested persons were afforded the opportunity to hear and be heard; and
WHEREAS, the City Council considered all oral statements and written protests made
or filed by all interested persons.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula
Vista, as to all Open Space and Maintenance Districts referenced in this Resolution, as follows:
1. That it finds that written protests against the proposed assessment have not been
made by owners representing more than one-half of the area of land to be
assessed.
2. That it confirms the diagram and assessment contained in the Engineer’s Report

3. That it orders that the open space and maintenance facilities be maintained.
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that the
adoption of this Resolution constitutes the levy of assessments and collectibles as proposed in
the Engineer’s Report for the 2025-26 Fiscal Year for Open Space District 20 Zone 5.
