RESOLUTION NO. 2025-101 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A CONSULTANT SERVICES AGREEMENT FOR CLOUD-BASED PERMITTING SOFTWARE, LICENSING, HOSTING MAINTENANCE AND IMPLEMENTATION SERVICES WITH ACCELA, INC. WHEREAS, in 1991, the City purchased Permits Plus© automation software for processing applications and permits for projects and land development with City boundaries; and WHEREAS, the City upgraded from Permits Plus© to Accela Automation in 2013; and WHEREAS, Accela, Inc. software has been continuously used to support permitting, licensing, and code enforcement functions since 2013; and WHEREAS, Accela, Inc. has notified the City that the existing on-premises system will reach end-of-life and no longer be supported after June 30, 2025; and WHEREAS, City staff recommends that City Council waive the competitive process in compliance with Municipal Code Section 2.56.070(b)(3); and WHEREAS, City staff has negotiated a five-year agreement with Accela, Inc. to migrate to a Software as a Service (SaaS) platform, including subscription licensing, maintenance, cloud hosting, data migration, professional services, and enhanced reporting capabilities not to exceed $3,335,387; and WHEREAS, the agreement terms include fixed five-year pricing, continued use of existing modules, an Enhanced Reporting Database (ERD), third-party integrations, 200 hours of bonus professional services, and a Government Solutions Architect review if executed by June 30, 2025; and WHEREAS, the City desires to approve this agreement to ensure continuity of service, improve long-term sustainability of the permitting platform, and prevent service disruption; and WHEREAS, the proposed agreement represents a continuation of services and reflects a transition from the City's existing on-premises software to a modern, cloud-based platform; and WHEREAS, the current system is proprietary to Accela, Inc., and no third-party vendors can legally maintain or extend the City’s current environment, the migration is necessarily sole- sourced to the original developer. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, waives the competitive process and approves the Consultant Services Agreement for Cloud-Based Permitting Software and Services, between the City and Accela, Inc, in the form presented, with such minor modifications as may be required or approved by the City Attorney, a copy of which shall be kept on file in the Office of the City Clerk and authorizes and directs the City Manager; to execute same.
