SUMMARY Design Review Permit DR22-0025 (Urbana 2.0) was approved by the Planning Commission on December 11, 2024, and includes a 208-unit multifamily building with rooftop amenities and underground parking. This item proposes minor corrections to two conditions of approval: reducing the required right -of-way dedication along H Street from 11 to 9 feet to reflect the approved project plans and updating the fire access road and driveway design requirements to be consistent with current City engineering standards. HOUSING IMPACT STATEMENT The subject properties are not designated in the General Plan’s Housing Element as ones that would contribute toward the City’s allocation for addressing regional housing needs; however, the Project enhances the City’s overall housing inventory through the addition of 208 market-rate multifamily residential units. The Project is not required to provide affordable housing units in accordance with the City’s Balanced Communities Policy or Chula Vista Municipal Code (CVMC) 19.91 because the application was submitted prior to the adoption of either policy. Page 10 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda P l a n n i n g C o m m i s s i o n S t a f f R e p o r t P a g e | 2 ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the proposed Project for compliance with the California Environmental Quality Act (“CEQA”) and determined that the Project was adequately covered and addressed in the previously certified Final Environmental Impact Report for the Urban Core Specific Plan (“UCSP”)(EIR 06-01; SCH #2005081121; certified by City Council Resolution No. 2007-097 on April 26, 2007) in that the Project is within the scope of the program approved in 2007, and that Program Environmental Impact Report adequately described the Project for the purposes of CEQA. No further environmental review is required. DISCUSSION Project Description On December 11, 2024, the Planning Commission unanimously approved (7-0) Design Review Permit DR22-0025 for the Urbana 2.0 project. The approved project consists of 208 market-rate multifamily residential units, including a rooftop pool deck/terrace and underground parking. The project also involves demolition of an existing 28-unit apartment building currently located on the site. The proposed new structure will include four walk-up studio units, 94 studio units, and 110 one-bedroom units, with unit sizes ranging from 355 to 657 square feet. Condition Modification Regulatory planning documents, such as Specific Plans or the Circulation Element of the General Plan, include policies aimed at improving circulation systems that support a balanced mix of pedestrian, motorized, and non-motorized transportation. To implement these policies, development projects are often required to dedicate portions of private property to accommodate roadway widening for vehicles, bicycle lanes, and pedestrian walkways. On June 18, 2012, the Design Review Committee approved the original Urbana Luxury Apartment Community (DRC-11-27) at 393 H Street, which is adjacent to the Urbana 2.0 project site. That project included a street dedication along H Street, which facilitated an urban pedestrian environment and supported the design of underground parking. To maintain consistency between the adjacent developments, the Urbana 2.0 project was expected to provide a similar dedication. As part of the Urbana 2.0 approval, Condition No. 22 (see Attachment 2) of Planning Commission Resolution 2024-17 stated: Prior to the issuance of any City permit, and in accordance with the provisions of the UCSP, the Applicant shall grant an irrevocable offer of dedication of 11 feet along the Project’s entire H Street frontage. Following approval, the Applicant identified a discrepancy between the conditions of approval and the approved project plans (Attachment 3). Upon review, City staff concurred with the Applicant that the condition incorrectly stated an 11 foot dedication. The correct dedication, consistent with the approved project plans is nine feet. Following is the updated Condition No. 22: Page 11 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda P l a n n i n g C o m m i s s i o n S t a f f R e p o r t P a g e | 3 Prior to the issuance of any City permit, and in accordance with the provisions of the Urban Core Specific Plan, the Applicant shall grant an irrevocable offer of dedication of nine (9) feet along the Project’s entire H Street frontage. The dedication shall be consistent with the street frontage improvements of the adjacent Urbana apartment community and shall be subject to the review and approval of the City Engineer. Additionally, upon review Staff identified an incorrect fire access road and driveway condition provided in Condition No. 28. The condition read: Any proposed fire access roads and driveways shall meet the H-20 loading requirements or shall be designed for a Traffic Index (T.I.) of 5. In September of 2024 the City Engineer issued Engineering and Capital Project Directive 2024-03 – Traffic Index & Pavement Structural Section Calculations (Attachment 4) clarifying the required standards for design of these and other roadway facilities. To comply with the Directive, Condition No. 28 is corrected to: Any proposed fire access roads and driveways shall meet the standards set by the City of Chula Vista Subdivision Manual and Engineering & Capital Project Directive 2024-03 - Traffic Index & Pavement Structural Section Calculations to the satisfaction of the City Engineer or designee. The proposed corrections to Condition No. 22 and Condition No. 28 will not alter the building’s location or design and will not negatively affect planned street improvements, including landscaping, utilities, or pedestrian pathways. CONCLUSION The overall Project is consistent with the 2007 UCSP Final EIR and is a permitted use in the UC-2 subdistrict within the UCSP. The proposed corrections to Condition No. 22 and Condition No. 28 aligns the project’s requirements with the approved plans and the adjacent Urbana development, ensuring consistency in street frontage improvements along H Street. The modification will not affect the building’s design or functionality and will continue to support the goals of the Urban Core Specific Plan. Therefore, the Planning Commission adopt the proposed resolution (Attachment 5) approving the revised condition maintaining all other findings and conditions contained in the original Project approvals. DECISION-MAKER CONFLICT Staff has reviewed the property holdings of the Planning Commission members and found no property holdings within 1,000 feet of the boundaries of the Project Site. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(7) or (8) for purposes of the Political Reform Act (Cal. Gov’t Code §87100, et seq.). Staff is not independently aware of nor has been informed by any Planning Commission member of any other fact that may constitute a basis for a decision-maker conflict of interest in this matter. The minimum requirements for pavement structural sections defined in Section 3-406 of the Subdivision Manual shall apply to both public and private roads per Section 3- 404.3(8) of the Subdivision Manual. 2. The Traffic Index (T.I.) shall be calculated in accordance with the Caltrans Highway Design Manual using ultimate or buildout traffic flow data for the affected road as determined by the City Engineer. a. Buildout traffic volume data may be selected from a variety of sources, at the City Engineer’s discretion, including, but not limited to the following: i. SANDAG traffic models ii. City-adopted traffic studies for the affected community iii. Design ADT for the given street classification per the Subdivision Manual iv. Ultimate traffic volume projection based on available ADT data b. Private residential streets, generally, have a design ADT not exceeding 800 vehicles per Section 3-401.1 of the Subdivision Manual. c. The T.I. calculation accounts for a certain number of trucks on the road. The design and construction of temporary fire access roads shall comply with the Temporary Fire Apparatus Access Road Requirements (April 2024 or latest) as published by the City’s Fire Prevention Division. Black, AICP DATE Director of Development Services 09/05/2024 Page 18 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda 1 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA APPROVING A MODIFICATION TO CONDITION NO. 22 OF DESIGN REVIEW PERMIT DR22-0025, REDUCING THE REQUIRED PUBLIC- RIGHT-OF-WAY DEDICATION FROM 11 TO 9 FEET WHEREAS, on September 14, 2022, a duly verified application for a Design Review Permit was filed with the City of Chula Vista Development Services Department by Urbana 2.0, LLC (“Applicant”); and WHEREAS the property that is the subject of this Resolution is owned by Carmel Oaks Del Mar, LLC (“Property Owner”) and is located in the UC-2 (Gateway) subdistrict of the Urban Core Specific Plan (“UCSP”) area, at 355-365 H Street, and is otherwise identified by Assessor’s Parcel Numbers 568-450-50 and 568-450-51, totaling approximately 0.94 acre (the “Project Site”); and WHEREAS the subject property is designated in the Chula Vista General Plan as a mixed- use transit focus area; and WHEREAS the Applicant requests approval to construct a seven-story, 208-unit multifamily residential building with a rooftop pool deck/terrace and underground parking (“Project”); and WHEREAS, pursuant to Chula Vista Municipal Code (“CVMC”) 19.14.582(B), a public hearing before the Planning Commission is required for Design Review applications proposing more than 200 residential units; and WHEREAS the Director of Development Services has reviewed the proposed Project for compliance with the California Environmental Quality Act (“CEQA”) and determined that the Project was adequately covered and addressed in the previously certified Final Environmental Impact Report for the Urban Core Specific Plan (EIR 06-01; SCH #2005081121; certified by City Council Resolution No. 2007-097 on April 26, 2007) in that the Project is within the scope of the program approved in 2007 and that Program Environmental Impact Report adequately described the Project for the purposes of CEQA; and WHEREAS City staff recommends approval of the Consistency Evaluation for the Project under CEQA and DR22-0025 for the Project as proposed; and WHEREAS the Director of Development Services set the time and place for a hearing on the Project before the Planning Commission to consider the Project, and notice of the hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City and its mailing to property owners and residents within 500 feet of the exterior boundaries of the property at least 10 days prior to the hearing; and WHEREAS a public hearing on the Project was held as advertised at 6:00 p.m. on Wednesday, May 14, 2025, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission, and the hearing was thereafter closed; and Page 19 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda PC Resolution May 14, 2025 2 WHEREAS the Planning Commission has reviewed and considered all materials for the Project. The proposed Project is consistent with the approved UCSP and the previously certified 2007 Final Program Environmental Impact Report for the Urban Core Specific Plan (FEIR06-01; SCH#200508112). The proposed condition modification, and Project with office and retail uses, is within the scope of the UCSP and the UC-2 subdistrict development standards and regulations, and was adequately studied, covered and addressed, consistent with CEQA Guidelines Section 15168(c), in the previously certified 2007 Final Program Environmental Impact Report for the Urban Core Specific Plan (FEIR06-01; SCH#200508112). 2. The proposed Project is consistent with the Chula Vista General Plan, Title 19 of the CVMC, and the UCSP. The proposed multifamily residential Project, and condition modification, is consistent with the Chula Vista General Plan’s mixed-use transit focus area designation and its intent to provide the highest intensity mixed-use residential environment within one-quarter mile of transit stops. The Project is also consistent with the provisions of the UCSP and the UC- 2 subdistrict development standards and regulations, as well as any applicable standards not contained within the UCSP but covered by Title 19 of the CVMC. 3. The proposed Project is consistent with the design requirements and recommendations contained in Chapter VII of the UCSP. The proposed building design incorporates a variety of materials and architectural features in a neutral color palette with a contemporary theme. The proposed building facades will utilize a combination of colors and materials to minimize repetitive design elements and allow for architectural flexibility. The proposed parking area will be located underground and will not be visible from public views. A landscaped courtyard and rooftop area encourage activity within the development. 4. The Project will not adversely affect the health, safety, or general welfare of the community. The proposed multifamily residential building is a permitted use in the UC-2 subdistrict, and along with the condition modification, meets all development standards, including required parking and landscaping, as required in the UCSP, the CVMC, and as conditioned herein. BE IT FURTHER RESOLVED that the Planning Commission, based on the findings above, does hereby approve the condition modification to DR22-0025, and subject to the same, following conditions. The Applicant shall develop the Project and Project Site in accordance with the approved plans for DR22-0025, which include a site plan, floor plans, and elevations on file in the Development Services Department. The colors and materials specified on the building permit drawings shall be consistent with the colors and materials shown on the plans approved by the Planning Commission for this Design Review. 3. Ground-mounted utility appurtenances such as transformers and/or air conditioning condensers shall be located out of public view and/or adequately screened using a combination of concrete or masonry walls, berming, and/or landscaping. The sound from such appurtenances shall also be buffered from adjacent properties and streets using the same method(s). The method and type of screening shall be specified on the building permit drawings for the Project. 4. All roof appurtenances, including air conditioners and other roof-mounted equipment and/or projections, shall be shielded from view and the sound buffered from adjacent properties and streets. Such screening shall be architecturally integrated with the proposed building design. The method and type of screening shall be specified on the building permit drawings for the Project. 5. All exterior lighting shall be shown on the building permit drawings for the Project and shall include shielding to prevent any glare onto adjacent properties. Details for said lighting shall also be included in the building permit drawings for the Project. 6. All applicable requirements and mitigation measures of EIR 06-01 and the related Mitigation Monitoring and Reporting Program (“MMRP”) for the same shall be implemented and met. Before the issuance of the first grading permit for the Project, the Applicant shall prepare and submit to the City a list of applicable mitigation measures from EIR 06-01 and the related MMRP, which shall be approved in writing by the Director of Development Services or their designee. Land Development 7. The Applicant shall comply with all requirements and guidelines of the CVMC; the Chula Vista Subdivision Manual; the Chula Vista Design and Construction Standards; the Page 21 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda PC Resolution May 14, 2025 4 Development Storm Water Manual for Development and Redevelopment Projects; Chula Vista Grading Ordinance (No. 1797); and the Subdivision Map Act. 8. Prior to the final building inspection, the infrastructure serving the Project Site shall be constructed and fully operational to the satisfaction of the Director of Development Services. 9. The Applicant shall deposit any applicable fees in accordance with the Master Fee Schedule for any required submittals per the Subdivision Manual and CVMC. 10. Prior to the issuance of any building permit for the Project, the Applicant shall submit an improvement plan and obtain a Construction Permit to construct sidewalk, curb and gutter, street trees, private driveways, and associated signage and striping in the City’s right-of- way, including but not limited to the following requirements: a. All driveways shall conform to the City of Chula Vista’s sight distance requirements in accordance with CVMC 12.12.120 and Chula Vista standard drawing RWY-05 (Sight Distance Requirements). Neither landscaping, street furniture, nor signs shall obstruct the visibility of drivers at street intersections or driveways. b. Removal and replacement of any broken or damaged curb, gutter, and sidewalk along the applicable Project frontage on H Street per San Diego Regional Standard Drawings G-02 and G-07 (for non-monothetic) or G-03 (for monothetic), to the satisfaction of the City Engineer. Sidewalk shall be designed and constructed with proper transitions to existing conditions. c. Removal and replacement of existing pedestrian ramps according to the City’s Americans with Disabilities Act (“ADA”) standard requirements as part of the improvement plans. d. Additional asphalt paving for the replacement of any existing ADA ramps, curb, gutter, and sidewalk. 11. Separate permits for other public utilities (gas, electric, water, cable, telephone) shall be required as necessary. Utilities trenching and restoration shall be consistent with Chula Vista Construction Standard Drawing GSI-03. 12. It is the Applicant’s responsibility to identify, process, and obtain any required permits from any applicable agency and/or jurisdiction other than the City prior to the issuance of any City permit. 13. Any improvements in the right-of-way beyond the Project limits shall be designed and constructed as not to interfere with adjacent businesses, as approved by the City Engineer. 14. Prior to beginning any earthwork activities at the site, and before issuance of a building permit, the Applicant shall submit grading plans to the Land development Division for Page 22 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda PC Resolution May 14, 2025 5 processing, reviewing, and permitting in accordance with CVMC 15.04. Plans shall be in conformance with the City’s Subdivision Manual and the City’s current Best Management Practices (“BMP”) Design Manual. 15. A transportation permit is required prior to hauling any material from the Project Site. If any surplus material is to be transported from the Project Site, the Applicant shall provide a letter from the receiving site prior to exporting any material. 16. The Applicant shall provide technical reports during review of the grading plans, including but not limited to geotechnical, drainage, sewer, and any other required report. The reports shall be reviewed and approved prior to the issuance of a grading permit. 17. Prior to issuance of the first permit for the Project, the Applicant shall submit a detailed sewer study for review and approval, prepared by a civil engineer registered in California. Any approved recommendations in the study shall be implemented and constructed by the applicant as part of the first permit issuance for the Project. 18. The submitted Stormwater Quality Management Plan (“SWQMP”) is considered conceptually complete and provides adequate information regarding the Project’s BMP objectives to move forward with construction drawings. Additional requirements may be imposed at the time of development and/or upon submittal of a Land Development permit application, depending upon the final plans submitted for review and approval. 19. The submitted drainage report is considered conceptually complete and provides adequate information regarding the Project’s drainage objectives to move forward with construction drawings. Additional requirements may be imposed at the time of development and/or upon submittal of a Land Development permit application, depending upon the final plans submitted for review and approval. 20. Prior to issuance of the first of the grading, construction, or building permits, the Applicant shall enter into a Stormwater Management Facilities Maintenance Agreement for the perpetual maintenance and funding of all post-construction permanent BMP facilities within the Project Site to the written satisfaction of the City Engineer. 21. The following applies to any retaining wall on the site: a. When grading plans are submitted for a grading permit, all retaining walls shall be noted on the grading plans and include a detailed wall profile. b. Structural wall calculations are required if walls are not built per San Diego Regional Standard Drawings or Chula Vista Construction Standard Drawing GRD- 05. c. Retaining walls that will be part of a building wall must be approved as part of the building permit for the Project. Retaining walls around trash bins (if any) shall be noted on the grading plans and called out per City standard. e. Retaining wall drains shall tie into the drainage system. 22. Prior to the issuance of any City permit, and in accordance with the provisions of the Urban Core Specific Plan, the Applicant shall grant an irrevocable offer of dedication of nine (9) feet along the Project’s entire H Street frontage. The dedication shall be consistent with the street frontage improvements of the adjacent Urbana Apartment Community and shall be to the satisfaction of the City Engineer. 23. Prior to the issuance of any building permit within the Project Site, the Applicant shall provide the City with proof of Pad Certification. 24. Prior to the issuance of any City permit, the Applicant shall provide a “Will Serve” letter from the Sweetwater Authority District. 25. The onsite sewer and storm drain system shall be private. All sewer laterals and storm drains shall be privately maintained from each building unit to the City-maintained public facilities. 26. All proposed sidewalks, walkways, pedestrian ramps, and accessible parking shall be designed to meet the City of Chula Vista Design Standards, ADA standards, and Title 24 standards, as applicable. 27. Any proposed private water and fire line structures shall be submitted on a separate building plan and permitted by the Development Services and Fire Departments. 28. Any proposed fire access roads and driveways shall meet the standards set by the Subdivision Manual and Engineering & Capital Project Directive 2024-03 - Traffic Index & Pavement Structural Section Calculations to the satisfaction of the City Engineer or designee. 29. Any proposed trash enclosure shall be a covered trash enclosure meeting the requirements of Fact Sheet SC-Q of the City’s current BMP Design Manual. 30. Prior to the issuance of a construction permit or building permit, the Applicant shall obtain an encroachment permit for any private facilities proposed within public rights-of-way and/or City easements. 31. Prior to grading plan approval, the Applicant shall upload digital files in a format such as AutoCAD .dwg or .dxf (AutoCAD version 2000 or above), ESRI GIS shapefile, or personal geodatabase (ArcGIS version 9.0 or above). The files should be transmitted directly to the GIS section using the City's digital submittal file upload website: http://www.chulavistaca.gov/goto/GIS. The Applicant shall submit a complete set of landscape improvement plans for review and approval by the Director of Development Services or their designee. Prior to the final building inspection, the Property Owner shall have installed the approved landscape improvements in accordance with the submitted landscape improvement plans and shall have had said improvements inspected and approved by City staff, to the satisfaction of the Director of Development Services or their designee. 34. New dwelling units generate Park Acquisition and Development (“PAD”) fees in accordance with CVMC 17.10. Payment of the PAD fee per dwelling unit is required in accordance with CVMC 17.10.100; however, pursuant to Ordinance No. 3324, payment of PAD fees can be deferred to the final inspection. The PAD fee amount shall be based on the rates in effect at the time in which they are due. The PAD fee is adjusted on an annual basis on October 1st, and costs are subject to change at that time. 35. The Applicant shall comply with all requirements and guidelines of the UCSP, including the installation of site amenities such as pedestrian-scale pole lights, benches, tree grates, bike racks, and trash receptacles. These elements shall be shown graphically on the public improvement plans, building plans, and landscape plans prior to plan approval. The Applicant shall provide electrical connection for pedestrian lighting on electrical site plans within the building permit set. BE IT FURTHER RESOLVED that the following ongoing conditions shall apply to the Project Site for as long as it relies upon this approval: 1. The Applicant shall maintain the Project Site in accordance with the approved plans for DR22-0025, which include a site plan, floor plans, and elevations on file in the Development Services Department. The Project shall also maintain compliance with the conditions contained herein and the UCSP UC-2 development regulations, as well as other applicable regulations of the UCSP and the CVMC. 2. Approval of this Project shall not waive compliance with any provisions of the UCSP, the CVMC, nor any other applicable laws and regulations in effect at the time of building permit issuance. The Applicant and Property Owner shall and do hereby agree to timely and fully indemnify, protect, reimburse, defend, and hold harmless the City, its City Council members, Planning Commission members, officers, employees, and representatives from and against any and all liabilities, losses, damages, demands, claims, and costs, including any costs, fees, and expenses to prepare the administrative record for any challenge to the Project approvals and/or compile a response to a Public Records Act request(s) to provide the record of proceedings materials for the Project, the City’s costs to retain its own defense counsel to defend any challenge to any Project-related approvals, court costs and attorney fees (collectively, “liabilities”) incurred by the City arising, directly or indirectly, from (a) the City’s approval and issuance of this permit and (b) the City’s approval or issuance of any other permit or action, whether discretionary or non-discretionary, in connection with the use contemplated herein, and the Applicant shall acknowledge their agreement to this provision by executing a copy of this permit where indicated below. The Applicant and Property Owner’s compliance with this provision is an express condition of this permit and shall be binding on any and all of the Applicant/operator’s successors and assigns. 4. The Applicant shall comply with all applicable requirements and guidelines of the Chula Vista General Plan, the Chula Vista Landscape Manual, the CVMC, and the UCSP, as amended from time to time, unless specifically modified by the appropriate department head with the approval of the City Manager. These plans may be subject to minor modifications by the appropriate City staff with the approval of the Director of Development Services. However, any substantial modifications shall be subject to approval by the Planning Commission. 5. This permit shall expire if not utilized within three years of the approval date (December 11, 2027) or the end of any appeal period unless the Applicant initiates an extension prior to expiration of the permit in accordance with CVMC 19.14.600. 6. Any violations of the terms and conditions of this permit may result in the imposition of civil or criminal penalties and/or the revocation or modification of this permit. 7. The conditions of approval for DR22-0025 shall be applied to the subject property until such time as the approval may be revoked, and the existence of this approval with conditions shall be recorded with the title of the property. 8. The Applicant shall obtain a sign permit from the Development Services Department for each proposed sign. Signs shall comply with all applicable requirements of the CVMC and the UCSP Design Guidelines. 9. In accordance with Mitigation Measure 5.13-1 of the MMRP for EIR 06-01, land uses which use, transport, store, and dispose of hazardous materials shall be conducted in compliance with the relevant regulations of federal, state, and local agencies, including the Environmental Protection Agency (EPA), California Department of Health Services (DHS), and California Department of Transportation. 10. The Applicant shall comply with all applicable requirements and guidelines of the CVMC; the Chula Vista Subdivision Manual; the City of Chula Vista Design and Construction Page 26 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda PC Resolution May 14, 2025 9 Standards; the Development Storm Water Manual for Development and Redevelopment Projects; the City of Chula Vista Grading Ordinance (No. 1797); and the Subdivision Map Act. III. Recommended Action Adopt a resolution approving the Conditional Use Permit (CUP23-0015) based on the required findings and subject to the conditions contained therein. SUMMARY AT&T Mobility (“Applicant”) requests approval of plans to place a new 50-foot faux eucalyptus wireless telecommunications facility and associated equipment enclosure on a 3.89-acre parcel (“Project”). The subject property is located at 940 Hilltop Drive and is presently developed with a church. The zoning designation is Single-Family Residence (R-1) and the General Plan land use designation is Low-Medium Residential (RLM). HOUSING IMPACT STATEMENT No housing is proposed as part of this Project. The subject property is not designated to accommodate any portion of the City’s regional housing needs allocation within the Housing Element of the General Plan. ENVIRONMENTAL REVIEW The Director of Development Services determined that the Project qualifies for a Class 3 categorical exemption under to Section 15303 of the CEQA Guidelines (New Construction or Conversion of Small Structures). The project will not result in a significant effect on the environment, create a cumulative impact, damage a scenic highway, or cause a substantial adverse change in the significance of a historical resource. In accordance with Chula Vista Municipal Code (“CVMC”) Chapter 19.89 (Wireless Telecommunications Facilities), wireless telecommunications facilities are allowed via by Conditional Use Permit within any zone. Facilities that exceed the height limit of the underlying zone must include a stealth design, maintain the minimum height for technological feasibility, and be reviewed by the Planning Commission. Project Site Characteristics The 3.89-acre Project site is on the west side of Hilltop Drive, south of L Street and north of Angela Lane (Attachment 1). Existing single-family residential properties are north, east, and south of the Project site. To the west are single-family and duplex dwellings. The facility also includes an equipment area enclosed by an eight (8)-foot block wall. Other improvements include new landscaping surrounding the ground-level enclosure, which will help to blend the project in with adjacent landscaped areas. Additional planting material along the enclosure walls will provide protection against vandalism and graffiti. The Project will be built to comply with the development criteria specified in CVMC 19.89.060 and all other applicable City zoning and building regulations. Access to the site will be minimized and conducted in a manner that does not negatively impact nearby residents. Height/Stealth Technology Design Page 36 of 100 City of Chula Vista Planning Commission May 14, 2025 Agenda P l a n n i n g C o m m i s s i o n S t a f f R e p o r t P a g e | 3 The proposed stealth facility is designed to provide wireless telephone coverage through the primary residential areas within a half-mile radius of the Project site (Attachment 3). The Applicant has demonstrated that the proposed 50-foot tower height is the minimum technologically feasible height necessary to close a gap in coverage, which will result in providing uninterrupted service to their customers. A facility built at the maximum building height (28 feet) would not be as effective at providing coverage to areas beyond the adjacent buildings constructed to the same height. To minimize visual impacts, the facility has been designed as a faux eucalyptus tree to carefully screen the antennae located on the tower (Attachment 4), and it has been located beyond the minimum setbacks required in the R-1 zone. The closest residential parcels are approximately 23 feet to the south. A noise study conducted for the Project found that noise from the site is expected to be adequately controlled to meet the City’s performance standards. The study modeled significant noise sources while excluding existing ambient noise and other fencing/landscaping that could further reduce noise impacts to properties south or east of the Project. Significant noise sources were identified as the continuously running heat exchangers and battery cabinets, which are located inside the equipment enclosure and surrounded by eight-foot concrete masonry unit (CMU) walls. Location CVMC 19.89.060 requires that wireless facilities allow for co-location to the extent possible. The Applicant complied with a search for co-location opportunities on existing towers within a one-half mile radius of the Project site. The location was selected near the edge of the search area south of Cook Elementary School. An Alternative Site Analysis provided by the Applicant considered two alternative sites to the Project site. Alternative One is not feasible for co-location because it cannot accommodate the Project’s minimum requirements and is located outside of the search area. Alternative Two, while not a co-location, would have ground space available for stealth design. However, it would provide limited coverage because it is outside of the search area, and the property owner will not allow the development of a wireless telecommunications facility on the site. The proposed Project was found to be the best option for providing additional wireless services. The additional height and space on the proposed tower will also provide sufficient space for future co-location by other carriers. CONCLUSION Staff has reviewed the Project and determined that it is consistent with the CVMC and the Chula Vista Design Manual. Staff recommends that the Planning Commission adopt the proposed resolution approving the Project, subject to the conditions contained therein (Attachment 6). DECISION-MAKER CONFLICT Staff have reviewed the property holdings of the Planning Commission members and found no property holdings within 1,000 feet of the boundaries of the Project site. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(7) or (8), for purposes of the Political Reform Act (Cal. Gov’t Code §87100, et seq.). Staff are not independently aware and have not been informed by any Planning Commission member of any other fact that may constitute a basis for a decision-maker conflict of interest in this matter. The chosen site is in a single-family residential zone, R-1. This facility would necessitate the construction of a 50-foot stealth facility as well as relevant equipment inside the base of the tower. As part of the City of Chula Vista’s CUP requirements for wireless facilities, AT&T has also looked for viable alternatives in both design and location to ensure that the facility best supports the community. As demonstrated on the coverage maps provided in Exhibit A, this site is intended to close a gap in coverage through the community, extending farther into nearby commuter roads of L Street and Hilltop Drive. The target area is a residential community consisting primarily of single-family residences that have a need for reliable, fast wireless coverage for leisure, working from home, and emergencies. The proposed location was ideal given its current land use designation as a religious facility, which allows for a fully stealth design in a stealth façade monument. The chosen zone is single-family residential, where wireless communications facilities are discouraged. However, the benefit of such an advantageous location is the coverage of a section of L Street that is highly traveled and where there is a confluence of primarily residential and community uses. This location is zoned as single-family residential, R1. The attractive feature of this site was the ability to collocate as is preferred by the City of Chula Vista. However, with additional review the site became less feasible. There was little feasibility as the existing facility was unable to accommodate AT&T’s needs. Moreover, the facility is located outside of the extended search ring and would provide limited coverage to target objectives. With these considerations in mind, the chosen facility remains the best location. Alternative Site #2 The second alternative site that AT&T considered is similarly a portion of raw land, at the commercial facility with APN: 619-100-49-00. This location is also zoned as neighborhood commercial, CN. The location was appealing due to the ground space available for a stealth design. On the other hand, such a site would be limited in the coverage it could provide due to its position outside the extended search area. Finally, the property owner was uninterested in having a wireless facility on their property. Overall, the existing facility remains the best location when considering all factors. Conclusion AT&T wishes to be the best possible servant to the community and address all jurisdictional concerns. After consideration of multiple factors, AT&T chose the site at 940 Hilltop Drive for expansion of coverage. The expansion of coverage will result in the greatest amount of coverage while limiting the total number of wireless communication facilities in the City of Chula Vista. The site’s zoning designation of single-family residential allows for the best coverage for the residents in the area while keeping distance between their homes and the facility. The site also had the possibility of a fully stealth design that would ensure blending into the background environment in a residential area. AT&T looks to renew its commitment to a partnership with the City of Chula Vista and provide its residents with a reliable source of connectivity. The proposed use at this location is necessary or desirable to provide a service or facility that will contribute to the general wellbeing of the neighborhood or the community. The proposed use will provide expanded wireless communication services to the Chula Vista community, including residential and public facilities, and will improve wireless communication as a public convenience by providing essential communication and improved service in the area surrounding its location. The use will continue to aid in the general wellbeing of the community by improving the reliability of wireless communication in its coverage area. In the event of an emergency or natural disaster, the use will be able to continue to function, which supports the general health, safety, and welfare of the citizens of Chula Vista. 2. The use will not be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity, nor will it be injurious to property or improvements in the vicinity. The Radio Frequency – Electromagnetic Energy (RF-EME) Compliance Report indicates that the proposed installation will comply with Federal Communications Commission (FCC) regulations upon proper installation of recommended signage and/or barriers. The only location in which modeling exceeds the FCC’s general public limit is within approximately 20 feet of the proposed antennas at the utility line level. The adjacent utility pole, between the heights of 35 feet and 38 feet, will not exceed the FCC’s occupational limit and signage will be installed for utility workers. All other areas do not exceed the FCC’s general public limit for safety. The nearest adjacent parcels to the south are greater than 20 feet from the facility with a by-right height limit of 28 feet. To minimize visual impacts, the facility utilizes a stealth design to appear as a faux eucalyptus tree, complimenting existing adjacent landscaping and screening cellular equipment from public views. It will not interfere with any existing activities or conveniences of the public. The proposed use will comply with the specified regulations and conditions in Title 19 of the CVMC. The use will be implemented in compliance with the development criteria outlined in CVMC 19.89.060 and all other City zoning and building regulations. Further, this CUP requires the Applicant and Property Owner to meet conditions of approval in the interest of protecting the health, safety, and welfare of the surrounding community, including compliance with all applicable regulations and standards specified in CVMC 19.89 for the use. 4. Granting this conditional use will not adversely affect the General Plan of the City nor the adopted plan of any governmental agency. The integration of wireless facilities with existing uses helps to implement General Plan Policy PFS 24.1, regarding state-of-the-art wireless facilities, as well as PFS 24.2, regarding siting and design techniques that minimize community impacts. Approval of this permit shall not waive compliance with all applicable provisions of CVMC Title 19 nor any other applicable City ordinances in effect at the time of building permit issuance. 3. The Applicant shall execute this permit only as the authorized use. Any new use or modification/expansion of uses shall be subject to additional review and approval by the Zoning Administrator. 4. The Applicant shall cooperate with telecommunications companies in co-locating additional antennas on the subject property, provided said co-locators have received a permit from the City for such use at the Project Site. The Applicant shall exercise good faith in co-locating with other telecommunications companies and sharing the permitted site, provided such shared use does not give rise to a substantial technical-level or quality-of-service impairment of the permitted use (as opposed to a competitive conflict or financial burden). In the event a dispute arises as to whether the Applicant has exercised good faith in accommodating other users, the City may require a third-party technical study at the expense of the Applicant. 5. Within 90 days of cessation of the business operations and use of the antennas, the Applicant shall submit a substitute user to the satisfaction of the Director of Development Services and/or remove the Project and all associated equipment from the Project Site. If the facility is removed, the Applicant shall restore the Project Site to its original condition. Any changes to this permit shall require a modification to be reviewed by the Zoning Administrator. 6. The Applicant shall comply with the construction and demolition debris recycling requirements as set forth in CVMC 8.25.095, including submittal of a Waste Management Report and possible payment of a Performance Deposit prior to the issuance of a building permit for the Project. 7. The Property Owner and Applicant shall and do agree to fully and timely indemnify, protect, defend, and hold harmless the City, its City Council members, officers, employees, and representatives from and against any and all liabilities, losses, damages, demands, claims, and costs, including court costs and attorney’s fees (collectively, liabilities) incurred by the City arising, directly or indirectly, from (a) the City’s approval and issuance of this permit and (b) the City’s approval or issuance of any other permit or action, whether discretionary or non-discretionary, in connection with the use contemplated on the Project site.
