HomeMy WebLinkAboutcc min 1925/02/17 MINUTES OF AN ADJOURNED :REGULAR MEETING OF THE BOARD OF TRUSTEES, CHULA VISTA, CALIFORNIA, HELD FEBRUARY 17, 1925. The Board met pIlrsuant to adjournment, in the Council Chamber of the City Hall, on the above date, with President Peters in the Chair, who called the meeting to orler at 7:30 p.m. Present I Trustees Peters, Shaw, Bent, Lyons, Wentworth. I_r TELEPH01'E FRANCHISEI The city attorney reported on the status of the matter of a franchise of the Telephone company, citing the case of the city of Turlock, California, which is similar to the one in this city. The case of Turlock has been tried in the Superior Court, and the city was defeated, but the case has been appealed to the Supreme Court,"upon permission of the Attorney General of the State. In the discussion, upon motion by Mr. Shaw, seconded by Mr. Wentworth, it was decided that the application for a franchise from The Pacific Telephone and Telegraph Company, received for file by the city on April 2, 192J, be rejected, for the reason, among others, that the franchise sought by the company, does not provide for the payment of 2% of the gross annual receipts to take effect upon the granting of the franchise, as the Board of Trustees understands Section 3, of Aot 1229, of the General Laws, to mean. Also, the authority given the company to continue the use of the streets of the city without a franchise, in letter dated April 3,1924, is hereby rescinded, and the provisions of Ordinance No. 23, become effective upon the rejection of the application for the above-mentioned franchise. Wentworth offered Resolution No. 115, which is a resolution ordering the work of laying sidewalks as provided in Reso')lution of Intention, No. 114. The resolution was read, and upon motion by Mr. Wentworth, seconded by Mr. Shaw, it was passed and adopted by the following vote, to-wit: AYES: Trustees Wentworth, Bent, Peters, Shaw, Lyons. NOES I None. ABSENT I None. Resolution No. 116: Mr. Lyons offered Resolution No. 116. This is a resolu- tion directing that work of leying sidewalks and curbs as provided in Resoultion No. 114, be performed under the supervision of the city engineer. The resolution was read, and upon motion by Mr. Lyons, seconded by Mr. Shaw, it was passed and adopted by the following vote, to-wi tl AYES. Trustees Lyons, Wentworth, Bent, Peters, Shaw. NOESI None. ABSENT. None. ORDINANCE NO. 1201 Upon motion by Mr. Wentworth, seconded by Mr. Shaw, which carried, Ordinance No. 120 was placed on its second and final reading. This is an ordinance providing for trimming street trees by the city tree warden. The ordinance was read, and upon motion by Mr. Wentworth, seconded by Mr. Shaw, it was passed, adopted and approved, -s read, by the following vote, to-wit: AYES I Trustees Wentworth, Peters, Shaw, Lyons. NOES I Bent. NOES I None. ORDINANCE No. 1211 Upon motion by Mr. Wentworth, seconded by Mr. Lyons, which carried, Ordinance No. 121, was placed on its second and final reading. This is an ordinance providing for parking vehicles on t he streets of the city, and prohititing the parking in certain places. The ordinace was read, and upon motion by Mr. Wentworth, seconded by Mr. Lyons, it was passed, sdopted and approved, as read by the following vote, to-wit: AYES I Trustees Wentworth, Bent, Peters, Shaw, Lyons. NOES I None. ABSENT. None. ORDINANCE NO. 122. Upon motion by Shaw, seconded by Mr. Lyons, Ordinance No. 122 was plaoed on its first reading. This is an ordinance amending Ordinance No.llO, providing for licensing certain businesses and occupations. ,r- TRIMMING TREESI Upon motion by Mr. Lyons, seconded by Mr. Shaw, the tree warden was directed to trim trees and shrubbery in the following places, the trimming to be of such nature that the foliage will not obstruct the view of motorists at these intersec- tionsl The southeast corner of National Avenue and J Street, :I. Palm and 1 jlepper tree; South side of J Street, at Second Avenue, 1 Pepper tree; see the agent of the property and endeavor to have more shrubbery trimmed out at the southeast corner of National Avenue and E Street; northeast corner of First Avenue and H Street, hedge; northeast corner of G Street and First Avenue; the street ~perintendent to attend to moving the brush so trimmed. The tree warden was also instructed to retrim the trees on G Street, between First and Second Avenues, making the trim even all around, and not just that portion that hange over the street; this style of trimming to govern in all the trimming in the future. !lotion carried. The removal of the rubbish to done by the property owners who are permitting it to be piled at that point. Meeting of February 17,1925, Continued. ADDITIONAL STREET LIGHTSI In the matter of an order of additional street lights, ordered at the meeting of Deoember 15, 19~, the clerk reported that it will cost $395.00 to install the light at K Street and 4th Avenue, and $227.00 to install the one at I Street and 2nd Avenue. This charge for the installation will be made owing to the distance it will be necessary to 9%tend the lines of the light company. However, if two lights are installed at these points, or one installed between the point desired and the source of the current, then no charge will be made. The clerk directed to oanoal that part of the order for new lights pertaining to the two mentioned above. LEAGUE OF COU!~Y MUNICIPALITIES: Four menus of a dinner to be served by the Methodist and Congregational churches, for the meeting of the League of County Municipalities to be held in this city, Jlarch 6, 1925, were presented and consid- ered. It was decided to accept the one presented by the Congregational church, at $1.00 per plate. ,r- "GRAVEL. SALE OFI Mr. Bent, seconded by Mr. Wentworth, moved that the action taken at a meeting of Deoember 15, 1924, which action prevented the sale of gravel to a:a;yone for ~ purpose, be rescinded, and that in future the city sell gravel to any resident of the city, in small quantities only. After discussion, the motion was lost on the following vote, to-witl AYES I Trustees Bent, Wentworth. NOES I Trustees Peters, Shaw, Lyons. IBSENT. None. PURCHASE OF ADDITIONAL FI:RE EQUIPMENT. The clerk read a letter from the fire chief requesting authority to purchase several small articles of fire equipment. Matter referred to the fire colJlllittee, with authority to act, upon motion by Mr. Wentworth, seconded by Mr. Shaw, which carried by the following vote, to-wit: AYES I Trustees Wentworth, Peters, Shaw, Lyons. NOES I None. ABSENT I None. Mr. Bent did not vote. BILLS PAIDI Upon motion by Mr. Shaw, seconded by Mr. Wentworth, bills, as examined by the finance committee, were ordered paid. 4883 Jack M.
