MINUTES OF A REGULAR MEETING OF THE BOARD OF TRUSTEES, CHULA VISTA, CALIFOBNIJ.,
HELD SEPTEMBER 1, 1925.
The Board met in regular session in the Council Chamber Of the City Hall, on the
above date, with President Peters in the ohair. Meeting oalled to order at 7:00 p.m.
Present: Trustees Peters, Lyons, Wentworth, Shaw, Bent.
READING OF MINUTES: The minutes Of the last regular meeting Of August 4, 1925,
and an adjourned regular meeting of August 18, 1925, were read, and after oorreoting
the minutes of August 18, 1925, relative to Janitor work of the city hall, they were
approved.

SIDEWALKS - PROTESTS: The city clerk announced that there were two protests
on file against the work of laying sidewalks and curbs on the work ordered by resolu-
tion of intention No. 114. The protests were filed by Leo Schroeder, owner of a
parcel of land on 3rd Avenue, and Virginia V. Shaw, owner of a parcel of land on
E Street. Mr. Schroeder complained that the price of completing work appeared ex-
oessive, with no specific statement. Inasmuoh as the work had been performed under
a specifiedoontract price, after due advertising, the cheapest price accepted, noth-
ing could be done in his case. Virginia V. Shaw complained against the quality Of
the work performed, the price, and made a general statement that the .assessments
were incorrect and illegal, with no specific items mentioned. J. M. Loop, who
made the assessment, stated that the assessment was correct and legal, and in the ab-
sence of aDY evidence to the contrary, his statement was accepted. The oity engineer
and superintendent of streets both stated that they had inspected the work and found
it to be a good and workmanlike job. They refuted the statement in the protest that
some of the expansion joints were over an inck in width, with the stat.ent that two
were about one-fourth Of an inch in width, only, and that the surface was in accordance
with the contract requirements. A Mr. Weiss verbally supported the protest, but could
not make any specific charges further than was stated in the written protest. Mr.
C. O. Nelson, the contractor, stated that he had been approached recently by Mr. Weiss
with the proposition that if Nelson would accept a discount in the price, the Shews
would make him a cash payment for the work. Upon Nelson refusing to accept the proposi-
tion, Nelson stated that Weiss then advised him that a protest would be made.
After all evidence had been hear4, Mr. Wentworth offered Resolution No. 131, which
is s. resolution dismissing the appeal and apnroving and ratifying the assessment and
diagram of the work. The resolution was read, and upon motion by Mr. Wentworth, seo-
onded by 1~. Shaw, the resolution was passed, adopted and approved by the following
vote, to-wit: AYES: Trustees Wentworth, Bent, Peters, Shaw, Lyons. NOES: None.
ABSENT: None.
FIRE ZONE. WOODEN BUILDINGS THEREIN: Fred Winer complained to the Board that
he was refused a permit to construct a wooden garage on his lot, in the fire zone,
yet a wooden ice box had been constructed on the lot at the southwest corner of F
Street and Third Avenue. He, therefore, requested permission to erect the garage, which
he had originally asked for. The building inspector advised that he had conferred with
the fire chief, at the time the ice box was erected, and they had concluded that the
ice box was not a building, as such i. defined in the ordinance. Upon motion by Mr.
Wentworth, seconded by Mr. Shaw, which carried, the request of Mr. Winer to construo'
a frame garate on his lot, was denied.
After discussion, and upon motion by Mr. Lyons, seconded by Mr. Shaw, it was
decided to have the owner of the ice box make it to comply with the fire zone ordinance.
the motion carried by the following vote: AYES: Trustees Lyons, Bent, Peters, Shaw.
(:Mr. Wentworth not voting) NOES: None. ABSENT: None.

SIDEWALKS: C. O. Nelson, contractor for sidewalks recently laid, under Resolution
of Intention No. 114, in a written request, applied for an extention of time for the oom-
pletion of his contract, for a period of 30 days. The request was dated August 29,1925.
Upon motion by Mr. Shaw, seconded by Mr. Wenttrorth, the request was granted by the follow-
ing vote, to~it: AYES: Trustees Shaw, Lyons, Wentworth, Bent, Peters. NOES: None.
ABSENT: None.
PRINTING: The matter Of printing 3000 citation blanks for the police depart-
ment, by the Chula Vista Star, was again brought up for consideration. The records
showed that the above mentioned work was rejected by the Board, at its meeting Of June
23,1925, for the reason that the peper used in the work was not Of the kinA required
by the specification for printing. The publisher of the Star requested that the matter
be compromised by the city accepting the printing at a reduced cost, if no other method
40uld be arrived at satisfactorily. The city attorney advised the board that no com-
promise could be effected; that the work must be either accepted or rejected; that a
compromise would indicate that the.work had not been performed according to contract,
and would not be legal to accept it under such conditions. Mr. Shaw then moved that
the action Of the board of June 23,1925, which rejected t1is work, be rescinded, and
that the work be accepted. The motion was lost for the want of a second. This leaves
the action of June 23,1925, in full force, and the printing is rejected.

Meeting Of September 1,1925.
TRI1WING TREES: R. M. Pray asked the board to have some trees trimmed, where the
branches hang so low that they interfere with pedestrians on the sidewalks. He cited
several places. The tree warden was ordered to trim all trees in the city requiring
it, where the branches interefered as above set forth.
The question of removing brush from tree trimming was diScussed, and the fact was
brought out that such brush is sometimes allowed to remain where it falls for some time.
The tree warden was ordered to notify the street superintendent, in writing, keeping a
copy Of the notification, every time he trims trees, and the street superintendent was
instructed to remove the brush at once, upon notification.
PLANNING COMMISSION: The minutes of meetings of the Planning Commission,
of July 27, August 24 and 31, 1925, were read, and upon motion by Mr. Lyons, seconded
by :Mr. Wentworth, they were received .and filed. Motion carried.
PLAZA IN THIRD AVENUE: '!.'he tree warden having stated that a sprinkling system
should be installed in the above plaza, with which to properly irrigate the flowers
'therein, he was instructed to confer with the city clerk, and to obtain prices on
a system installed.
PERIODICAL REPORTS: The monthly reports of the city recorder and community nurse
for the month of August, 1925, were read, and upon motion by Mr. Shaw, seconded by Mr.
Lyons, which carried, were ordered filed.
FIRE CHIEFS' CONVENTION: A letter from the Pacific Coast Association Of Fire Chiefs
in which, in invitation to Fire Chief Smith of this city, to attend the annual convention,
to be held in Seattle, Washington, was read. Upon motion by Mr. Bent, seconded by:Mr.
Shaw, the letter was ordered received and filed. Motion carried by the following vote:
AYES: Trustees Bent, Peters, Shaw, Lyons, Wentworth. NOES: None. ABSENT: None.
REMOVAL OF STREET TREE: Mrs. Dora P. Slauson requested permission to remove an
olive tree from the street, at the corner of J street and Church Avenue, for the reason
that the tree is unsightly and covered wi th scale. Referred to the Planning Commission,
upon motion by Mr. Bent, seconded by:Mr. Lyons, which carried.
VACATION: Traffio Officer Byers asked, in writing, for a vacation for a period
of 15 days, from October 2,1925, under the provisions Of Aot 6010, of the California
Gneral Laws, which recites that where there is a regularly organized police force, each
officer will be given 15 days vacation, with pay, each year. The question 01 whether or
not this city has a regular organized police force was referred to the city attorney for
a decision. After consulting the law, the city attorney decided that this city has a
regular organized police force, and upon motion by Mr. Wentworth, seconded by :Mr. Lyons,
which carried, the request for the vacation was granted.
GRADING FIFTH AVENUE AND K STREET: ALSO CHANGING CHANNEL OF CREEK: '!.'he oi ty attor-
ney presented an agreement, signed by E. F. Chase, accompanied by a plat, said agree-
ment authorizing the city to change the present course of a ravine now in 5th Avenue,
to a location on the land owned by Mr. Chase, piovided that the oi ty grade 5th Avenue
from J to K Street, and K street from 5th to 6th Avenues. Upon motion by :Mr. Went-
worth, ~eoonded by Mr. Bent, the agreement and plat were accepted and all conditions
therein contained were accepted and approved. The motion carried by the following vote,
to~1t: AyES: Trustees Wentworth, Bent, Peters, Shaw, Lyons. NOES: None. ABSENT: None.

POLES AND TROLLEYS ON STREETS: The oi ty attorney was instructed to again take
up with the San Diego and Arizona Railway Company, the matter Of removing the poles and
wires formerly used by the San Diego Eleotry Railway Company, from the streets of the
city. Some Of these poles are now considered a menace and unsafe, and the city attorney
was instructed to ask the railway company to either to make the poles safe, or fix a
definite date when they will be removed. This action taken . upon motion by :Mr. Shaw,
seconded by Mr. Lyons, which carried by the following vote: AYES: Trustees Shaw, Lyons,
Wentworth, Peters. NOES: None. ABSENT: None. (:Mr. Bent did not vote)
SCHOOL CHILDREN CROSSING STREET: Upon motion by Mr. Shaw, seconded by Mr.Lyons,
the police department was directed to have an offioer at the intersection Of F Street
and 3rd Avenue, at the hours that the school children are crossing at that point, t~e
officer to so control traffic that the children will not be endangered.
VACATION: Street Superintendent Schraeder asked for a vacation for a period of
two weeks, wommenoing about Sept. 4,1925. Upon motion by Mr. Bent, seconded by:Mr.
Shaw, the request was granted.
LIBRARY BOARDI President Peters nominated :Mrs. H. H. Wentworth as a member Of
the library board, vice Perry A. Clay, deceased. Upon motion by Mr. Lyons, seconded by
Mr. Shaw, the nomination was confirmed.
