RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA (1) APPROVING AN AGREEMENT WITH THE
SBCS CORPORATION FOR DOMESTIC VIOLENCE
SERVICES; AND 2) AUTHORIZING AND APPROPRIATING
INTEREST EARNED ON AMERICAN RESCUE PLAN ACT
FUNDS THEREFOR
WHEREAS, on March 11, 2021, the United States Congress passed the American Rescue
Plan Act of 2021 (“ARPA”) – CDFA 21.027, which provides fiscal relief funds to State and Local
Governments, and other program areas aimed at mitigating the continuing effects of the COVID-
19 Pandemic; and
WHEREAS, ARPA funds are intended to provide support to local governments in
responding to the impact of COVID-19 and in their efforts to contain COVID-19 in their
communities, residents, and businesses; and
WHEREAS, ARPA funds have included State and Local Fiscal Recovery Fund (SLRLF)
payments to support urgent COVID response efforts to decrease the spread of the virus; to replace
lost public sector revenue to strengthen support for vital public services; to support immediate
economic stabilization for households and businesses; and to address systemic public health and
economic challenges that have contributed to inequal impacts of the pandemic on certain
populations; and
WHEREAS, interest earnings on SLFRF payments are not subject to the requirement of
the Cash Management Improvement Act and Treasury’s implementing regulations at 31 CFR
Part 205 to remit interest to Treasury, are not subject to the requirements of 2 CFR 200.305(b)(8)
and (9) to maintain funds in an interest-bearing account and remit interest earned above $500 to
Treasury, and are not subject to program restrictions; and
WHEREAS, the City Council intends to expend a portion of the City’s ARPA Funds in
accordance with Federal Law and guidance, for the current critical needs and priorities including
the provision of domestic violence response services, and
WHEREAS, SBCS Corporation (“SBCS”) through their Domestic Violence Program
provides therapeutic counseling and crisis intervention services to adult and children victims of
family violence including those impacted due to the pandemic; and
WHEREAS, City desires to provide funding to the SBCS Domestic Violence Program to
assist SBCS to maintain and increase their ability to respond to calls and provide assistance to
victims; and
WHEREAS, SBCS warrants and represents that it is experienced and staffed in a manner
such that they can prepare and deliver the services required by the City; and

WHEREAS, the City desires to appropriate $50,000 in American Rescue Plan Act interest
earnings for this effort, as allowed under the Coronavirus State and Local Fiscal Recovery Funds
Final Rule (31 CFR Part 35).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista,
that it appropriates $50,000 for the Family Violence Response Team.
BE IT FURTHER RESOLVED that the City Council approves the City of Chula Vista
Contractor/Service Provider Services Agreement to Provide Emergency Domestic Violence
Services, between the City and SBCS Corporation, in the form presented, with such minor
modifications as may be required or approved by the City Attorney, a copy of which shall be kept
on file in the Office of the City Clerk, and authorizes and directs the City Manager or designee to
execute same.
