JULY 3, 1928.
The Council met in regular session, on the above date, in the Council Chamber
of the City Hall, with Mayor Peters presiding. Masting called to order at ?:00 p.m.
Present: Mayor Peters, Councilmen Barnes, Hawkins, Scott. Councilman Lyons absent.
READING OF MINUTES: The minutes of the last re~,la~ meeting of ~une 5, 19~-8, and
of adjourned regular meetings of ~u~e llth and 12, 1928, were read and approved aa
read.
A~.HIODICAL REPORTS: The monthly reports of the City Sudge and Fire Chief, for the
month of ~une, 19~, Sogether with the quarterly report of the Chief of Police on im-
pounding, for the quarter ending Yune SO, 19P~, were read, and ~dered received and filed
Ww~B 0T.W. ANING: Mr. W. N. Drew verbally stated that he had been info~med that
R. ~. Wharton, official in charge of weed oleaining throughout the city, had stated
that Drew'e land must be hoed, and not burned, the same as other property, l~harton
denied any such statement, but said he had said that where Drew'~ l~d had bee burned
off only partially, the helance r~,-ining, clumps of weeds and grass, would have to
be hoed out. No action taken.
SUBDIVISION: The Developers of a subdivision, known as ~A~borside No. ~, pre-
sented a map of their subdivision, for approval, it lying within three miles of the
city limits, and having been approved by the City Pl~tng Co~mu~esion, upon motion
by Cl. Hawkins, seconded by Cl. Scott, the plat was approved, and the city officials
required to sign atone were directed to es sign. Marion carried by the following vote
to-wit: AYES: 01. Hawkins, Barnes, Peters, Scott. NOE~: None. ABSENT: C1.L~one.

REPLACING STREET ~w.~: Tree Wax. den Elliott again presented his bill for $4.75
for furnishing trees to replace trees in front of F. W. Stafford's property. The bill
was allowed, but the clerk, in refunding the deposit of Stafford, will deduct $4.2§
therefrom, as cost of the tress replaced.
SI~EW~W.w~ No. ~: Victor Tessitore asked whet action is being taken in getting
out bonds for the work of sidewalks on Flower Street. City E~gineer Capwell advised
that he employed Y. M. Loop to get out the assessment roll, and did not know how the
work is progressing. Council advised city engineer to get behild Loop and get some
action.
COUNTY LEAGI]E OF MUNICI~.ALITIES: This organization being entertained by this
city on ~nly 13, 19P~, the council agreed to accept the ?§¢ menu fc~ the dinner, as
presented by the Ladies of the Congregational Church.
VACATION~: Fire 0hief Smith asked for a vacation for W. B. Sewett, Fir~,
fo~ ten days, ~nl¥ 9, to 18, 192~8, inclusive. Upon approval of Cl. E~ons, ', the
request was granted. Motion by 01. Scott, seconded by Cl. Barnes, carried.

ACQUISITION AND I~0VEMENT DISTRICT, No. 1: A letter of appreciation for cour-
teous treatment whild executing a contract for the city, by the city officials, was
received from the Miracle Construction Company. After reading, ordered filed.

C0~UNITYII~SE: A letter fr~m the CommUnity Nurse was presented and read, in
which she asks for an increase of $6.00 per month in salary, and for a vacation from
euly 16, 1928, to August 16, 1928. A report of the number of eases attended by the
nurse,resulted in instructions to the nurse, through the city health officer, that
she will not attend cases where bedside nursing is required, except in cases where
the parties requiring her services are charitable cases, and except in emergency
cases. She will decline to attend any calls for bedside nursing where the parties
calling her are financially able to provide the services. The request for an increase
in salary, and the vacation desired, together with the instructions above set forth,
were covered by motion by Cl. Hawkins, seconded by Cl. Barnes, granting the two re-
quests, which carried.
SEWE~ SYSTEM: A petition, signed by a number of property owners, was presented
and read, in which it is requested that the instructions of this coUncil that all house
connections must be made to the sewer system by Autust 5, 19P~, be a~ulled, and per-
sons having septic tanks in working condition, be permitted to continue their use as
long as serviceable, was, upoh motion by Cl. Scott, seconded by Cl. Barnes, which car-
ried, denied, due to the fact that it would not be Just to those who have already complied
with the instructions.
PAVING THIRD AVENUE: 0ontracts with the Griffith Company f~r paving Third Avenue
from E to L Street, l~Were presented for signature of the proper city off~lciale, together
with the bonds g,,a~anteeing the contract. Upon motion by Cl. Scott, seconded by Cl.
Hawkins, the proper officials were authorized and directed so sign and approve the above
instruments. Motion carried by the following vote, to-wit: AYES: Cl. Scott, Hawkins,
Barnes, Peters. NOEB: None. ABSENT: teems Cl. Lyons.
MASTER pLAN OF ~ cITY: The city attorney presented a resolution by the Plan-
ning C~m, tssion, passed by that body June 29, 1928, which resolution adopts the Mester
Plan for the city.
01. Hawkins offered Resolution No. 250, which is a resolution setting 7:00 P.M.,
August 7, 1920, as the time for a hearing on the final adoption by the CoUncil of the
Master Plan presented. The resolution was read, and was passed adopted and approved,
by the following vote, to-wit: AVZq: Cl. Barnes, Peters, Scott, Hawkins. NOES: None.
ABSENT: Ol. Lyons.
PLANNING C0~ISSIONMINUTES: Minutes of the P]-~ntng Commission meetings,
were presented, and action taken as follows:
May 22, 1928: No action required or taken by this body.
May ~9, 1928: Approved payment f~r bills contracted in developing the Athletic
Park, to include the bill for plumbing, -mount $144.00, plus' cost of a gate valve, which
installed. Removing trees of C. S. Martin, approved. See below, case of Hawley.
Sane ~, 1928: Approved the employment of Kenneth Gardner for plan for
Athletic Park.
Approved the deduction of $4.25 from deposit of F. W. Stafford for replace-
ment of street ~rees, and payment of M. C. Elliott's bill of $4.?5, in connection with
this same project.
Approved the removal of t~eea by H. W. Hawley, provided he deposits with the
City Clark, $5.00 for each tree to be removed. (In this connection, it was suggested
by the Cit~ Council that in all eases where trees are to be removed, that the original
request be approved, or disapproved, and turned over to the City Clerk, who will
lect the deposit before the permit to remove the trees ia issued. This method will
comply with the provisions of the c~dinances covering this subject, which provides that
the Planning C~esion approve, or disapprove requests, only, and the Council grants
the permission)
0RDINANGE No. 1~4: Upon motion by Cl. Barnes, seconded by 01. Scott, which car-
ried, Ordinance No. 1~4 was placed on its second and final reading. It was read, and
was passed, adopted and approved, as read, by the following vote, to-wit: AYES: Cl.
Scott, Hawkins, Barnes, Peters. NOES: None. ABSENT: Cl. Lyons.
C~DINA~OE No. 185: Upon motion by Cl. Hawkins, seconded by Cl. Scott, which
carried, Ordinance No. 155 was placed on its first reading. This is an ordinance re-
moving the fire zone from National Avenue.
0~DINANOENo. 1~6: Upon motion by Cl. Scott, seconded by Cl. Hawkins, which
ca~ried, Ordinance No. 186 was placed on its first reading. This ia an ordinance pro~
hibiting the erection, of board -~ barton buildings for business purposes.

HOUSE ~VING: The city attorney was in~tructed to prepare an ordinance requiring
any person performing the business of moving buildings, in the streets of the city,
to deposit a cash bond, in each case, bef~e a permit will be issued, to insure the city
against damage to street trees, or other
LEAVE 0FAB SENSE: Mayor Peters asked for and was gra~ted a leave of absence, with
permission to leave the state, for a period of 30 days, upon motion by Cl. Scott, sec-
onded by Cl. Barass, which carried. It was decided that Cl. Barnes will be acting mayor
during the absence of Maker Peters.
COPT CLI~K: It was decided that the clerk fc~ th~ city court shall receive a
· salary of $100.00 per month, and shall be en~loyed full time, until the w~rk in the
city court is brought up to ~ate. Metion covering by Cl. Hawkins, seconded by 01. Scott,
which carried.
