HomeMy WebLinkAboutcc min 1928/08/07~LINL1TES OF A REGULAR MEETING OF THE CITY COUNCIL, C~ VISTA, CALIFORNIA, HELD AUGUST 7, 1928. The Council met in regular session, in the Councl~ Chamber of the City Hall, on the above date. Present: Councilmen Lyons, Hawkins, Barnes, Scott. In the absence of Mayor Peters, the Clerk called the meeting to order at 7:00 p.m. Counci~mRn Scott moved, seconded by Cl. Lyons, which carried, that Cl. Barnes act as Mayor, and take charge of the macing, which he did. BEANING OF MINUTES: The minutes of the last regular meeting of July 3, 19~8, were read, and approved as read. PERIODICAL REPORTS: The reports of the City ~udge, Fire Chief, for the month of Yuly; the report of the City Treasurer, for the Quarter ending Yune ~0, 1928; the ,n~ual report of the City Clerk, and a special report on the financial status of the weed cleaning operations for the year 1928, were read. Upon motion by Cl. Scott, sec- onded by Cl. Lyons, which carried, all reports, except the annual report of the city clerk, were ordered received and filed. The annual report was ordered publiched, as required by law. MAST~H PLAN HEARING: This being the time set for a hearing on the adoption of the Master Plan of the city, the map was produced end Messrs. Geo. N. Brown, Geo. B. Gordy and 0. T. Floodberg, discussed with the council various phazes Sf the Master Plan. Mr. Brown objected to the width of the street plRnned for going through his property in ~-Section 136; the street pl-nned is 60 feet, while Mr. Brown thought 40 feet would be sufficient. The map was referred back to the City Planning Com- mission,to change the manner of the street going through Lots 11 and 12, of Pray's Orange Villa Tract. Thio street to be eliminated through these lots. This action covered by motion by Cl. Scott, seconded by Cl. Hawkins, which carried. BRIDGE ON FL~'I'n AVENUE: In the matter of constructing a concrete bridge on 3th Avenue, between Y and K Streets, after discussion, it was referred to the Street Department. S~H CONNECTIONB: ~. H. L. 01mstead appeared before the council, and com- plained against the m~nner in which the city had run a conmection into his property on G Street; he claimed that the connection is so shallow that the sewer pipe in his lot is not below the surface sufficient for safety. The Sewer Inspector took the floor, and stated that this connection was the same as all others; that is was ~ feet deep at the property, and allowed over the ~ inch fall required by ordinance; that if any change is now made, it will mean digging up and destroying the pipe now laid. After discussion by council, the matter was referred to the Sewer Inspector to confer with Mr. 0lmstead, and satisfactoryily adjust the matter without digging up the connec- tion. G STREET TO BkY: The clerk presented a deed to a strip of land, 20 feet in width from Tracy Brick and Art Stone Company, to the City, together with a release from the provisions of a mortgag~on this land, for approval by the council. Cl. Hawkins of- fared Resolution No. 2§0, which is a resolution accepting the deed fort~e property. It was read, and was passed, adopted an~ approved, as read, by the following vote, to-wit: AYES: Cl. Scott, Lyons, Hawkins, Barnes. NOES: None. ABSENT: Cl. Peters. VACATIONS: Upon motion by Cl. Scott, seconded by Cl. Lyons, which carried, Chester Norm,n, employed by Planning Cmmaissio~ was granted a vacation from Sept. ~, to 9, 1928, with full pay. Upon motion by Scott, seconded by Cl. Lyons, City Attorney Andrews was granted a two week's vacation, with pay, to be taken during AUgUSt, or September, 192~. Motion carried. REWARD~ CAP~n~E 0~_GEI~.~I~:.~: The clerk read a letter from the San Diego Poultry Association, wherein it was stated that a check for $100.00 had been forwarded to the city as a reward for t~e capture of some chicken thieves recently. The clerk advised that he had the cheek in ~uestion, and upon motion by Cl. Scott, seconAed by Cl. Lyons, which carried, the matter was referred to Cl. Hawkins to adjust, by dividing the reward among those entitled to receive it. RER00F CITY GARAGE: Cl. Scott reported that the city garage was in need of reroof- lng, and upon motion by Cl. Lyons, seconded by Cl. Hawkins, he was authorized to have the work performed. Motion carried. Meeting of August 7, 19~8, Continued. EQUIP~7~NT FOR CITY GARAGE: Cl. Scott reported that the city garage was in need of an electric hand drill, to cost approximately $?3.00. Upon motion by Cl. Lyons, seconded by Cl. Hawkins, the purchase was authorized. Motion carried. LI~Y BOARD: Mayor Barnes nominated ~rs. Helen Wentworth to succeed herself for another term, as a member of the City Library Board. The nomination was confirmed upon motion by Cl. Hawkins, seconded by Cl. ScoSt, which carried. GAS TANK IN STREET: C. C. DeBoyer, in a letter, requested permission to install a gasoline tank and p~p, at the curb, in front of his new place of business, on F Street. A permit to install the tank and p~m~p, as requested, which request i~ re- vokable at the pleasure of this council, was granted upon motion by Cl. Scott, seconded by Cl. Lyons, which carried. PERMANENT FIREMAN: The written resignation of W. B. Jewett, effective July 31, 19~8, as a city fireman, (engineer) was read. The resignation was accepted upon motion by Cl. Hawkins, seconded by Cl. Lyons, which carried. A letter from the fire chief, reco~aending the appointment of Morris Lamb, as engineer, fire department, effective August 1, 19~8, was read. The appointment of Lomb was confirmed upon motion by Cl. Hawkins, seconded by Cl. Lyons, which carried. FIRE HYDRANT AT CITRUS ASSOCIATION PACKING HOUSE: A written request for a fire hydrant at the packing plant of the C. V. City Citrus Association, was read, and the request was granted, authorizing the fire department to have the hydrant installed, upon motion by Cl. Scott, seconded by Cl. Hawkins, which carried. LUBRICANTS FOR STREET MACHINERY: A contract, renewing the former contract for lubricants, for street machinery, was presented by the Union 0il Company f~r accept- ance. The street superintendent hav~lng reported that the product of this company has heretofore been satisfactory, the Acting Mayor was authorized and instructed to sign the renewal contract for and on behalf of the city. Notion by Cl. Lyons, seconded by Cl. Hawkins, which carried. REPAIR OF POLICE L~ACHINE: In the matter of repairing an automobile belonging to the Chief of Police, d~ed in apprehendinE a law violator, amounting to a charge of $~0.00, after discussion, it was referred to Cl. Hawkins, to have the damaged machine appraised by an automobile appraiser in Sau Diego, to ascertain the actual value of the machine. SIDEW:~S 0NFL0~ S'IP~EET: Tt~ city engineer presented the assessment roll covering this work, and the clerk having reported that there were no protests filed against th w~k, ~ud no one appearing to protest the work, Cl. Lyons offerred Resolu- tion No. 2Sl~which is a resolution accepting the work, and directing the issu~n-~ ~f a warrant covering same. The resolution was read, and was passed, adopted and approwd, as read, by the following vote, to-wit: AYES: Gl. Scott, Lyons, Hawkins, Barnes. NOES: None. ABSENT: Cl. Peters. POLICE 0FFIG~: Upon motion by Gl. Hawkins, seconded by Cl. Scott, which carried, Traffic Officer Y. L. Emde, heretofore employed as a temporary officer, was permantly appointed, at the same salary as other traffic officers, effective August l, 1928. PI~ING C0~SION~INUTES: The minutes of a meeting of the City Planning Com- mission, held Yuly 2~, 19~8, were read, and action taken as follows: Removal of stumps, bushes and trees in front of property owned by W. R. Edwards, on Nation Aavenue, as requested tM said Edwards, was authorized. No action was taken on the recomuendation in connection with the plaza in ~hlre Avenue. A vacation of one week, only, was granted to ~hes~cri:Norman, as he is not en- titled to more than that, until he has been continuously in the employ of the city for two years. ORDINANCE No. 185: Upon motion by ~1. Scott, seconded by Cl. Lyons, which carried, Ordinance No. 18~ was placed on its second and final reading. It was read, and was passed, adopted and approved, as read, by the following vote, to-wit: AYES: Cl. Scott, Lyons, Hawkins, Barnes. NOES: None. ABSENT: Gl. Peters. ORDINANCE No. 188: Upon motion by Cl. Hawkins, seconded by Cl. Lyons, which carried, 0rdinanee No. 188 was placed on its second and final reading. It was read, and Was passed, adopted and approved, as read, by the following vote, to-wit: AYES: Gl. Hawkins, Barnes, Scott, Lyons. NOES: None. ABSENT: ~. Peters. Meeting of August 7, 1928, Continued. ORDINANCE No. 187: Upon motion by Cl. Scott, seconded by Cl. Hawkins, which car- ried, Ordinance No. 187 was placed on its first reading. This is an ordinance setting 7:30 p.m., as the hour of regular council meeting, instead of 7:00 p.m., as here£ofore. ORDINANCE No. 188: Upon motion by Cl. Scott, seconded by Cl. Hawkins, which car- ried, Ordinance No. 188 was placed on its first reading. This is an ordinance providing regulations for house moving in the city, and repealing the old ordinance on this subject. ORDINANCE No. 189: Upon motion by Cl. Lyons, seconded by 01. Scott, which car- ried, Ordinance No. 189 was placed on its first reading. This is an ordinance provid- ing a penalty for parking over time in the business district. RE~0VING T~ FROM STREET: Cl. Lyons brought up the subject of removing the large pepper treet, growing in the street, on F Street, negr Third Avenue, with the statement that the tree will interfere with the construction of the store building to be constructed on that cc~ner by Hellere, Inc. Inasmuch as removal of the tree is necessary before the planning comnission will meet again, the removal of the tree was authorized upon motion by Cl. Lyons, seconded by Cl.
