Recommended Action: Conduct a public hearing and adopt a resolution approving Design Review Permit No. DR22-0023 based upon the required findings and subject to the conditions contained therein. SUMMARY Baldwin & Sons, LLC (“Applicant”) requests approval to construct a mixed-use development on Parcel MU-1 of the Otay Ranch Village Two SPA, including 31, for rent, townhomes with associated amenities, parking, a commercial event venue, and landscaping (“Project”). The vacant 1.8-acre site is located just off the northeast corner of Santa Carolina Road and Santa Victoria Road (“Project Site”). ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the Project for compliance with the California Environmental Quality Act (“CEQA”) and determined that the Project was adequately covered in the previously adopted FEIR for the Otay Ranch Village Two SPA Plan (EIR 02-02; SCH#2003091012; and incorporated by reference in the certification of Final SEIR 12-01 by Resolution No. 2014-207 on November 4, 2014). Therefore, no further environmental review is required. HOUSING IMPACT STATEMENT The Project Site is within the MU zone of the Otay Ranch Village Two SPA, which allows commercial and residential uses. The proposed Project will increase housing supply in the Otay Ranch Village Two SPA by adding 31 for-rent townhomes. There are no affordable housing units provided within the Project. An Affordable Housing Agreement for Otay Ranch Village Two was executed on April 4, 2011 and recorded on February 1, 2012. Each individual developer’s affordable housing obligation is prorated based upon the total number of units to be constructed within that developer’s related ownership interest, and that obligation is satisfied as provided for in the Affordable Housing Agreement. This action does not include any changes to the applicable affordable housing requirements in Village Two. Page 5 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda Planning Commission Date: September 27, 2023 Page No. 2 DISCUSSION The proposed Project is consistent with the City of Chula Vista’s General Plan and compliant with Title 19 of the Chula Vista Municipal Code (“CVMC”), as well as the Otay Ranch Village Two SPA Plan. The proposed Project will provide the required minimum parking outlined in the SPA plan and landscaped areas complementing the design of the proposed buildings. Site amenities include an outdoor common area in the center of the site featuring tables and chairs, a raised planter and seat wall, and a walking path providing a connection – through the Project Site – from the adjacent site to the north and continuing to a future park to the south. The commercial event venue is situated in the southern central portion of the site, providing a transition from the outdoor common area to the future park site. Additional landscaping has been placed along the perimeter of the site and throughout the parking areas. SETBACKS/HEIGHT PROPOSED: Street Setbacks 16 feet (Santa Victoria Road) 15 feet (Santa Carolina Road) Setbacks from Other Property Lines Between 11 feet and 18 feet Residential Height (maximum): 36 feet (building), 38 feet (features) Commercial Height (maximum): 22 feet (building), 34 feet (features) Design Review In accordance with CVMC section 19.14.582(A) and the Otay Ranch Village Two SPA Plan, Design Review is required for the Project. The following describes the Project’s consistency with the Otay Ranch Village Two SPA Design Plan and Master Precise Plan. Building Massing and Scale Variations in roof heights and form will provide visual interest and varying shadows. Wall planes are staggered to draw attention to entries and architectural features, which also create a horizontal building setback. Enhanced elevations are provided adjacent to street intersections and building entrances. To incorporate a smaller building mass at a pedestrian scale, street-facing facades are two stories, while three-story dwellings are located toward the center of the site. The commercial building has a large tower feature, which is a required landmark architectural element, and a vaulted ceiling within the event venue complements floor-to-ceiling windows and doors that open to the adjacent outdoor areas. Materials/Colors The proposed Project’s architecture is consistent with the standards outlined in the Otay Ranch Village Two SPA Design Plan and Master Precise Plan. The architecture of the proposed homes and commercial building follows a Santa Barbara-style design theme: light-colored cement plaster stucco with dark accent colors, tiled gable roofs, chimneys, clay tile pipes, decorative shutters and trim, and covered patios. Circulation, Site Access and Parking The Project Site can be accessed by pedestrians from Santa Victoria Road, Santa Carolina Road, and the future park site. Vehicular access follows the general shape of the Project Site, connecting Santa Victoria Road and Santa Carolina Road. Surface parking is provided in open parking spaces in the center of the site and on either side of the driveway. Each dwelling will include a two-car garage. Landscaping All areas of the Project Site not covered by structures, drives, parking, or hardscape will be appropriately landscaped. The proposed Project has been designed such that 16 percent of the gross site area is proposed to be landscaped; the Otay Ranch Village Two SPA and the City of Chula Vista Landscape Manual only require 15 percent to be landscaped. Proposed landscaping consists of a variety of trees, shrubs, and groundcover throughout the site. Trees line the street frontages and are also provided adjacent to and within the outdoor area and Page 7 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda Planning Commission Date: September 27, 2023 Page No. 4 parking areas, as well as along the front and rear of the proposed buildings. Trees are also provided in the front of the commercial building within the parking lot area. Exterior Lighting In compliance with applicable provisions of the SPA plan, exterior lighting is provided around the buildings and throughout the site to illuminate parking and pedestrian areas. All lighting will be directed downward and will be consistent with the City’s lighting policies. Waste Management The proposed location and size of the trash enclosures are consistent with the Recycling and Solid Waste Planning Manual. CONCLUSION The proposed Project complies with the policies, guidelines, and design standards outlined in the Otay Ranch Village Two SPA and CVMC Title 19. Staff recommends that the Planning Commission approve the proposed Project, subject to the conditions provided in the attached resolution. DECISIONMAKER CONFLICT Staff has reviewed the property holdings of the Planning Commission members and found no conflicting property holdings within 1,000 feet of the subject property’s boundaries. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18705.2(a)(11) for purposes of the Political Reform Act (Cal. Gov’t Code § 87100, et seq.). Staff is not independently aware nor has been informed by any Planning Commission member of any other fact that may constitute a basis for a decisionmaker conflict of interest in this matter. FISCAL IMPACT There are no current year or ongoing fiscal impacts to the General Fund or Development Services Fund resulting from this action. All processing costs are borne by the Applicant. and WHEREAS the Applicant requests approval of a mixed-use development on Parcel MU-1 of the Otay Ranch Village Two SPA, including townhomes for rent with associated amenities and parking, a commercial event venue, and landscaping (“Project”); and WHEREAS the area of land that is the subject of this Resolution is an existing, vacant, 1.8- acre parcel located just off the northeast corner of Santa Carolina Road and Santa Victoria Road (“Project Site”); and WHEREAS the Director of Development Services has reviewed the Project for compliance with the California Environmental Quality Act (“CEQA”) and determined that the Project was adequately covered in the previously adopted FEIR for the Otay Ranch Village Two SPA Plan (EIR 02-02; SCH#2003091012; and incorporated by reference in the certification of Final SEIR 12-01 by Resolution No. 2014-207 on November 4, 2014); and WHEREAS the Director of Development Services set the time and place for a hearing before the Planning Commission for DR22-0023, and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City and its mailing to property owners and residents within 500 feet of the exterior boundaries of the P roject Site at least 10 days prior to the hearing; and WHEREAS the Chula Vista Planning Commission has reviewed and considered all materials for DR22-0023; and WHEREAS the hearing was held at the time and place as advertised in the Council Chambers, 276 Fourth Avenue, before the Planning Commission, and the hearing was thereafter closed; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Chula Vista that it hereby makes the following findings: Page 36 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda PC Resolution No. 2023-13 September 27, 2023 Page 2 1. The proposed development, as proposed and/or conditioned, is consistent with the development regulations of the Chula Vista Municipal Code (“CVMC”), the Chula Vista General Plan, the Otay Ranch Village Two SPA Plan, the Otay Ranch Village Two SPA Design Plan and Master Precise Plan, and all other applicable development standards. The proposed Project complies with the City of Chula Vista’s General Plan and Title 19 of the CVMC, as well as the Otay Ranch Village Two SPA Plan and the Otay Ranch Village Two SPA Design Plan and Master Precise Plan. Said compliance includes consistency with the uses permitted on the Project Site, provision of the minimum required number of parking spaces, and provision of the required minimum amount of landscaping for the proposed Project. For development in the MU zone, development standards, including building height, setbacks, and open space, are determined through the Design Review process. The proposed Project provides building heights, setbacks, and open space consistent with other development in the area. The proposed Project also includes a walking path through the Project Site connecting the adjacent site to the north and the future park to the south, a requirement of the Otay Ranch Village Two SPA Master Precise Plan. BE IT FURTHER RESOLVED that the Planning Commission, based on the findings above, does hereby approve Design Review Permit DR22-0023, subject to the following conditions: I. Unless otherwise specified, the following shall be accomplished to the satisfaction of the Director of Development Services or their designee prior to issuance of building permits: Planning 1. The colors and materials specified on the building plans shall be consistent with the colors and materials shown on the site plan and colored building elevations approved by the Planning Commission. 2. A graffiti-resistant treatment shall be specified for all exterior wall and building surfaces. Additionally, the Project shall conform to CVMC Chapter 9.20 regarding graffiti control. 3. All roof appurtenances, including air conditioners and other roof-mounted equipment and/or projections, shall be shielded from view and the sound buffered from adjacent properties and streets as required by the Director of Development Services. Such screening shall be architecturally integrated with the building design. 4. All exterior lighting shall include shielding to reduce any glare onto adjacent residences and properties. Details for said lighting shall be included in the architectural plans. 6. The Applicant shall obtain a sign permit from the Development Services Department for each proposed sign. Signs shall comply with all applicable requirements of the CVMC and the Otay Ranch Village Two SPA Design Plan. Land Development/Traffic 7. The Applicant shall comply with all requirements and guidelines of the CVMC; the Chula Vista Subdivision Manual; City of Chula Vista Design and Construction Standards; the Development Storm Water Manual for Development and Redevelopment Projects; the City of Chula Vista Grading Ordinance (No. 1797); and the California Subdivision Map Act. 8. The Project shall comply with the Tentative Map conditions in Resolution Nos. 2006- 156 (amended by 2012-009 and 2012-056) and 2006-157 (CVT 06-05). 9. Prior to the final building inspection, the public infrastructure serving the Project Site shall be constructed and fully operational to the satisfaction of the Director of Development Services. 10. Prior to issuance of a building permit, a lot line adjustment shall be approved. 11. All driveways shall conform to the City of Chula Vista’s sight distance requirements in accordance with CVMC section 12.12.120 and Chula Vista standard drawing RWY- 05 (Sight Distance Requirements). Neither landscaping, street furniture, nor signs shall obstruct the visibility of drivers at the street intersections or driveways. 12. Prior to obtaining any building permits for the Project, the Applicant shall submit a Construction Permit for review and approval to perform the following work in the City’s right-of-way: a. The proposed driveway in Santa Victoria Road needs to be straight (not curved). The existing bulb-out will need to be extended to meet sight visibility requirements. Plans shall show the sight visibility clearance area per City Standard Drawing RWY-05. b. Provide signage and striping plans in Improvement Plans. c. Proposed driveways shall follow City Standard GSI-01. d. Improvement Plans shall show proposed signage and striping changes for the existing all-way stop intersection of Santa Carolina Road and Mason Road. A pedestrian barricade shall be installed on the west side of Santa Carolina Road. f. These improvements shall be shown in the signage and striping plans as part of the Improvement Plans submittal. g. The pedestrian ramp on the northwest corner of Santa Carolina Road and Mason Road shall be removed and replaced with sidewalk, curb, and gutter per City standards or San Diego Regional Standard Drawings (“SDRSD”). h. Removal and replacement of any broken or damaged curb, gutter, and sidewalk per SDRSD G-03 along the Project’s frontage to the satisfaction of the City Engineer. Sidewalk shall be designed and constructed with proper transitions to existing conditions. i. The proposed driveway on Santa Carolina Road shall be designed and located to provide the required sight visibility and to follow Manual on Uniform Traffic Control Devices (“MUTCD”) guidelines. 13. Streets or driveways within the Project shall be designated as private. 14. Separate permits for other public utilities (gas, electric, water, cable, telephone) shall be required as necessary. 15. Any improvements in the right-of-way beyond the Project limits shall be designed and constructed as to not interfere with adjacent businesses, as approved by the City Engineer. 16. Prior to beginning any earthwork activities at the site and before issuance of a building permit, the Applicant shall submit grading plans to the Land Development Division for processing, reviewing, and permitting in accordance with CVMC Chapter 15.04. Plans shall be in conformance with the City’s Subdivision Manual and the City’s most current Best Management Practices (“BMP”) Design Manual. 17. The Priority Development Project Storm Water Quality Management Plan (“PDP SWQMP”) approved with this Design Review is considered conceptually complete and provides adequate information on the Project BMP’s objectives to move forward with construction drawings. There may be additional requirements set at the time the development takes place and/or a Land Development Permit is applied for, depending upon final plans submitted for review and approval. 18. Design Review Drainage Report is considered conceptually complete and provides adequate information on the Project’s Drainage objectives to move forward into Construction Drawing documents. There may be additional requirements set at the time the development takes place and/or a Land Development Permit is applied for, depending upon final plans submitted for review and approval. Applicant shall enter into a Storm Water Management Facilities Maintenance Agreement to perpetually maintain and fund all Post Construction Permanent BMP facilities within the Project to the satisfaction of the City Engineer, prior to the issuance of the Grading, Construction, or building permit, whichever occurs first. 20. Applicant shall submit a detailed Operation and Maintenance (“O&M”) plan for all permanent BMPs as required by the City to preserve the intended pollution control and/or flow control performance of the BMP. Upon completion of construction of BMPs/Project, update/finalize O&M Plan to reflect constructed structural BMPs with as-built plans and baseline photos. 21. Prior to grading permit issuance, Applicant shall provide a complete and accurate Notice- of-Intent (“NOI”) filed with the State Water Resource Control Board (“SWRCB”) for the Project as covered under the Construction General Permit. A copy of the acknowledgement from the SWRCB that a NOI has been received for this Project shall be filed with the City of Chula Vista when received. Further, a copy of the completed NOI from the SWRCB showing the Permit Number for this Project shall be filed with the City of Chula Vista when received. 22. The following applies to all site retaining walls: a. When Grading Plans are submitted for a Grading Permit, all retaining walls shall be noted on the Grading Plans and include a detailed wall profile. b. Structural wall calculations are required if walls are not built per SDRSD, or City of Chula Vista Construction Standards GRD-05. c. Retaining walls that will be part of a building wall must be approved as part of the Building Permit for the Project. d. Retaining walls around trash bins (if any) shall be noted on the Grading Plans and called out per standard. e. Retaining wall drains shall tie into the drainage system. 23. Prior to issuance of any Building Permit within the Project, the Applicant shall provide the City with proof of Pad Certification. 24. A “Will Serve” letter from Otay Water District shall be provided prior to issuance of the first Building Permit or prior to the first improvement plans approval. 25. The onsite sewer and storm drain system shall be private. All sewer laterals and storm drains shall be privately maintained from each building unit to the City-maintained public facilities. 26. All proposed sidewalks, walkways, pedestrian ramps, and accessible parking for people with disabilities shall be designed to meet the City of Chula Vista Design Standards, ADA Standards, and Title 24 standards, as applicable. Proposed private water and fire lines structures are to be submitted on a separate Building Plan and permitted by the Building and Fire Departments. 28. The proposed trash enclosure shall be a covered trash enclosure and meet the requirements of the City of Chula Vista most current BMP Design Manual Fact Sheet SC-Q. 30. Applicant shall obtain an Encroachment Permit for any private facilities within public right-of-way and/or City easements prior to construction permit or building permit issuance. 31. Applicant shall obtain a Letter of Permission to grade and/or construct improvements offsite prior to grading permit issuance. 32. Prior to Grading Plan approval, the Applicant shall upload digital files in a format such as AutoCAD DWG or DXF (AutoCAD version 2000 or above), ESRI GIS shapefi le, file, or personal geodatabase (ArcGIS version 9.0 or above). The files should be transmitted directly to the GIS section using the city's digital submittal file upload website at: http://www.chulavistaca.gov/goto/GIS. The data upload site only accepts zip formatted files. Fire 33. The Applicant shall apply for required Building and Fire Safety Engineering permits. Permits shall comply with applicable codes and requirements, including but not limited to the current edition of the California Building Code (“CBC”), and the California Fire Code (“CFC”), and the National Fire Protection Association (“NFPA”) standards, as adopted and amended by the City of Chula Vista. 34. Plans, including a hydraulic analysis, for the design and construction of private underground fire service utilities are required to be included within a permit submittal to the Development Services Department (DSD) in the form of a Private Utility Improvement Permit Plan or as part of the Architectural Building Permit Plan. Plans and the hydraulic analysis for underground fire service utilities shall be in compliance with all applicable sections of the Underground Fire Service Utility Requirements of the Chula Vista Fire Department (“CVFD”) found under the “Requirements” heading at the following web page: CVFD Fire Prevention Requirements, Forms, and Details. 35. The Project is required to have two points of connection for the Underground Fire Service. 36. For 8,364 square feet of Type VB construction, the Project will require a fire flow of 2,250 gallons per minute (gpm) for a two-hour duration at 20 pounds per square inch (p.s.i.). Per CVMC section 15.36.075, CVFD allows a 25 percent reduction in fire flow when the building is protected by an approved fire sprinkler system. [2,500 gpm – 25 percent Page 41 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda PC Resolution No. 2023-13 September 27, 2023 Page 7 reduction in fire flow = 2,250 gpm]. Additionally, per CVMC section 15.36.075, the maximum fire flow for the Project is capped at 5,000 gpm for a four-hour duration at 20 p.s.i. 37. The required fire flow for Type VB construction type is 2,250 gpm for a two-hour duration at 20 p.s.i. 38. Per CFC 903.2.8, the Project is to be protected throughout by an approved automatic fire sprinkler system in accordance with the adopted CFC and/or NFPA standards, respectively. 39. A Fire Control Room shall be provided. The Fire Control Room shall be in accordance with CVFD’s Fire Control Room detail found under the “Fire Safety Engineering Details” heading at the following web page: CVFD Fire Prevention Requirements, Forms, and Details. The Fire Control Room shall be shown on the Architectural Building Permit Plan submittal. 40. Fire Department Connections and signs (see CVFD’s Multi-Family Dwelling FDC detail) must be provided. Show on elevations during the Building Permit submittal. 41. The Project will require a Fire Sprinkler Alarm Monitoring System. 42. Premise Identification shall be shown on the Architectural Building Permit Plan submittal. 43. The Commercial Knox Vault/Box Requirement detail shall be reproduced and have their locations shown on the Building Permit Plan submittal. 45. The Project shall have on-site fire access roadways marked as Fire Lanes in accordance with the Fire Lane Identification detail found under the “Fire Safety Engineering Details” heading at the following web page: CVFD Fire Prevention Requirements, Forms, and Details. Fire Lanes shall be shown on the Building Permit Plan submittal. 46. An Illuminated Directory (see CVFD’s Illuminated Sign Directory) must be provided. The “Agreement” shall be signed/dated by the responsible party and reproduced on Grading, Improvement, Design Review and Architectural Building Permit Plans. See below for excerpt requirements for this requirement: Water Supply means a fully operational and tested fire service utility system serving the permanent hydrant system. • Access means a fully improved street section (private or public); a first layer of asphalt is also acceptable to allow for access to within 150 feet of all combustibles. • When approved by the Fire Marshal, temporary access roadways and temporary water services may be substituted for permanent road and water supplies. 48. The number of hydrants is based upon the original fire flow and in accordance with CFC Table, C102.1. Landscape Architecture 49. Prior to the second submittal of the building permit set, the Applicant shall submit a complete set of Landscape Improvement plans for review and approval by the Director of Development Services or designee. 50. Prior to the final building inspection, the Owner shall have installed Landscape Improvements and have had said improvements inspected by City staff, per the approved Landscape Improvement plans, to the satisfaction of the Director of Development Services or designee. II. The following ongoing conditions shall apply to the Project Site as long as it relies upon this approval: 51. The Applicant shall maintain the Project in accordance with the approved plans for DR22- 0023, which include a site plan, floor plans, and elevations on file in the Development Services Department. The Project shall also maintain compliance with the conditions contained herein and Title 19 of the CVMC. 52. Approval of this Project shall not waive compliance with any provisions of the CVMC nor any other applicable laws and regulations in effect at the time of building permit issuance. 53. The Applicant and Property Owner shall and do hereby agree to timely and fully indemnify, protect, defend, and hold harmless the City, its City Council members, Planning Commission Page 43 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda PC Resolution No. 2023-13 September 27, 2023 Page 9 members, officers, employees, and representatives from and against any and all liabilities, losses, damages, demands, claims, and costs, including any costs and expenses to prepare the administrative record for any challenge to the Project approvals and/or compile a response to a Public Records Act request(s) to provide the record of proceedings materials for the Project, the City’s costs to retain its own defense counsel to defend any challenge to any Project-related approvals, court costs and attorney fees (collectively, “liabilities”) incurred by the City arising, directly or indirectly, from (a) the City’s approval and issuance of this permit and (b) the City’s approval or issuance of any other permit or action, whether discretionary or non-discretionary, in connection with the use contemplated herein, and the Applicant shall acknowledge their agreement to this provision by executing a copy of this permit where indicated below. The Applicant and Property Owner’s compliance with this provision is an express condition of this permit and shall be binding on any and all of the Applicant/operator’s successors and assigns. 54. The Applicant shall comply with all requirements and guidelines of the City of Chula Vista General Plan, the Chula Vista Landscape Manual, the Chula Vista Design Manual, and the Non-Renewable Energy Conservation Plan as amended from time to time, unless specifically modified by the appropriate department head with the approval of the City Manager. These plans may be subject to minor modifications by the appropriate department head with the approval of the City Manager; however, any material modifications shall be subject to approval by the Planning Commission. 55. This permit shall expire if not utilized within three years of the approval date (September 27, 2026) or the end of any appeal period unless the Applicant initiates an extension prior to expiration of the permit in accordance with CVMC section 19.14.600. 56. Any violations of the terms and conditions of this permit may result in the imposition of civil or criminal penalties and/or the revocation or modification of this permit. III. GOVERNMENT CODE SECTION 66020(d)(1) NOTICE Pursuant to Government Code section 66020(d)(1), notice is hereby given that the 90-day period to protest the imposition of any impact fee, dedication, reservation, or other exaction described in this Resolution begins on the effective date of this Resolution; that any such protest must be in a manner that complies with Government Code section 66020(a); and that failure to follow this procedure in a timely manner will bar any subsequent legal action to attack, review, set aside, void, or annul imposition. Failure to satisfy the conditions of this permit may also result in the imposition of civil or criminal penalties. VI. INVALIDITY; AUTOMATIC REVOCATION It is the intention of the Planning Commission that its adoption of this Resolution is dependent upon the enforceability of each and every term, provision, and condition herein stated, and that in the event that any one or more terms, provisions, or conditions are determined by a Court of competent jurisdiction to be invalid, illegal, or unenforceable, this Resolution and the permit shall be automatically revoked and of no further force and effect. Location: 740 Hilltop Drive (APN: 574-281-41) Environmental Notice: The Project qualifies for a Class 3 Categorical Exemption pursuant to section 15303 (New Construction or Conversion of Small Structures) of the California Environmental Quality Act (“CEQA”) State Guidelines. Recommended Action: Conduct a public hearing and adopt a resolution approving Conditional Use Permit (CUP22-0044), based upon the required findings and subject to the conditions contained therein. SUMMARY AT&T Wireless (the “Applicant”) requests approval to install a wireless telecommunications facility (“WTF”) consisting of 12 panel antennas mounted on a 55-foot mono-broadleaf tree, in addition to an eight-foot concrete masonry unit (“CMU”) equipment enclosure (the “Project”), on a developed parcel located at 740 Hilltop Drive (the “Project Site”). The Project Site is on the west side of Hilltop Drive, between J Street and Telegraph Canyon Road (Attachment 1) and is owned by Hilltop Baptist Church of Chula Vista California, Inc. (the “Property Owner”). The Project Site is zoned Single-Family Residential (“R-1”) and designated Residential Low-Medium (“RLM”) in the General Plan. HOUSING IMPACT STATEMENT The Project Site is zoned R-1and is designated RLM in the General Plan, allowing residential uses. No housing is proposed as part of this Project; therefore, no additional housing units are proposed as a part of this project. ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the proposed Project for compliance with CEQA and determined that the Project qualifies for a Class 3 Categorical Exemption pursuant to section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines. No further environmental review is required. Page 49 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda P a g e | 2 DISCUSSION On December 29, 2022, the Applicant submitted a Conditional Use Permit (“CUP”) application for the proposed Project. In accordance with the Chula Vista Municipal Code (“CVMC”) Chapter 19.89 (Wireless Telecommunications Facilities), WTFs are allowed in any zone, subject to approval of a CUP. Facilities that exceed the height limit of the underlying zone require a stealth design and Planning Commission approval. The Project Site is zoned R-1, which has a maximum height limit of 28 feet. The proposed Project would exceed the maximum building height in the R-1 zone by 27 feet. Project Site Characteristics The Project Site is developed with a church and paved parking. The facility also includes an eight-foot CMU enclosure for the ground equipment associated with the tower, which includes a metal security gate (Attachment 2). ANALYSIS The facility is at the minimum technologically feasible height possible in order to ensure adequate coverage to the target area. Propagation maps are included and referenced in the Project application to demonstrate the improvement in coverage tied to the additional height (Attachment 3). The proposed facility will be built to comply with the WTF ordinance’s development criteria and all other applicable City zoning and building regulations. Access to the site will be kept to a minimum and conducted in a manner that does not negatively impact the adjacent neighbors or existing church. Noise A noise analysis verified that noise impacts from the project site are expected to be adequately controlled. Page 50 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda P a g e | 3 Height, Stealth Technology, and Design The proposed facility will be placed in the southwestern portion of the property near established trees to blend in with the existing landscape and minimize visual impacts to adjoining properties. The antennas will be painted to match the mono-tree, and faux branches will obscure the antennas, effectively minimizing visibility of the facility, making the antennas as unobtrusive as possible with the most efficient technology. The Applicant acknowledges the development criteria established in CVMC Section 19.89.060 and will maintain a stealth design, including continued maintenance of the faux branches (Attachment 4). The proposed facility is designed to cover a large footprint in an area where user density can fluctuate as customers travel to and from the nearby schools and surrounding residential areas. The proposed antennas are selected to handle the potential user traffic and are as small as are available to meet the Applicant’s needs while being installed as closely together as feasible to avoid shadowing or interference. The equipment on-site will be compact and maintain minimum safety clearances between pieces of equipment. Collocation The Applicant searched diligently for collocation opportunities on existing towers within the area. The focus area targeted a location between two single-family homes near the intersection of Corte Maria Avenue and J Street. Several property owners were approached to enter a lease resulting in the current proposed location. Additionally, there is another wireless facility site located on the property, which furthers the goal of concentrating wireless facilities on a common site per CVMC Section 19.89.060(A)(3). The Project as proposed, is taller than a rooftop installation and will be able to accommodate additional antennas, should another wireless carrier wish to install at this location. Parking Displacement; Setbacks The location of the facilities will be in the southwesterly most part of the parcel, in an unimproved portion of the property; therefore, it will not displace any parking. The proposed facilities will be located not less than 33 feet from the rear yard setback, and not less than 67 feet from the side yard setback, meeting the requirements for the R-1 zone. CONCLUSION Staff has reviewed the Project and determined that it is consistent with the CVMC and the Chula Vista Design Manual. Staff recommends that the Planning Commission adopt the proposed resolution approving the Project, subject to the conditions contained therein (Attachment 5). DECISION-MAKER CONFLICT Staff has reviewed the property holdings of the Planning Commission members and found no property holdings within 1,000 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(7) or (8), for purposes of the Political Reform Act (Cal. Gov’t Code §87100, et seq.). Staff is not independently aware and has not been informed by any Planning Commission member of any other fact that may constitute a basis for a decision-maker conflict of interest in this matter. Unit 500 | Portland, OR 97239 PROPOSED 55’-0” HIGH MONO- EUCALYPTUS TOWER PROPOSED AT&T PANEL ANTENNA (TYP OF 6, 2 PER SECTOR) Page 75 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda Attachment 5 RESOLUTION NO. 2023-14 RESOLUTION OF THE CITY OF CHULA VISTA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT CUP22-0044 FOR A NEW WIRELESS TELECOMMUNICATIONS FACILITY LOCATED AT 740 HILLTOP DRIVE ON 2.76 ACRES WITHIN THE R-1 ZONE WHEREAS, on December 29, 2022, a duly verified application for a Conditional Use Permit (“CUP”) was filed with the City of Chula Vista Development Services Department by AT&T Wireless (“Applicant”); Hilltop Baptist Church of Chula Vista California, Inc. is the property owner (“Property Owner”); and WHEREAS the area leased by the Applicant, which is the subject of this Resolution, is a portion of an existing 2.76-acre parcel, located at 740 Hilltop Drive, on the west side of Hilltop Drive, between J Street and Telegraph Canyon Road (“Project Site”); and WHEREAS the Applicant requests approval of a CUP to install a new wireless telecommunications facility (“WTF”), consisting of a 55-foot mono-broadleaf tree along with enclosed associated equipment (“Project”) within the R-1 zone; and WHEREAS, in accordance with Chula Vista Municipal Code (“CVMC”) section 19.89.060, WTFs are subject to the height limitation stipulated in the underlying zone; and WHEREAS the R-1 zone has a maximum building height of 28 feet; and WHEREAS, in accordance with CVMC section 19.89.050, any WTF that exceeds the maximum building height allowed in a particular zone shall require a CUP approved following a public hearing before the Chula Vista Planning Commission; and WHEREAS the Director of Development Services has reviewed the proposed Project for compliance with the California Environmental Quality Act (“CEQA”) and determined that the Project qualifies for a Class 3 Categorical Exemption pursuant to Section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines; and WHEREAS the Director of Development Services set the time and place for a hearing before the Planning Commission for consideration of CUP22-0044, and notice of the hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City and its mailing to property owners and residents within 500 feet of the exterior boundaries of the property at least 10 days prior to the hearing; and WHERAS the Chula Vista Planning Commission has reviewed and considered all materials for CUP22-0044 and the Project, as well as having considered such oral testimony and documentary evidence submitted related to CUP22-0044 and this Project; and WHEREAS the hearing was held at the time and place as advertised in the Council Chambers, 276 Fourth Avenue, before the Planning Commission, and the hearing was thereafter closed; Page 76 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda PC Resolution No. 2023-14 September 27, 2023 Page 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Chula Vista pursuant to CVMC section 19.14.080, does hereby makes the following findings: 1. That the proposed use at the particular location is necessary or desirable to provide a service or facility which will contribute to the general well-being of the neighborhood or the community. The proposed use will provide expanded wireless communication services to the Chula Vista community, including for individual residents and for maintenance and operation of public facilities. The proposed use will include facilities (i.e., a tower with antennas attached) that will exceed 28 feet in height; however, the proposed height is the only technologically feasible option for providing service to the area. The proposed use will improve and ensure the availability of wireless communication as a public convenience by providing essential communication and improved service in the surrounding area of its location. In the event of an emergency or natural disaster, the use will continue to function, which supports the general health, safety, and welfare of the citizens of Chula Vista. 2. That such use will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. To minimize the visual impacts of the use, the proposed facility and all associated equipment will be located in the southwestern portion of the Project Site and utilize a stealth design to be visually unobtrusive. The antennas will be painted to match the mono- tree, and faux branches will obscure the antennas. Existing mature trees which are of the same relative height as the proposed facility will aid in further blending the Project into the surrounding area. 3. That the proposed use will comply with the regulations and conditions specified in Title 19 of the CVMC for such use. As proposed, the use is compliant with the City’s applicable development criteria, particularly those outlined in CVMC Chapter 19.89, and all other City zoning regulations. 4. That the granting of this conditional use will not adversely affect the General Plan of the City or the adopted plan of any governmental agency. The integration of wireless facilities with existing uses is encouraged by the Public Facilities and Services Element of the General Plan, including Policy PFS 24.1, regarding the installation of state-of-the-art wireless facilities, and Policy PFS 24.2, regarding the review of new telecommunications facilities and utilizing siting and design techniques that minimize community impacts. BE IT FURTHER RESOLVED that the Planning Commission, based on the findings above, does hereby approve Conditional Use Permit CUP22-0044, subject to the following conditions. The following ongoing conditions shall apply to the Project Site for as long as it relies upon this approval: Page 77 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda PC Resolution No. 2023-14 September 27, 2023 Page 3 Planning 1. The Applicant shall maintain the Project in accordance with the approved plans for CUP22-0044, which include a site plan, equipment plan, and photo simulations on file in the Development Services Department. The Project shall also maintain compliance with the conditions contained herein and Title 19 of the CVMC. 2. This permit shall be reviewed 10 years from the date of approval (September 27, 2033) at which time the Zoning Administrator shall review this use for compliance with the conditions of approval and any applicable codes and regulations and shall determine, in consultation with the Applicant, whether the Project shall be modified from its original approval, or revoked, and whether another review shall be necessary for the Project and, if so, in what period of time. 3. The Applicant and Property Owner shall execute this permit acknowledging that the approved use is the only use that has been approved under this permit. Any new use or modification/expansion of uses shall be subject to review and approval by the Zoning Administrator. 4. The Applicant shall cooperate with telecommunications companies in collocating additional antennas on the subject property, provided said co-locators have received a CUP from the City for such use. The Applicant shall exercise good faith in collocating with other communications companies and sharing the permitted site, provided such shared use does not give rise to a substantial technical-level or quality-of-service impairment of the permitted use (as opposed to a competitive conflict or financial burden). In the event a dispute arises as to whether the Applicant has exercised good faith in accommodating other users, the City may require a third-party technical study at the expense of the Applicant. 5. Within 90 days of cessation of the business operations and use of the antennas, the Applicant shall submit a substitute user to the satisfaction of the Director of Development Services or their designee and/or remove the Project and all associated equipment from the Project Site. If the facility is removed, the Applicant shall restore the Project Site to its original condition. Any changes to this permit shall require a modification to be reviewed by the Zoning Administrator. 6. The Applicant and Property Owner shall and do hereby agree to timely indemnify, protect, defend, and hold harmless the City, its City Council members, officers, employees, and representatives from and against any and all liabilities, losses, damages, demands, claims, and costs, including court costs and attorney fees (collectively, “liabilities”) incurred by the City arising, directly or indirectly, from (a) the City’s approval and issuance of this permit and (b) the City’s approval or issuance of any other permit or action, whether discretionary or non-discretionary, in connection with the use contemplated herein, and the Applicant shall acknowledge their agreement to this provision by executing a copy of this permit where indicated below. The Applicant and Page 78 of 93 City of Chula Vista Planning Commission September 27, 2023 Agenda PC Resolution No. 2023-14 September 27, 2023 Page 4 Property Owner’s compliance with this provision is an express condition of this permit and shall be binding on any and all of the Applicant/operator’s successors and assigns. 7. The conditions of approval for this permit shall be applied to the Project Site until such time as the approval may be revoked, and the existence of this approval with conditions shall be recorded with the title of the property. 8. Any violations of the terms and conditions of this permit may result in the imposition of civil or criminal penalties and/or the revocation or modification of this permit. 9. This CUP shall become void and ineffective if not utilized within three (3) years from the effective date thereof (September 27, 2026), in accordance with CVMC section 19.14.260. Failure to comply with any conditions of approval shall cause this permit to be reviewed by the City for additional conditions or revocation. Landscape Architecture 10. The Applicant’s contractor shall ensure that any existing plant material noted within the area of construction or adjacent to the area of construction is protected in place and receives sufficient irrigation to flourish during construction. If any existing planting material experiences a decline in health as a result of construction activity, the contractor shall replace the existing material in kind to the satisfaction of the Director of Development Services. 11. The Applicant’s contractor shall ensure that any existing landscape irrigation within the area of construction or adjacent to the area of construction is protected in place. If any existing irrigation is damaged, the contractor shall replace the existing irrigation equipment in kind to the satisfaction of the Director of Development Services. I. GOVERNMENT CODE SECTION 66020(d)(1) NOTICE Pursuant to Government Code section 66020(d) (1), NOTICE IS HEREBY GIVEN that the 90-day period to protest the imposition of any impact fee, dedication, reservation, or other exaction described in this resolution begins on the effective date of this resolution, and any such protest must be in a manner that complies with Government Code section 66020(a), and failure to timely follow this procedure will bar any subsequent legal action to attack, review, set aside, void or annul imposition. The right to protest the fees, dedications, reservations, or other exactions does not apply to planning, zoning, grading, or other similar application processing fees or service fees in connection with this project, and it does not apply to any fees, dedication, reservations, or other exactions which have been given notice similar to this, nor does it revive challenges to any fees for which the statute of limitations has previously expired. II. Status: The building permit has been issued. • DR21-0009 - Approved Design Review for a 108,205 square-foot concrete tilt-up industrial building on a 7.51-acre site in the PA-3 Zone of the Otay River Business Park (ORBP) Specific Plan. Status: Easement vacation approved by City Council on June 6, 2023; grading permit issued; building permit is in review. • DR21-0037 - Approved a Design Review Permit for Escaya II Apartments, 218 multi-family units – Otay Ranch Village Three. Status: Grading permit issued; building permit is under review. September 28, 2022: • Approved Consideration of an application to rename Showroom Place to District Place within the District at Eastlake. Status: The road signs have been installed with “District Place”, CV Mapper has been updated and Google Maps accurately reflects this road as District Place. OCTOBER October 12, 2022: • Consideration of an application to approve a Tentative Map time extension located within Otay Ranch Village 4 – The extension was granted by the Planning Commission. October 26, 2022: • PCP22-0001 - Approved consideration of a Planned Sign Program for new wall signs for an automotive dealership in the Auto Park North Specific Plan Area. Status: Signs have been installed at Mossy Chrysler Dodge Jeep Ram on Main Street in the Auto Park North Specific Plan Area. NOVEMBER November 9 and November 23, 2022 meetings were cancelled DECEMBER December 14, 2022: • DR21-0029 - Approved Design Review and Conditional Use Permit for a medical office building expansion and associated detached parking structure at 1400 East Palomar Street within Village One of the Otay Ranch Sectional Planning Area . Status: Building permit has been issued and construction has begun on the new parking structure behind the existing SHARP medical office building. • DR21-0036 - Approved Design Review for a building in the PA-3 zone of the Otay River Business Park Specific Plan. Status: Municipal Code Updates approved by City Council on February 21, 2023; regulations are now in effect. • Approved a Second Amendment to the Otay Ranch Eastern Urban Center Development Agreement between the City of Chula Vista and McMillan Otay Ranch, LLC December 28, 2022 – Meeting cancelled JANUARY • January 11, 2023 – Meeting cancelled January 25, 2023: • PCS-14-01 - Approved Tentative Map and Coastal Development Permit to allow for the subdivision of 35-acres into eleven (11) lots for 1,500 multi-family residential units, approximately 416,800 square feet of office use and a 250 -room hotel. Status: Grading permit issued for public roadway improvements. • DR22-0003 - Approved Design Review and Tentative Map for the construction of 244 market rate, for sale residential townhomes, a commercial parcel, and a 0.5 acre parcel for a future public park in the Urban Core Specific Plan . Status: Demolition permit issued for the existing vacant Sears building; Grading permit in review; building permits in review; project site has been fenced off in preparation for demolition. Note: The property has been purchased by CalWest and they will be constructing the project. FEBRUARY February 8, 2023: • DR22-0007 - Approved Design Review for a 41,930-square foot office/warehouse building on a 2.5-acre site in the PA-2 zone of the Otay River Business Park Specific Plan.
