now holds legal title to said building, and that it has been offare~ to
the City of 0hula Vista for the sma of $20,000.00.
The City clerk advises me that there are sufficient unc.~=~tted mon~s in
the general and capital outlay ftmd~ to effect the purchase.
The law in this State auth~ises cities of any class to o~sanize, px~ote
and conduct progr~ma of comaunity recreation and to establish systems
of playgrounds and recreation and to acquire, i~prove, maintain and operate
recreation centers.
The law also provides that a City Council e~ 1 not incur any indebtedness
or liability in any ~---~ or for any pU_~pe~e exceeding in any year the
income and revenue p~ovide~ for such year without the assent of two-thirds
of the queaified electors of the city voting at an election to be held
for that purpose.
Tt is m~ opinion that the City of Chula Vista is ls~l~ e~pawere~t to
purchase the U.S.O. Building for nee aS a recreation cente~, prO~i~e~l the
purchase prise is paid in cash ~ from money on ~d not co~saitted or
earmax~e~ for other purposes - (Si~e~ DeC,itt A. Higgo, City Attorney
for the City of Chula Vista, California~,
Following the above, Councilman Chase state~l that, in vie~ of the
recomnendation given by Attorney Higgs, in a~dition to the ve~ious service
clubs, including Chamber of C~rco, Recx~ation Ca~.~asion, and ~y others
who ~ad express~l their ~esiro that the city purchase the U.S.0.Building and
equilment for recrsationea purposes because of the nee~ being urgent, and
in view of the extr~l~ iow fi~Are of $~0,000.00 for the purchase of se~e,
he move~i that City Manager Ray be instructed to negotiate with the Federal
~rMs Agency, an~ ~a the offer of $20,000.00 for the purchase of the
l~eseat U.S.O. Building and equil~ent in Chula Vista.
Counc~l~ B~--eide then rsitorut~l his first contontien that the purchase
of the U.~.0.Building an~ equ~I-~ut be put to the vote of the people, to
which Counci~ Biesla~l stated that, if the Council waited any longo~,
the building and aL1 its equipw'nt woul~ he ~ispoeed of.
