The Council mst in the Council Chambers of the City Hall, on tbs
above date at 7 o'clock P.M., with D~yor E~ithley prs$id~ng. Present:
Councilm~n Ksithlay, Howe, Rieslaud, Burmside, Kidder. Absent: None.
~ ACR0~S SCHOOL PROPEP~Y: There having been a request
from Nr. J.'H. Tompkims, that the City Council ask the Chula Vista Union
Grammnar School Board for sm easement of five (5~ feet across their
property f~r the purpose of in~talling a sewer line to connect with the
southerly exta~ion of Clover Avemu~. After discussion the council
authorized Mayor Keithley to contact t~e school board smd try and arremge
for then to deed to t~ City for street purposes a thirty (30) foot strip
which would allow the openimg of Davidson Street from Gerrett Avenue to
Fourth Avenue. If this were granted it would then not be necessary for
en easememt. The m~tion, grantimg the Mayor authority to negotiate, was
made by Council~n B~rnside, seconded by Councilman Rieslend, and carried.
S~z'~.' EEPAIB~: Street S~perintendent Lymu Love, reported to the
Co,mucil that the Daley Corporation had ~m~l~l their bill for seal coating
two (2) blocks on Fourth Avenue. T~® cost wa~ Sen (10¢) cents per square
yard, ~d ~aounted to approXimately $283.00 per block for twenty (~0) foot
pa~ememt amd $~80.00 per block for forty (40) foot pavement. In light of
this cost, on motion by 0ounci~ Riealamd, seconded by Councd]m~n
Keithley, ~aich carried, street superintendent Love was authorized to pro-
ceed with the se~l coating of Fourth Avenue from "G" Street to ,Y, Street,
having same done by the Daley Corporation under the same terms as the
two (2) blocks previously done.
$?IE OF POR~ION OF PARK LAND: There having been ~ bid tendered the
council to buy a portion of park laud located adjacent to ~ south of
Fourth ~lvemue, between "C" smd "D" Streets, by ~r. amd L~s. wolfe, fc~ a
consideration of $500.00, upon motion by Councilman Kidder, seconded by
Councllmam Rieslamd, which carried, the offer was rejected and the matter
tabled.
CLAI~ FOR DAMAGES: City Attorney Little reported that in the
matter of claim of Y~.Bunn for injuries received when he fell in a hole
in the side-walk on lower "I~' Street. ~he City could accept no responsi-
bility because there warn no knowledge of the hole's existence. The property
owner, ~s.~hegas, admitted to the City Attorney that she allowed the water
to ~ in the ditch Causing this hazard. On motion by Councilmau How$,
secomdsd by Councilman B~rmside, which carried, the clerk was instructed to
notify ~r.l~,~= to this effect a~d suggest that he place his claim with
Shegas, the property owner.
POLIC~. REPORT: The clerk pre~ented a detailed report from ~e Police
Department for the month of April, and on motion by Councilmam HOwe, seconded
by Councilman Kidder, which carried, the report was accepted aud ordered filed°
~EQ~EST FO~ TR~?7.~R 0RDINAN~: Mr.Pumton again s~peared bei~Ore the
Council, request~r~ a Trailer Control Ordinance to be drafted. He explained
that authorized Trailer Camps were forced to obey existing law~, while
individual trailer~ of from one to three were not controlled. On motion by
Councilman H~e, seconded by Councilman Rissland, which carried, the matter
was referred to B~ilAing InspeCtor Done for report at the next meeting.
PLANNING COMMISSION APPOINT~d~T: Mayor Keithley sppointed Mr.
N.H. Jolmson 'as a member of the Planning Commission, ~nd on motion by
Councilmam Kidder, seconded by Councilw~ Rieslsnd, which carried, the
appointment wa~ confirzmd.
0RSINANGE N0.327: PINBALL ,MACHINES;. ordinance Nc. S2? having
bee~ place~ o~ its first reading at a Special Meeting of the City Council
held April 25, 1964, the matter of passage of the Ordinance by placemant
on its second reading, wa~ brought up. Council~ Riesl~md r~m~ded
the Council that, at their meeting held April 18, his motion wa~ duly
seconded e~d c~rried that the City Attorney be instructed to draft an
0rdinanee similar to that of the County of San Diego, whereby Pinball
~iachineS could be lagally bAa-ed in the City of Chula Vista.
He thereupom asked the c~rk to read Section 6 of the County
0rdinmmce, smd also Sectio~ 6 of the 0rdinsnee for the Cit~y of Chula Vista,
which the City Attorney had prepared and ~ich had been placed on its first
reading April 25. Councilman Rieslend called attention to the fact that
the Ordinance aS drafted by City Attorney legalized Pinball Machines in the
City of Chula Vista, rather than b~Bning th~. He thereupom presented a
mew ordimanee whiCh wa~ drafted to fulfil all of the conditions of the
County Ordima~ce.
0a motion by Councilman Riealemd, seconded by Councilm~ Kidder,
~ich carried, the ordinamce warn placed on its first reading.
ORDINANCE N0.Z28.:. PA~EING ME~ER~..:. Ordinance No.~E8 having been
placed om its first readimg at a Spect-1 meeting of the Council, April ES,
19~, on motion by Councllmam Howe, it wa~ moved for second reading and
passage. The heading was read, ~nd on motion by Councilmen Burnside, ~
seconded by Councilman Howe, which carried, the reading of the text was
waived. The O~-dinance failed f~ ps, sage by the following vote, to-wit:
Ayes: Councl~a~ Howe and Burnside. Noes: Councilm~n Kidder, Rlesland and
Keithley. Absent: None.
Councilm~n Riesla~d then explaimed that he favored the 0~dinause,
with the exception of the Emergency claus®. Whereupon, after the delatioa
of the Emergency clause, on motion by Councilman Howe, seconded by Councilman
Burnside, which carried, with Councilman Kidder voting No, the 0rdina~ce
was placed on its first reading in its revised form.
After the reading of the revised section of the adoption claU~e, on
motion by Councilman Burnside, seconded by Councilman Howe, ~hich carried,
further reading of the taxt was waived.
RESI~TION OF CITY ~TORhEY: City ~Attorney Little tendered his
resignation as City Attorney to be effective at the close of this neeting.
On motion by Councilman Rieslend, seconded by Council~m~u Kidder, which
c~rried, ~ith Councilm~ H~e and. Councilm~ Burnside voting No, the
resignation was accepted.

seconded by Councilman Keithley, vhich carried, with Cou~ucilEe~ Howe voting
No, with Councilman Burnside not voting, ~oKeith ~therton was appointed ~-~
to the position of City ~kttorney, the appointment to becon~ effective
~t the close of this meeting.
