The ~ouncil iaet in regular session in the Councl~lCh~mber of the City Hall on the above shown date with Mayor Howe presiding. The meeting was called to order at ? o'clock P.M. Present: Clmen. HOwe, Timmons, Perkins end B~rnside. Absent: Cl. Dupree. The ~Inutes of the regular meeting held November 10th haVing been prepared and mailed to each member of this council by the ci~ sle:k were approved as prepared end m~,~iled. The minutes of the regular meeting of the. planning Go~lssion held December let were read by the clerk and were approved as read. Referring to the matter of combination sidewalk on §th Avenue as mentioned in the minutes of the Planning C~mlssion Cl. Perkins reported that in his estimation the difficulty could be corrected by elevating the grade of the sidewalk approximately 18 inches, thus obviating necessity of a combination side- walk and curb. The matter of infected trees in the Plaza and Library as mentioned in the Pl-~ing Oo...tssion minutes was discussed, and the Council authorized Street ichor Perkins to remove these palms and replace same with 1§ ft. 0coos Pl~aosas perm-. R~, .~EST FOR DAMAGES: The clerk read a letter from k~rs. Genevieve 01roStand in which she suggested that the City ~ke some definite offer in settlmment for injuries received on Nov. 1~, 19~1. On advice from the City Attorney the clerk was instructed to v~ite a letter to t/vs. 01mstead advising her to the effect that the matter had been placed in the hands of our insurance company for investigation and action. The clerk was further instructed to make a copy of M~s. Olmstead's letter ~o keep for file and to send the original to the insurance company for their file. ABANDONMENT OF ,~,T~.I~y: ~/r. Louis Ule~d appeared before the Council with the request that a portion of the alley running fx~m Tkird Avenue to G Street be abandoned so that he might avail htm~elf of this space on which to erect a building. Cl. Perkins advised that in his opinion it would be a definite benefit to Third AvenUe and would remove a hazard to small children which now exists at this place and recommended that this por- tion be abandoned. Upon motion by Cl. T/rm~ons, seconded by Cl. Perkins, which carried, the matter was referred to the Ci~y Attorney to arrange the necessary procedure amd papers for abandonment. RE .~. FOR, ,,DR!VE~,: ~. ~m. Moeser appeared before the Oouncil asking permission to cut out a twenty foot length of curb on Third Avenue near the new m~ket to permit access to a parking lot for patrons of the market. Asked Specifically by Cl. Perkins whether this would be a public or a private parking lot 1/r. Moeser assured 01. Perkins that it would be a public parking lot without charge. On this basis it was moved by Cl. Timmons, seconded by Cl. Howe, and carried, that ~r. Moeser be allowed to construct a 18 ft. drive way to this property Cl. Perkins withheld his vote on this motion. I~O~I.0,N NO., ,$1,~,: Cl. Perkins offered Resqlut, io~ No. $1~. This is a resolution approving the petition of the Santa Fe Railway Company for extension of railway service in Ohula Vista. The resolution was read in full a~d was passed, adopted and approved by the following vOte, to-wit: A~es: 01men. Perkins, Burnside, Howe end Timmons; Noes: None; Absent: Cl. Dupree. HE,JEST FOR STI~A~t~ GPADING: ~. MaNeely and others appeared before the Council to ask that the 0ity grade a street x~,~ug east from ~ourth Avenue known as Konetska Way. This not being an accepted street but et~mply a private road way Street C¢=,,,,~,~ssioner Perkins advised that the City was not willing to use their equipment inrepair of same. He did advise !/r. MeNeely, however, that the culvert at the entrance to this road would be re- paired by the City as soon as time was available. OB ,YECTIONS TO. ,O.RDINAN ,GE NO. 500: The clerk presented a petition which had been cir- culated by Mr. l~. $. Peters asking the 0ouncil to rescind Ordinance No. 300which licenses occupations .r~ businesses. The petition stated that their objection was based on the fact that the business men would bear the brunt of this extra burden ~d they preferred that these ex~ra funds be raised by general taxation. A very lengthy discussion followed the presentation of this petition participated in by 1/r. Yack Millan, Executive Seorets-~y of the Chamber of Ccmm~erce who explained that the movement had been fostered by the Minutes of a Regular ~eting of the City Council, held December S, 1941 C~A~ber of Commerce in the best interests of the local merchants. Mr. Z. D. Eidder also spoke, stating he thought the ordinance was a Just one and badly needed to ~e enforcible our present licensing ordinance. Mr. Peters took e~ception to every ment that was advanced in favor of the ordinance ~ud ended by saying that he would be willing for the ordin~uce to go into effect providing all outsidA businesses would be licensed with e mi~wmun fee of $150.00 per year payable quarterly. ~Mr. C. V. 2~own stated that he had secured approw~m-tely twenty-three names to the pe~$~n from business men adjacent to National Avenue. It would seem from the discussion that tD~re was a great deal of misunderstending about the whole affair end several made the statement that after further study they regretted that their names were placed on the original petition. Cl. Perkins advised those in the audience that in his opinion the ordin- ance should be left as it was and tried for a year, then if found inadequate or unjust it could be repealed; the other me.bors of the Oouncil concurred in this belief where- upon the matter was dropped. ~RI~W_T, AL B~,,ARDINGHOUSE: 0mce again the matter of the condition of the Oriental Boarding House at Third Avenue and K Street owned by Mr. Auderson came before the COuncil. Mr. Anderson advised that his agreement with the Council expired Yenuary let, 1942 and that he had given notice to the occupants to vacate on that date unless the Council saw fit to grant a temporary permit to continue for a period of 80 dsys in order to allow the harvesting of the crops. Building YmspectorDone made a report on conditions and said the building is in very poor condition and contrary to the requirements of the State HousingAct. Mr. Tom Chino was spokeam-m for the occupants of the building and was very much concerned over their removal at the present time due to the need for adequate labor in harvesting the crop of celery. The Council advised ~. Chino that they were powerless to help in the matter and suggested he contact the State Housing authorities and request permission to stay on for that length of RE~DV_~T FOR LOCATION OF MAIL BOXES_: The clerk read a letter from Richard Higgs, Postmaster, requesting permission to install mail boxes at Third ~lvenue s~d F Street and Third Avenue ~n~ Oenter Street. Upon motion by Gl. Ttrmmons, seconded by Cl. Howe, the request was granted and the motion broadened to include a bl.~ket authorization for the installation of m~l boxes wherever needed by the Postmaster in the futUre. REQUEST FOR STEEE~ LI(~T: The clerk presented a petition to the O~uncil signed by several property ownere on Pa~k Nay requesting installation of a street light on the corner of Fourth Avenue and Park Way. Upon motion by Cl. T~rmmons, seconded by Cl. Howe, which carried, the matter was referred to the Street Commissioner with power to act. ,REQUEST F0~FUNDFOR CERISTMA~ ~qDI~JRES: The clerk presented a letter from the Lions Club requesting a~ allotment of"~00.'u0 to be used for 0h~istmas activities in the City of Chula Vista for this year. Upon motion by Cl. Perkins, seconded by Cl. Burnside, which carried, the expenditure of $200.00 for this purpose was authorized. REQUEST FOR ~LEAVE OF ABSENOE: The 0ity Clerk requested a leave of absence the City December 2~rd and 24th. Upon motion by 01. Hm~e, seconded by ¢1. Burnside, which carried, the request was granted. PtrRDHASE OF '~CK ~ODY: Street O~lssioner Perkins requested authorization to buy a ~ump truck body for the new t~uck chassis which was recently ordered. Upon motion by 01. Howe, seconded by Cl. T!r~ons, which carried, the request was granted. .RE~.QLUTION NO. $~0: Cl. T~_mm~ns offered Resolu~ion No. 820. This is a resolution accepting en easement ~n certain lend for street purposes. RESOLU~ON NO. 6~,!: Cl. Perkins offered Resolution No. $21. This is a resolution accepting certain lends for street purposes. The resolution was read in full smd was passed, adopted and approved by the following vote, to-v~t: Ayes: 01men. Perkins, Burnside, Howe and Ttrmmons; Noes: None; Absent: Gl. Dupree. In the matter of the foregoing~ two resolutions the clerk was instructed to secure a policy of title insurance on all the land included in these two resolutions of acceptance.
