HomeMy WebLinkAboutcc min 1940/10/07 MINUTES OF A REGULAR ~&~I~I'ING OF THE CITY COUNCIL OF THE CITY OF CHULA YISTA, CALIFOP~ HELD OCTOBER, ?, The Council met in re~-mlar seeston in the Council Chamber of the City Hall on above shown date with ~ayor Done presiding. T~e meeting was called to order at ? o'clock P.M. Present: Ail members. ~ OF ~h.~V.LOUS ~E~TIN~S: The minutes of a regulsr meeting of Sept. 3rd and of the adJou'r~ed regular meetings of Sept. 12th and Sept. 19th having been prepared and m~_led to each member of this council by the city clerk were approved as prepared and ~led. SET-BACE ORD. ~IOLA~,0N,:, M~. Yawger, who had been requested by the Council to move his recently constructed garege as its location is in conflict with the Set-Back Ordinance, appeared before the Council to request that a suspension of the Set-Back Ordinance relating to his lot on 6th Ave. and H St. be granted. He produced a scale map which showed the location of the present building and explained that he had placed it in this location be- cause it see~ed to h~m to be the least conspicuous spot. He further stated that he found no provision in tl~ law which would classify his building as a traffic hazard. Be also stated that at the time of the constxw~stion of the garage he waS not suspicious nor had he an idea that the garage location was in conflict with an~ city ordinance. At this point the City Attorney was asked where the liability for this violation rested. His reply wes to the effect that in no way was the 0ity liable. Be further stated that in his opinion it was a matter to be settled between the Building Inspector and Mr. Yawger. ~en asked if he had discussed the matter of Set-Back Ordinance ~n~ location with the City Clerk M~. Yawger stated that he had not. At this point Cl. Dopree stated that in his opinion an ordinance should either be repealed or enforced an~ asked Mr. Yawger if he had any suggestion as to a reaSonable settlement of this sit~mation. MA-. Yawger cited several instances in which the Council had previously waived zone restrictions and stmtl~ matters ~ud suggested that the same procedure be followed in this case. Mayor Done then told Mr. Yawger that the Council would take the matter under advisement and notify h~m at a later date of their decision. t~D~EST FOR MASTER ~'S ~,'raENSE: Mr. E. A. Logan of 3255 Byron St.. San Diego. appeared before the Council to request a Master l~umber's License. He was advised that it would be necessary fo~ bt~ to be e~mtued by the local P!~u~bers' ~r~tn~ Board before a license could be issued. R0~R AIRCRAFT CORPORATION: The clerk read a letter from the Rohr Aircraft Corporation in which they 'acknowledge the receipt of and acceptance of the terms of l~eolution'No. 579. FV~AV. ~W.?. U~W.V. ~ L~P~: The clerk advised the Council that effective as of October 1, 1940 electric 'service for lights at the ball park had been ordered cancelled by the City for the reaSon that there was no provision in the new budget for same. RE~YEST FOR 0IL LEA~E: The clark read a letter from D~. Whiteloc~ of ~en Diego again requesting consideration for e lease of the City-owned tide lands for oil drilling purposes. After a brief discussion the Council ordered the letter tabled. AUDITOR'S I~gPOi~: The clerk read a letter from M~. W~rold Certified Pablic Accountunts, in which a complete report of his recent audit of the books of the 0ity of Chula Vista was explained and upon motion by Cl. t~we, seconded by Cl. Paxton, which carried, the report was ordered acceptede 'I~ FLA~S ~m~.,$: Chief of imolice Kelly acquainted the Council with the fact that the present flags furnished by the Oity are badly in need of replacement and upon motion by 01. D~pree, seconded by Cl. Pa~ton, which carried, the clerk was authorized to buy new flags when funds are available for same. BTT.T-~I p~: Upon motion by Cl. Howe, seconded by Cl.
