The Council met in regular session in the council chamber of the City Hall on the
above shown date with Mayor Done presiding. The meeting was called to order at ? o'clock
P.M. Present: All members.
MI~u'f~S OF PREVIOUS I~EETINGS: The minutes of the Regular ~eeting of Me~ 6, 1940
and of the Special 5~eeting of May 16, 1940, having been mailed to each member of this
Council by the City Clerk were approved as written and r~ailed.
ORDINANCE NO. Z86.:. Upon motion by Cl. Howe, seconded by Cl. Paxton, which carried,
Ordinance ,No. 286. was put on its second and final reading. This is an Ordinance estab-
lishing uniform highway markings within the City of Chula Vista. The Ordinance was
read in full and was in the exact form as given on its first reading at the meeting of
this Council held May 6, 19AO. It was passed, adopted and approved as read by the fol-
lowing vote, to-wit: Ayes: Clmen. Howe, Dupree, Paxton, Perkins and Done. Noes: None.
Absent: None.
PETITION TO BUY II~O SEb~ER DISTRICT:, The clerk presented a petition to buy into the
sewer district signed by five property owners on Alma Street West and adjacent to Second
Avenue. This matter was referred to the City Attorney for investigation and report.
REQUEST FOR ~aT.WEy Ek~NSION: The clerk presented a letter from L~. and ~rs. Paul
Grandall of 2A4 Third Ave. in which they wished to know why the alley that starts beside
Foster's Store on E St. and runs down as fa~s M~. Whitt's property could not be ppened
through the whole block to Davidson St. Mayor Done stated that he had consulted the map
and found that the extension referred to was on private property and that the Council
had no authority to extend the alley further.
GLEN ABBEY SIGI~: Cl. Howe called attention to the fact that the sign on the corner
of National Ave. and E St. placed there by Glen Abbey Mamorisl Park Association was con-
trary to the ordinances of our city. Inasmuch as the Association had previously request-
ed permission to install four new signs at differen~ places in Chula Vista it was moved
by Cl. Dupree, seconded by Cl. Perkins, and cerried, that if the Association would remove
the sign telex?ed to at National and E permission could be granted to install standard
Automobile Club of Southern California signs at the following places:
One at 3rd Avenue and E Street,
One at E Street and 5th Avenue,
One at F Street and 5th Avenue,
One at 5th Avenue and Bonita Road.
It was further reeo~ended that an additional sign be placed at the co~er of 4th Ave.
and E St.
REQUEST TO AUDIT CITY BOOKS: The clerk read a letter from Alfred Fau!~-er and Associates
of Sau Diego, California, offering their services to audit the books of the city. The
letter was ordered tabled.
BID FOR VEN~.'i'IAN BLINDS: A bid of $39.09 from the Borg Furniture Company for the
installation of venetian 'b'~"inds in the two front offices of the City Hall was presented.
Upon motion by Cl. Dupree, seconded by Cl. Paxton, which carried, the bid was ordered
accepted.
BID FOR NEW CHEVROLET: A bid from Pm~l I. Stevens, Chevrolet dealer, this city, to
furnish a new 1~40 Ohevrol'et with specified equipment was read and discussed. It was
thought advisable not to take action on the purchase of this car until after the expira-
tion of the present budget year.
Inasmuc~ as there is provision in the present budget for a
trade in of the present prowl car on the purchase of a new one Police Chief Kelly was
authorized to m~ke an exchange, providing the cost of same would not exceed the budget
allowance of $350.00o
REQUEST FOR FIRE PLUG: ~ir. Northwang appeared before the Council and asked that a
fire plug be installed at the corner of 2nd Ave. and G St. to replace the present in-
efficient standpipe. The matter was referred to the Fire Co-w. tasioner for investigation.

which carried, the ~nutes of the Re~l~ ~geeting of the Pl~ing Cohesion of ~ 20,
1940, ~d the Mdnutes of the Special ~eting of ~ 31, 1940, were read a~ ~ter
lengthy discussion were approved, with the follo~ng exceptions:

of his business thro$ lack of adequate local ordin~ces, req~sted that an or~n~ce
s~lar to the one now in force in S~ ~ego be prepped and adopted by the City.
It was the opinion of City Attorney Higgs that a ~sty decision should not be ~de as
the issue involved was as yet not pressing enough to w~rant a special ordin~ce.
Higgs stated he would co. er ~her with the representative if future deficients
w~r~ut ed action.

which carried, t~ City Atto~ey was authorized to prepare ~d present proper ~en~ent
to the present Safety ~ne 0rdin~ce to confo~ ~th the present locations.
~., .~. A. ,C0~CT: Upon motion by Cl. Howe, seconded by Cl. P~ton, which carried,
the ~yor was authorized to si~ a contract for ~e continu~ce of the present S. R.
Contract.
~E ~ ~E: City Attorney Higgs having been requested to in~stigate the
legality of leasing tide l~ds for the purposes of drilling for oil rendered the opinien
that tide l~ds m~ be leased for oil ~illi~ p~poses p~vidi~ certain specific refe~
encee were ~de in the lease to the trust p~pose of the original gr~t and that the
lessee accept the responsibility of ~t~e co~t decisions pertaining to s~e. He ~her
stated that the law at the present time is uncertain but that the greater probabilities
are that in the future courts ~ll hold that the city has power to execute oil leases
on tide l~ds.
