in which he th-~ed the Council for their offer te cooperate in the matter pertaining to

~her, at the p~s~t t~ e~ineers were compiling fibres of cost, etc. ~d as such
material is available he would fo~d s~ to the City Co~cil. ~ also stressed the
adv~tages of suc~ a project to the City of Chula Vista.
C~ LICE~ ~CATION: ~e application of 0. F. ~aven for a c~ent contractor's
license was p~sented to the Council. Upon motion by Cl. ~we, seconded by Cl. ~,
which c~ried, the application was ~ted.
S~TTII~ G~ LI~: Cl. ~we brought to ~e attention of the ~uncil that a ch~ge
should be ~de in t~ city or~nce ~e~by prmperty o~ers should post $15.00 cash bond
with the cit~ clerk to sh~ good faith in ha~ng proposed sidewalks finished before the
city e~inee~ shoed set ~ade~ upon co~letion ef l~ing side~s the bond to be re-
turned. Upon motion by Cl. T~ons, se~nded by Cl. H~e, ~ich carried, this proposed
ch~ge to be inco~orated in n~ ordinance bei~ co~i~d by the city attorney; the Co~cil
bei~ given the power to ~e exceptions t~reto.
~ S~ W~G: St. C~tssioner Howe reported to the Council ~t the grade
on ~pine Street Is too low on one side, too hi~ on t~ ot~r ~d that the ~adi~ of s~
could not be done until Spring.
~ITI0~ ~R ~ SET ~I~: Cl. Howe reporting on this petition stated
that the street could not be widened for a greater dist~ce ~ 30 feet,to ~ich ~dth the
street is now grand, ~thout acquirl~ private l~d now plated in l~ons.
~IT~0N FOR ~ ~ ~~: Cl. Ho~, after investigation of the petition f~
lnst~ng steer light, recemended this petition ~ denied. Upon motion by Cl. Tigons,
seconded ~ Cl. ~n, which c~ried, t~ reco~ndation of Gl. ~e was ~proved.
Wy~ CO~ T~ S~: ~e clerk read a letter from Cl~ten B. Neill, Act~g ~slon
~ager of the Callfo~la Water & Telephone Comps, requesting t~t the co~cil t~ necess~y
action to clear up the delinquent t~es new due on t~ p~perty oc~pied by t~ water t~er
up to the ti~ ef their acquisition of the prope~y. ~e council asked the opinion of the
city attorney as to whether the city shoed ass~e this ob~gation. The city at~ney refer~d
them to a copy of his letter of ~e~er 5, 1939 ~itten to ~. Netll ~erein he stated that
it ~s his opinion that ~der the circ~t~ces in which t~ Water C~y acqui~d this
property they s~uld ass~e this obligation. Upon ~tion by Cl. ~e, seconded by Cl. Pazton,
which carried, the request of t~ California Water and Tel~hone Co~y that the Council c~cel
or w~ve t~se delinquent t~es was de~ed.

'i'~:~,~HONE C0~IPf~IY'S SUIT: The City Attorney informed the Council that the Southern
California Telephone Company had filed suit against the City of Chula Vista for a refund
of taxes due to over-assessment of property by the State Board of Equalization amd that
this suit is being filed against practically every other city in the State again this
year but action is being held up by the Telephone Company until the State Supreme Court
renders a decision on the case now before them. He reconmaended that he be instructed
to take the same action as heretofore and upon motion by Cl. Tinm~ons, seconded by Cl.
Brown, which carried, the above recormnendation was approved.
DdgSOLUTION N0. §~o4:v Cl. H~;e offered Resolution No. 55~. This is a resolution
accepting land from ~illiam I¢oeser and Pauline ~eser, husband and wife, for street
purposes. This resolution was read, was passed and adopted as read by the follo~ring
vote, to-~,rit: Ayes: Clmen. Timmons, Paxton, Brown, Done and Howe. Noes: None;
Absent: None.
O, RDI, NAi~CE N0. 284: Upon motion by Cl. Brown, seconded by Cl. Timmons, which carried,
0~dinanc~ No. 284 was put on its second and final reading. This is an ordinance changing
certain charges for construction and laying of sewer laterals. The Ordinance was read
in l~lll amd was in the exact form as given on its first reading at the meeting of this
Council held Janue~ry 2, 1940o It was passed, adopted and approved as read by the follow-
ing vote, to-wit: Ayes: Clmen. Ttww, ons, Paxton, Brown, Done and Howe. Noes: None;
Absent: None.
~tE~0VAL OF ~'RUIT ST~dqD: Clo Howe brought to the attention of the Council the matter
of a certain fruit stand operating at the cOrner of 3rd Avenue and J Street on which
he had received several complaints from property owners in that vicinity. Upon
motion by Cl. Howe, seconded by Cl. Ttraraons, which carried, the Police Cammissioner was
authorized to take necessary action to eliminate this public nuisance.
COIqSOLID~TION 0F VOTII~ PEECINCTS: The Clerk brought to the attention of the Council
that action should be taken to consolidate the eleven voting precincts so as to facili-
tate the casting of votes in the cc~ing election. Upon motion by Cl. Brown, seconded by
Cl. Paxton, which carried, the following consolidation was authorized: Precincts 2,
and 7, voting place City Hall, to be known as l~ecinct A; Precints l, 2, 8, voting place
Justice Court on National Avenue, to be knovm as Precinct B; Precincts 5, 6, 10, voting
place Nom-n's Club on G Street, to be known as Precinct C; Precincts 9 and ll, voting
place Chula Vista Vegetable Exchange, to be known as Precinct D. The Council Xnstructed
the ~,~eyor to designate voting officers assisted by the City Clerk to be selected from
registered list supplied by the County Rsgistrar of Voters.
"m,~ICAN IEFEIqSE ALLIANCE: The clerk ~ad a letter from the American Citizens'
Defense Alliance signed by William A. Foote explaining the activities of their organiza-
tion and requesting that they be granted permission to solicit memberships within the
city ltm~ts of Ohula Vista. The letter was ordered filed.
OFFICERS' MOTOR CYCLES: The clerk read a statement signe~ by Edgar F.. Rice con-
signing to the 0ity of Chula Vista his motorcycle, all rights, title and interest therein,
dated Ja~e~wyb4, 1940. A similar statement was read from Vern F. McLean. Upon motion
by Cl. Brown, seconded by Cl. Paxton, which carried, it was agreed that these ~wo motor-
cycles be accepted by the City.
TREE RE~0VAL: The clerk read a communication from R. H. Tabor, Chairman of the Plan-
ning Co,~,,~ssion, requesting that permission be granted Mrs. B. A. Shadinger to remove a
tree from the parking in front of her property at 25~ G Street . This action was re-
commaended by ~¥. Taber and two other members of the Pl~n~ing Commission. Upon motion
by Cl. Tqmmons, seconded by Cl. Brown, which carried, the City Clerk was instructed to
notify Mrs. Shadinger that she might remove the tree, including stump and roots, re-
placing the ~ at her own expense.
~tNUTES OF ,PLAN~NG CO~I~SSIONP The Minutes of the regular meeting of the Pl~uing
Commission held January 15,,1940 were read by the clerk and were approved as read.
W~ TRE~S,: Cl. Howe reported upon investigation the trees M~. Walker wished
to trade to the City for Cocos Plumosas to be planted in the parking in front of his proper-
ty were too small for use in the Park. Mayor Done instructed the clerk to inform
Walker that should he desire to remove said trees from the parking he would have to do so
at his own expense.
~FF LETTER: A commlunication from Howard D. Sutliff was read by the clerk. Upon
motion by Cl. Howe, seconded by Cl. Timmons, which carried, the letter was ordered filed.
CHP~IST~SLS T,I~z~ ~FUND: The clerk brought to the attention of the Council that the
Chai~n of the Christmas Committee, ~r. Baker, had exceeded the amount of their appropria-
tion in the sum of approximately $60.00. The Council instructed the City Clerk to pay bills
in the amount of the apprOpriation, the rest of the bills to be returned to the Chairman

CttRISTMAS 'I'It~E FUND: The clerk brought to the attention of the Council that the Chairman
of the Ohrlstmas Committee, ~r. Baker, had exceeded the amount of their appropriation in
the sum of approximately $60°00. The Council instructed the City Clerk to pay bills in the
emount of the appropriation, the rest of the bills to be returned to the Chairman of the
Christmas Oo...tttee, Mr. Baker.
DIVISION OF HI~T~&~m~.: Periodical report from the Division of Highways on mon&~s ex-
pended on State highways within the city limits of Chula Vista was read before the Council.
~yor Done was inst~'ucted to sign same as being accepted by the City. Cl. Howe offered
Resolution NCo 5§§, this being a resolution approving the allotment of ~ gas tax allocated
for State Highways. This resolution was read and was passed and adopted as read by the fol-
lowing vote, to-wit: ~yes: Clmen. Timmons, Paxton, Brown, Done and Howe. Noes: Hone.
Absent: ~one.
PERIODICAL RF~DORTS: The monthly report of the City Judge, the Police Department and the
Fire Department for the ~onth of January and the report of the City Treasurer for the month
of December were e~mtued and ordered filed.
HU~NE ,OFFICER: Chief of Police Kelly recommended that Bobby Law be placed on tt~ pay-
roll under the classification of Humane Officer, his pay not to exceed the amount allotted
in the present budget. ~ stated that at present the report each month was presented as
monies expended for rabies control and since this is not the case he felt it would be a
better practice to have Mr. Law on the regular pay roll. Upon motion by ES. Paxton seconded
by Cl. Ti~nons, which carried, it was decided that Bobby Law be placed on the pay roll at a
salary not to exceed the present budget.
~l~m DISTRICT: Fire Chief Armer requested the opinion of the council as to the limits
of fire protection due to the increase in fire equipment. The Council advised the Fire
Chief that the fire district included the px~ection of property v~thin the City limits of
ChulaVlsta.

Upon motion by Cl~ Tt~mons, seconded by Cl. Howe, which c~rried, this proposed chauge
to be incorporated in new ordinance being compiled by the City Attorney; the Council
being given the power to ~ke exceptions thereto.'
The,matter of the $1~.00 bond is to be incorporated in the Ordinance
above referred to on which the City Attorney is now working. In the meantime the
property owner must present to the City Clerk evidence showing that the contract has
been let ~nd that the work will be done.
