Present: All members. MINU~ OF PR~v10US I~, ,SK~TI, NC.S: The minutes of the Regular ~ieeting of September 5, 1939, of the Adjourned Regular Meeting of Sept. 25, 1939 and the Adjourned Regular ~eting of Sept. 28, 1939, having been prepared and mailed to each member of this Council by the City Clerk were approved as prepared and mailed. PERIODIC~L REPORTS: The monthly reports of the City Judge, the Police Department and the Fire Department for September were examined and ordered filed. ~OLUTION NO. 5§0: Cl. Brown offered Resolutio, n No. 5§0, which is a resolution accepting lauds from Wllliem and Pauline MOeser, hushed and wife,for city purposes. The :emolution was read and was passed and adopted as read by the following vote, to-wit: Ayes: Clmen. Brown, Done, Howe, Ti~mnons and Paxton. Noes: None. Absent: None. ~O, LUTION NO. ,~,~,l: Cl. Howe offered R,e,s. ol, ution No. 551, which is a resolution accepting lands from George J. Sudborough and Ethel Grace Sudborough, husband and wife, for city purposes. The resolution ¥~s read and was passsed and adopted as read by the following vote to wit: Ayes. Howe, Tfmmons, Paxton, Br~n and Done. CANCELLATI(~I OF ~: Upon motion by Cl. Brown, seconded by Cl. Ttmmons, which carried, Warrant No. 12,744 issued to Lydia Schweider was ordered cancelled ~ud a new one issued and delivered by the City Attorney upon procurement of proper receipts and evi- dence of ovmership. ~mm ASSESSMENT: The City Attorney advised that he had been contacted by ~ir. Bresee in regard to the Warrant for the City's shareof the settlenent of the Bresee m~tter. L~r. Davies advised that ~r. Campbell, attorney, was to get some record from the Title Company showing they were willing to pay their third of the cost but as nothing had been submitted to b~m nothing could be done at this time. FILLING OFFICE OF OITY CLERK: Mayor Done nominated Mr. 0. C. Ludwig; Cl. Timmons moved that the nomination be confirmed. Failed for lack of a second. Cl. Brown nomin- ated ~ir. It~rbert Bryant, the nomination was seconded by Cl. Paxton. The vOte was taken and was as follows: Cl. HOwe, no, Cl. TizEons, no; Cl. Paxton, yes, Cl. Brown, yes. ~r. Done declared the motion lost. Cl. Howe nominated Mr. Harold L. Pope, ~spc~nd~ed by ~.~. Brown ; following is the vote: Cl. Ti~mons r~served his vote, Ayes:~l~l~e'n. Paxton and Brown, Noes: Cl. Done. Cl. Brown left at this time. U1TPLEAS~LNT ODOR:, Cl. Howe brought up the matter of the unpleasant odor coming from the Northerly part of the city. Chief Kelly expressed the opinion that this odor is caused by the stagnant water tHat comes dow~ under the bridge aud ~amains there. He stated that he and Dr. Ashcroft had made an investigation of the sloughs and the Vanderberg Packing house in National City and that there is no water c~m~ing from those sloughs. Upon motion by Cl. Howe, seconded by Cl. Paxton, which carried, a committee consisting of Cl. Howe, Cl. Paxton and 0hief Kelly was appointed to investigate the condition ~d take it up with the proper County authorities. Blt.?2 PAID: Upon motion by Cl. Howe, seconded by Cl.
