The Council met in regular session in the Council 0hamber of the City Ball on the above
shown date with Mayor Done presiding. The meeting was called to order at 7 O'clock P. M.
Present: Mayor DOne, Clmen. Howe, Ti~laone, Broen and Paxton. Absent: None.

approved as prepered an~ mailed.
REQUEST OF H. B., B,. ,A~.T.~: The Deputy Clerk read & letter f~om Mr. Allen thn~Wtng
the Council for their appx~priatinn of $~00 and asking their pex~iesion to use F St. be-
tween gud Ave and C~x~ett St., also the ball park and lot adjacent thereto, the -~apitheatre,
a~d for police protection on th~ days of the Fiesta, ~ept. 21, 2P. and 2~, 1939. Upon
motion by Cl. Brown, seconded by Cl. ~we, which carried, the request was g~anted.
CE}~T C0h~TRAOT~'S LIO~E: Upon motion by 01. Me, seconded by 01. Brown, which
carried, the '~pplic~i'Jn of Glenn Gilbert for a cement contractor's linense was approved.
FIAI~ ,APPL~0A~..0~: The letter of application of Mr. Re.send ~. Flanders for the
position of City Clerk When it s~]l become vacant was read to the Council and was ordered
filed.
0~ m~. ,~.~w~ ~l~ .CE~, ' ~ma~TING: No action was taken on the w~itten request in the
form of a cix~ular letter from W. M. Dickie, Diraotor, State Department of Public Bealth.
that the Baalth 0ffioer attend the annual meeting of the California Health 0ffisers' to
be held in connection with that of the League of California M~micipalities, Sept. 18th to
~0th. The opinion was expressed by the Council that this is a County, not a Gity matter.
The letter was ordered filed.
B~ ASS~-T: Mr. C-..p. bell. Attorney for M~. Bresee, was present and advised
the Coun~['l 'that the Title Coz~a~y in order to get the matter closed was willing to pay
one-thi~l of the total amount, which he figured would be in the neighborhood of $~0.00.
The concensus of opinion was that while the City might be morally responsible the Title Co.
was legally responsible; that it was not part of the duties of the City Clerk to -~- cer-
tifications. The City Attorney expressed the opinion that the City c~.-ot pay out money
for "morale obligation; that the 0ity's funds can only be expandnd for a legal obligation
and the only obligation that h~e been incurred is that the City Clerk in the performs-se
of his duties made a report which was erroneous and for which the City is liable. After
considerable discussion it was d~cided that in order to avoid further inconvenience for
Mr. Bresee the 0ity should pay it's third of the above referred to cost. Upon motion
by Cl. Ti--aaonn, seconded by M~. Paxton, which carried, it was agreed that the City sta-cl
it's proportionate eh~x'e.
RENTAL OF CITY'S ~Q,US~,:, Upon motion by 01. Howe, seconde~ by Cl. ?~--~ns, which
carried it was decid~l to rent the house belonging to the City at 45~ G Street to the
mother ~ud stepfather of Street Superintendent Love for the sum of $15.00 per month;
the ranters in return for this iow rental to beep a watoh~-,~ eye on the City's equipment.
ON ~AT.E ~ NOTI~= The State Bon~l of Equalization notified the 0ity Council of the
applionti~ "of George B. Loft for an on-sale beer license at 4~5 National Avenue. The
Chief of Police having no objection no protest was made.
QU,IT G.I~ ~: Upon motion by Cl. Brown, seconded by Cl. Timmons, which carried,
the Mayor was instructed to execute a Q~it Claim Deed to the Brock Building COmpany for the
City's interest in Lot 10 in Block C of ~.-~les Park Subdivision, delinquent 0ity taxes on
same having been paid in full.

~md the Police Depa~nt for August, 1939, and the monthl~ reports of the City T~easu~er
for ~uly an~ August, 1939, were exam,-ed a~d ordered filed.
1939-1940 BUDgeT: Upon motion by Cl. Brown, seconded by Cl. Ti~aons, which tax.led,
the following Budget was adOpted and approved for the Budget Yea~ beginning October 1.
