The Council r~t in regular session in the Council ~h~mb~r ~f the City Hall on the above shoran date ~wlth I~iayor Done presiding. The meeting was called to order at 7 o'clock P. ~i. Present: I~Layor Done, Cl. Hove, Tin.cna, Brown and Bryant. Absent: None. ~UTES OF PREVIOUS ~G: The minutes of the regular meeting of July 0, 1939, havin'g bee~ 'prepared and mailed to each member of this Council by the City Clerk, were approved as prepared and mailed. CL. BRt~d~T'S ~r~SIGN~iTIOI~: Upon motion by Cl. Brown, seconded by Cl. Howe, which carried, the resignation of Cl. Herbert Vo Bryant was accepted with regret and he was thanked by the remaining members of the Council for his past cooperation with them. In his resignation Cl. Bryant stated that he had enjoyed his work on the Council but was resigning in order that he might be in a position to accept the office of City Clerk should he be elected or appoint- ed to same. APPOI!TI~ OF RALPH PAXTON T0 COUNCIL: Upon notion by Cl. Brown, seconded by Cl. Timmons, which carried, ~ayor Done's nomination of Ralph Paxton to the council to fill the vacancy created by the resignation of Herbert V. Bryant was approved. Cl. Paxton was sworn in by the clerk and took his place at the council table. BRESEE ~,T. i~. ~f. Campbell, ~ttorney for D. Bresee, reported to the Council that he had made a compromise with I~r. Haas on the sidewalk, curb and gutter assessment for $130.00. He stated that he did not believe that the City was liable for the error that had been made showing this property free of all assessments but that he did feel the City had a moral responsibility in assisting 1.h% Bresee in meeting the said cost. After considerable discussion over the question the matter was referred to the City ~ttorney to investigate and to report tl~ possible settlement ~t the next meeting. ~CE RESTRICTIONS: L petition sigaed by a number of property o~n~ers in( Howe's Subdivision ~d Lots 9 and l0 of Quarter Section 149 requesting the Council to restric~ said area to the Caucasian race was presented . Cl. Howe infolwed those present who h~d sigaed the said petition that property in Ito~?e's Subdivision was restricted at the present time but that he did not believe t~t the City had jurisdiction to impose restrictions on tne other property which has not been covered by subdivision laws. The City ~ttorney stated that it was his off-hand opinion that the ~tter was entirely between the original ov~ners ~nd the present o~n~ers and that the City had no jurisdiction over same. The City Council, however, re- ferred the ~atter to the City Attorney for his investigation and official opinion at the next meeting. Seemingly the cause of the ~bove petition has been the renting of a house on Second ~venue owned by ih~. ~?. J. S. Browne to a Japanese who ~as allowed his truck to park in front of his house ~t all hours of the night and has allowed vegetable c~ates of various descriptions to be strev~ about his lot. Cl. Brown of~'ered to contact D~. Sano regarding th'is promiscuous stre~'~ing of crates by the party above referred to to see if the property could ~ot be kept in a more desirable condition. PLA~Ii,~G COD~,~ISSION RESIGE~TIOk~S: Upon motion by Cl. Bro~;~n, seconded by Cl. Howe, ~'d~ich carried, the resignation of 12r. Kinmore and of l~r. R. L. I,~eller fro~ the City Planning Con. mission were accepted and upon motion by Cl. Timmons, seconded by Cl. Brown, ~hich carried, ?.~ayor Done's nomination of Charles Endsley to nembership in the City Planning Connuission was confirmed. BUDGET RE~'0ESTS: ?ne City Clerk rsad recommendations of the Jean Frederic: Loba Post 454 of the American Isgl'on and of the Chula Vi~.ta l~rchants Association that the City Council consider the purchase of a T~'~o-~,~JaY radio system to be maintained between Police Headqu~rters ~d its oatrol cars and the recommendation from tt~ Jean Frederick Loba Post for the appro- priatio~in the next budget to supply new fl~gs for the flag pole in the Plaza ~.d on the City Hall. The above recO~uendations were ordered to be held for consideration at budget time° The request of Paul I. Stevens, i~resident of the Chula Vista Chamber of Conm~erce, that the City appropriate one thousand doll~rs in the coming budget for the use of the Chamber of Commerce was ordered filed fOr budget consideration~ The request of the Finance Cor~mittee aud i~ir. H. B. B. Allen, the Fiesta Chairman, for a $500 appropriation for the co~_ing Fiesta was ordered filed for budget consideration. ~.~J~Id~R ~JEiDGE D~d,~GE: Upon motion by Cl. Brogan, seconded by Cl. Paxton, which carried, the re'quest of ~. C. ~. ]~Jalker, Ol0 Third Avenue, for a clai~'l of $E5.00 due hi~ as damages to his hedge which was burned by an S. R. ~. employee wor$ing with the City weed-burning crew was referred to Street Cormmissioner Howe for his investigation. It ~s pointed out by Street Superintendent Love that the hedge had been so~ked but that a change in the ~vind caused several plants in the hedge to be scorched but that the workers had been very careful to keep the damage to a minimum° Diinutes of a -{egall~r ~ieetin~ of the City Council, Held .~ugust ?, 1939. Wiard thanking the Council for their action in banning the use of fire explosives over the 4th of Yulyo LETTER OF AP~.ORECLiTIOI~: Upon notion by Cl. Brown, seconded by Cl. Tirmnons, which carried, the City Clerk was instructed to write letters of appreciation to ~ssrs. Haight, Fletcher, Stream and Pdtchie for their part in making the League dinner a success. ST~T LIGH~II~G REQUEST: The request of i,~s. Burgett for the installation of a street light on i~ Street midway between 3rd and 4th Avenues was referred to Cl. Howe f'or his in- vest!cation. CARD T~.w. LICENSES: Upon motiou by Cl. Br~,,,~., seconded by Cl. Howe, which carried, the applications of George Lott and Hathan Peters for card table licenses were granted. FLEET I~MGtd~i(CE: This being the tine of year for which the fleet insurance business should be allotted the City Clerk advised that the follow, ring parties had partici?~ted in said insurance: Pray, Folks, L!errill, Shadingar, Jiggington, Bigelow ond Bro,,me; that those entitled to participate were Guptil & Fulton, H. E. ~[iller and Ii. HoOper. ~!e ~fnestioned the Council if any of them}mew of anybody who should be entitled to participate in addition to those above listed and ~s no others were mentioned he listed the na~es of the last three mentioned above on separate pieces of paper, sho~k them up in a hat and asked City Attorney Davies to draw out a slip. The n~ae of Guptil & ~lton was drawn and if they can place the business with a Board company they will be given the insur~u~ce this year.
