Beuthel, ~s~rict ~gineer of the Divisio~ of NiMh~2~, ~nd Street Oo~.~issloner ~, to dete~ne the projects which Minutes of a Regular Meeting of the City Council held May 1, 1939. would qua~llfy according to the State law allowing said expenditurese Mr. Beuthel assured the Council that should the City desire to armor coat ~hird Ave. from Y St. to K St. over the present pavement that he was sure a supplemental agreement could be made allowing for such expenditure. BRIGHiW~OOD ??.T,~ ABANDON}~T: The request of ~. Lozamo, a property owner in the Brightwood Addition, for the abemdonment of the alley in Block ~- of Brightwood Addition was referred to Street COma1 ssioner Howe for his investigation and report at the next meet- ingo This alley being of l0 ft. width m~es it impossible for the street grader to grade same and consequently it is not serving its purpose as an alley. CARD TABLE LICE~BE: N~. Eenmeth Wishca~t reqUested the Council to authorize a refund of $9,00, which is the amount of the second quarter license which he hoe paid for the card table license at ~? Third Ave. and which business he has sold to Allen Moeteller. Mr. Allen Mosteller made application for a license to operate said card table at the above ad- dress. As it was pointed out by the Council that there was no provision in the Licensing Ordinance for the transfer of such license nor for a refund, Mayor Done moved, Cl. Howe seconded and the motion carried denying the request of ~. Wishart for a refund and referring the application of },~. Mosteller to Chief of Police Kelly for investigation with power to note i~ERIOD,,ICA~ REPO.R~S.: The monthly report of the City ~udge, the Police Department and the Fire Department for the month of April, 1939, and the City P~operty ~Uventory of the Street DepaA-~ment were presented to the 0ouncil and ordered filed. 3RD AVE. TRUCE PARKING,: Chief Eelly explained to the City Council the difficulties en- countered bY Stuck operators for adequate parking places after having their trucks over- hauled et local garages on 3rd Ave., specifically the case of Roger Lee who has his work done by Wolfe & Arnold on the corner of 3rd Ave. & Madrona. The trucks after having been serviced have been parked parallel on the West side of 3rd Ave., Just S~uth of the San Diego & Arizona Depot, which is against the City ordinance as it specifies that cars must be parked diagonally on 3rd Ave. It was pointed out by several of the Counsil~an that this parallel parking created a very serious liability to the City should a car going South on ~rd Ave. ha~e an accident with a train due to vision obstruction caused by the ~rueks parked at that location and as the trucks would block the highway if perked diagonally the only recourse left for them was to obtain permission to park on vacant lots thereby. ~'i~STA C0~A'A~'~.~: Mayor Done appointed Cl. Lauderbach informed the Council that the District Attorney had advised the School Board that public liability insurance ~ould be taken out to protect the~ against any accident which might occur on the school property leased to C. V. Brow~ and used as a recreation center. Mr. ~o~, having dete~minad that the cost of the above insurance approx~m~te~ $128.00, advised the Council that he would be unable to aes~,.~a same a~d as thc receipts are not more than enough to care for the maintenance he saw no solution to the situation u~less the City would care to assist the School Board in paying the above insurance. Mr. Lauderbach, however, stated that it was his opinion that the School Board could not m~ke insurance payments upon property leased to another party but by canselling the lease to ~r. Brown he felt that the School Roax~ would be willing the assume the said insu~ance with the hope that the City would be will- ing to assist them in the future. Cl. ~Owe stated that he felt that inasZauch as the City has apprOpriated $250.00 for development of the park and assumed the cost of the lighting expanse that the School Board should ass~m~ the liability insurance cost. It was also pointed out by Mr. ?~nderbach an~ members of the Council that the recreational facilities should be made available to all school children and not confined so much to adults or to teams that are representing concerns that have bee~ pla~ing there. It was alSo suggest- ed that a~ attempt be made to obtain from the S. R. A. a man to help patrol the grounds and keep the children inside the park. M~. Davies informed the Council that it was his opinion that the School Board would prObably be willing to take out the insurance and work out with the City some method of cooperation for sharing expenses this co~ing year. 0bier Kelly stated that as a result of the recreation park delinquency had no doubt been greatly reduced.
