The Council met in regular session in the Council Chamber of the City Hall on the above shown date with I~or Done presiding. The meeting was called to order at ? o'clock P. Tt~ons. ~L~I~S OF PREVIOUS ~ETIN ,GS:,, ~ The mfnutes of the regular meeting of February 6, 1939, and o'f the adJ urned regular meeting of February 15, 1939 having been prepared and malled~ to each member of this Council by the City Clerk were approved as prepared and mailed. PLaY-GROUND, ,E?~N, SION: The clerk read a letter signed by members of the Chula Vista Recreational Council which informed the Council that they plan to provide playgrousd facilities including apparatus and flood lights to provide additional playground area to the main diamond ~hich is already constructed across from the G~ammar School; this addi- tlonal area to have badminton, basket ball and various other kinds of courts and to be available to the younger children. The Co~ssion requested a reasonable financial appro- priation to help carry on this work, stated that it was necessary to install several flood lights in the new area and that a $75.00 appropriation would assist materially in obtain- ing their objectives. Cl. Brown spoke very approvingly of the new area to be developed as it would take care of a greater number of children and moved that the Council appropri- ate $75.00 for said development; the motiSn was seconded by Cl. Bryant and carried. ~. Lauderbach, member of the Co~w~tssion, being present thanked the Council for their favorable action. ~ ,SUBDIVISION: 2~r. George Ktmball presented to the Council a new end different .preliminary map of his proposed subdivision of Lot lC, Quarter Section 156. According to the new map only one street would traverse the property from the southerly line. However, inasm~$~ as it would be necessary to have this approved by the Planning Co~tssion, Mr. E~m~all was informed that it would be referred to the~. Er. Kimball presented a letter protesting the raising of 3rd Ave. along the easterly side of said Lot lC, stating that it had been raised 4 feet above the natural grade and that he did not believe it was within the Jurisdiction of the City to do so. Said letter was ordered filed. C. V. C. A. FIRE HAZARD PROTEST: ~ir. C. A. Butler, Secretary-Manager of the Chula Vista Citrus Association, by letter protested to the Council the operation of a wrecking yard on the South-west corner of 3rd Ave. and K Street. He stated that at times the Asso- ciation has as much as $250,000.00 involved in their property; that this is not in the prOper zone for a wrecking yard and that due to the fact that the owners burn the bodies of wrecked cars ~t would create a very definite fire hazard especially as the wind blows from the ~est. The City Clerk infoE~ed the Council that Chief Kelly had contacted the opera- tors of this wrecking yard and informed them that they were in the wrong zone for said busi- ness ~nd that they had ~o move~to another location. The wrecking yard matter having the s~ status as the man without a country, the City Attorney was instructed to investigate the feasi- bility of establishing a wrecking yard zone so that this business could be conducted in the city and it was suggested that if it was practical that it ~ be established on Bay Boulevard near the Northerly city limits. ~hls action taken upon motion by Cl. Brown and seconded by Cl. Howe. CARD T.AB..I~, LICENSE AP~LIC,?TIONS: The written application of 2~. Walter Hedrick re- question permission for the granting of a card table license at 29S Center Street was pre- sented and the written application of Lloyd Backer for the granting of a card table license at ~ 5~? Third Avenue, the place formerly occupied by Mr. Wishart, was presant~d. Upon motion by Cl. Brown, seconded by Cl. Howe, which carried, the above applications were re- ferred to the Police Commissioner and Chief of Police with power to act. MO~K~GO~ TREE REQUEST: The clerk presented the written request of Mantie Montgomary for permission to remove from the parking in front of her property at 3rd. Ave. & Davidson St. two unsightly Jacaronda trees and replace the~ with good ones of the same kind. Upon motion by Cl. Brown, seconded by Cl. Howe, which carried, the application was referred to the Pl~lng Oo~w, fssion. CEZ~i~T CONTRACTORS' LICENSE: Upon motion by Cl. Howe, seconded by Cl. Brown, which carried, the application of R. E. and T. K. Cox for a cement contractor's license was granted. This action was taken as it had been shown that they have a State Contractor's License. K ,,ST,., Z, ONE SUSt~-2~SION PET. ,I~ION: A petition signed by several property owners in the vicinity of K Street between 3rd Avenue and ~th Avenue was presented to the Council; it stated that they had no objection to the erection of chicken equipment on the rear of the property facing on K Street and in Lots 3 and ~ of Quarter Section 1AC. It was recalled that several months ago a real estate agent in Chula Vista had a prospect for the purchase of p~operty in that vicinity end the prospective buyer wanted assurance that he would be able to erect chicken houses in that vicinity but inasmuch as there had been no formal application to the Council for said suspension the above petition was ordered filed. l~hV£~ OF i~Ct~di %~TII{G OF CiTY C0bl~CIL, ~1~n I.~DJiCH 6, 19~9. PL~dk~DiNG GOI~rrSSION t{EOOI,Z~I~)~TION, S,: The Pla~ui~ Comission's reco~m~endation that the set-back requirements on Lots ZC, 37 an~ 38 of the Dyer Tract, which faces on F Street and are directly East of Church ~venue, be waived met with the approval of the City Council. The City ~ttorney having expressed the opinion that the set-back ordin- ance was ambiguous in that it could be Inlberpreted to apply only to Zone A end also could be inSerpreted to apply to both Zone A and Zone B, he was instructed by the Council to investigate and determine whether it be necessary to have an amendnent to the Set-back Ordinance so that it would include Zone B. ~e City Clerk informed the Council that the procedure in the past had been to interpret the ~rdin~nce as applying to both Zone A and Zone B. Upon motion by Cl. Brovm, seconded by Cl. Bryant, the following reco~enda- tions of the Planning Co~mission were approved: l- That Cocos Pltu~osas trees be specified for Cedar Avenue; ~- That the request of ~rs. Bessie D~. Lyster of 5£6 D Street for removal of a small pepper tree be granted upon condition that it be replaced with a Cocos Plumosas and not with a Hybiscus as she had requested; 3- That yellow acacias be specified for Brightwood Avenue from E St. to Flower St.; 4- That the resignation of $. D. Snow be accepted; said resignation due to the fact that he has not the available time to devote to work on said Commission. FIRE-WO~ ,O, RDII~NCE: A co~,~nunication from Dk~. Richttrd (k~aves, Secretary of the California League of I~ml'clpalities, was presented to the Cou~cil which informed them that there are two bills to be presented to the Legislature prohibiting the s~le, poss- ession and use of fire-works in the State except under a permit granted by the City Council or Board of Supervisors. It was disclosed, however, that should the Legislature enact said bill that the effective date would probably not be before this coming 4th of July and after considerable discussion the Council decided to put Ordinance, No. E?? on its second reading at the regular meeting in April and D~. Y. Colder, representative of the Chula Vista L~rchants Association, being present was advised to notify the said Association of the proposed action so that the members could be present to discuss with the Council the adoption of said Ordinance. ASSESSOR'S MAP 25-A: Cl. Bro~n offered Resolution No. 538~which is a resolution instructing the City Assessor to use Map 25-A, an arbitrary map adopted by the Board of Supervisors as the official Assessor's map, for assessing purposes. The Resolution was read and was passed and adopted as read by the following vote, to-wit: Ayes: Cl. Brown, Bryant, Done and Howe. Noes: None. Absent: Cl. Tigons. ORD]~AI~CE NO., ES0: Upon motion by Cl. Brown, seconded by Cl. Bryant, ~hich carried, Ordinance No. ~80 was put on its second and final reading. The title of the Ordinance was read and the body of the Ordinance was in the exact form as when given at its first reading at the meeting of this Council held February 15, 1939. Upon motion by Cl. Howe, seconded by Cl. Brown, which carried unanimously, the reading of the body of the Ordinance was waived. It was passed and adopted as read by the following vote, to-wit: Ayes: Clo Brown, Bryant, Done and Howe. Noes: None. Absent: Cl. Timmons MAT~0~ N ~i'i'LEM~,:,, The City Attorney suggested that the 'Council meet on March ~.lst to consider actio~ on resolutions to clear up the tax deeded property in the A and I District by adopting redemption schedules. He reported that there is approximately $~0,000 of unpaid taxes due the County on property in the said District; that if it were possible to save the property owners County penalties, appro~lw~tely a $6,000 savings could be made in addition to the $15,000 Nattoon re-spread saving; that inasmuch as this saving is partly due to the action of the City he suggested that in the escrow fees to be paid by the property-o~mere in the District to the Union Trust Company that enough be charged against each property owner to compensate the City to the extent of a maximum $~0.00. ~b requested the Council to approve the following reco~andationa: 1. That the City Clerk advise the property owners who requested notice by telephone or letter in regard to the L~tjourned Regular Meeting to be held on March ~.lst so that they could discuss with the Council the procedure to follow regarding rates of redemption from the City; B. That the City Attorney be instructed to work out for the said property owners savings of Mattoon re-spread and County tax penalties provided the property owners pay the above escrow fees to the Union Trust Company of $350.00 and such other expenses as might be incurred affecting such settlement, any excess over the escrow fee to be applied by the City Attorney on costs and fees incurred by the City in such prededure; L~NUTES OF REGDLZQ L2iZTIi;G OF CITY COUNCIL, i~LdQCH 6, 1939 3. That the City Attorney be authorized to try to obtain $300.00 from the California Water & Telephone Comp~uy Chula Vista Mattoon bond refund contribution ~ud which has not been used for the purchase of bonds, to be applied by him on fees due him from the City. Upon motion by Cl. Howe, seconded by Cl. Brown, which carried, the above reco~..enda- tions were approved. P~RK TR~:F.~: l~r. R. T. Oonyers reported that the recormuendation of the Tree Com- mittee was to continue pepper trees on Second Avenue adjacent to the New Park and also reported that the Committee as yet had no recomnendation to offer the Council to fill the posts on the Planning Oormntssion recently vacated. The City Clerk infollned the Council that the W. P. A. office had informed him that the necessary personnel for the Tree Survey was now available and that l~r. Love was making necessary arrangements to begin the survey. The recomendation of Cl. Howe that "No bicycles" signs be posted in the New Park was referred to Police Cormntssioner Bryant. Cl. Ho~e informed the Council that the City had an opportunity to purchase a $125.00 used grease gun for $35.00; that inasmuch as the Street Department is doing practically all of their o~m repair work it might be advisable to make said purchase. Upon motion by Cl. Broadax, seconded by Cl. Bryant, which carried, the above purchase was authorized. BTT.?.~ PAID: Upon motion by Cl. Brown, seconded by Cl.
