Recommended Action
Conduct interviews of all four applicants for the Planning Commission who submitted a qualified application
during the specified application period, to fill one vacancy for a qualified professional seat and make the
appointment as appropriate.
The following applicants will be interviewed: Sharmane Estolano, Rodrigo Leal, Oscar Romo, and Charles
Sanfilippo
SUMMARY
Four individuals submitted a qualified application during the application period and have been invited to
interview to fill one vacancy on the Planning Commission for a qualified professional seat. Following the
interviews, the City Council may deliberate and consider making an appointment to fill the vacancy.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed activity for compliance with the California
Environmental Quality Act (CEQA) and has determined that this activity is not a “Project” as defined under
Section 15378 of the State CEQA Guidelines because it will not result in a physical change to the environment;
therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.
Thus, no environmental review is required

A member of the Planning Commission resigned effective April 27, 2023, resulting in one vacancy for a
qualified professional seat. Members of the Planning Commission are appointed in accordance with the full
Council interview appointment process specified in Chula Vista Municipal Code section 2.25.052(B), which
incorporates Chula Vista Municipal Code chapter 2.53 processes. Nominations for interviews are not
necessary since fewer than five qualified applications were received during the application period, in
accordance with Chula Vista Municipal Code section 2.53.040. Therefore, all applicants have been invited to
interview.
Vacancy:
- Qualified Professional – to replace Jon Milburn – term expires 06/30/2026
Per Chula Vista Municipal Code 2.42.030: A minimum of three members of the Planning Commission should
be persons sensitive to design consideration and interested in townscape matters. Persons qualified for these
seats should include architects, landscape architects, land planners, urban planners, civil engineers, and
other design professionals with suitable experience. The current Planning Commission roster has been
provided as Attachment 1.
The individuals listed below submitted qualified applications during the application period. The applications
are provided in Attachment 2.

DECISION-MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific,
and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11),
is not applicable to this decision for purposes of determining a disqualifying real property-related financial
conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Staff is not independently
aware and has not been informed by any City Councilmember of any other fact that may constitute a basis
for a decision-maker conflict of interest in this matter.
CURRENT-YEAR FISCAL IMPACT
This item will have no impact to the general fund.
ONGOING FISCAL IMPACT
There is no ongoing fiscal impact.

Good Afternoon, Mayor, Councilmembers, City Attorney,
The Chula Vista website is down, so am sending via e-mail.
There are alot of people upset about the zoning changes for ADU's especially. However, SB-10, the
State law behind all this, is not actually a hard-and-fast law.
Once the candidate is seated on the Commission, she or he represents all of Chula Vista. At that
point, we are all counting on the new Commissioner, not just the people in one district. Just like
friends, we live all over the place and have all sorts of ideas, good or not so good, but we all get
along.
So please do your own research and don't just listen to the legislative analysts. If the law says that
as long as the structures do not present a threat to public health and safety and are not affected by
the construction of the ADU, they cannot be the basis of an ADU’s denial. That means if they
are a threat, an ADU can be denied. Well, under this law, I think they are a threat, disease spreads
faster in crowded places, you can hear your neighbors, crime tends to happen more, and I hope that
a lot of denials occur.
You can do it! Just remember all of the people whom you represent. Thank you.
