CHICKEN HOT DOGS: A petition signed by p~operty owners living in the vicinity of 46 Madison Ave., stating that they did not object to the issuance of a special permit to Mrs. Edgar Nelson for the preparation of chicken hot dogs and chicken spreads, by-products of same, at 46 Madison Ave. was presented to the Council. While this property is located in the multiple dwelling zone wherein types of business like this are not ordinarily allowed, inasmuch as the business is to be carried on in her own home and the neighbors in that vicinity have agreed to it, upon motion by Cl. Bryant, seconded by Cl. Timmons, which carried, the permit was granted as requested for a period of six months. SideWALKS TO GRA~$/AR SCHOOL: By letter 1/r. Y. C. Lauderbach, on behalf of the Board of Trustees of the Chula Vista Union School District, pointed out the need for side-walks adjacent to the new grammar school in the south part of the city. Inasmuch as there ~re hardly any side-walks in the southern part of Chula Vista it would present quite a problem when the rains come and the School Board suggested that some Joint procedure be worked out by the School District and the City. As a good share of the students going to the Grarmnsr School come by way of Third Avenue down to L St., thence to the School, Cl. Howe suggested that on the space reserved for side-walks the street be graded and granited on Third Ave. from K to L and on the south side of L St. to the Grem~mar School. He suggested that if the school district could have the W P A workers now working there ~X'a~la and put in the header boards that the city would furaiah the necessary granite for same. }~r. l~%derbach expressed the opinion that the school trustees would be willing t~ cooperate to that extent and it was decided by the council ttmt this would be satis- factory if it met with the approval of the school board. Cl. Howe, upon suggestion of Ms~or Done, stated that he would be present at the next school board meeting to discuss the matter with them. 00UNTY APPROVAS~ OF R0f~D OILING: A certified copy of the Resolution adopted by the Board of ~pervisors of Sen Diego County on November 28, 1958, providing for the oiling of certain streets in Chula Vista, was presented to the council. This action by the Board of Supervisors was taken upon the request of the Oity Council by its Resolution No. 5~4, which requested the County to furnish read oiling equipment and necessary men to operate same for the oiling of I St. from National Ave. to Bay Boulevard and_ of Ohurch Ave., Dgl Mar .Ave., Tw/i_n.09k~ s ~Ave., Elm Ave. and Alpine Ave. between 4 and Kear~ey S. tre_e~_s and.between 'n~. xr.o..ana . MR!qSUM i-~"l'ITI0,N: A petition signed by property owners living in the vicinity of LS1 National Avenue requesting that the cOuncil grant I~s. Hersum permission to rent a building at that address to about twenty-five ~epaness workmen during the s,,~,m-r season if it could be done without violating any of the essential laws of the city or state, was presented to the council. The City Attorney reported that the use of the building as it is at present by this number of persons w~uld be a violation of the state law due to the lack of necessary lighting and ventil- ating facilities as well as the lack of toilets, that he had contacted Mr. Hersum regarding the matter and that he was sure they had arrived at the idea of abandoming it. In the light of this disclosure the matter was laid on the table. w~.CTRIC RATE RENU. CTI~qN: The City Attorney ~nformed the council that he ~ad recei~e~ a cozm~Auication frum the Railroad 0ommissiom infomaing him that a reduction would be made in electric rates which will save the customers of the Consolidated Gas & Electric Oompany approximately $158,000.00 ~nnua~ly. It was pointed out that the major portion of the reduction was made available to the ~11 domestic and commercial users in the incorporated cities of the county. Reductions were also made in public street lighting rates for installation of sizes above one hundred candle po~wex' in all cities. Barton, representatives of the Diego Su~, ~ropositioned the City Council to subscribe $00.00 to advertise Chula Vista in the "Come to Sen Diego" edition to be publied Dec. 8l, this year. They pointed out that through the facilities of the Scripps-Howard newspapers throughout the United States such advertising would reach m~ny thousands of readers and that the city had subscribed to the edition last year. Cl. Tirmuons, however, pointed out that the action taken last year was upon condition that no mere sue~ advertising was to be subscribed to ~ud upon ~aotion by Cl. Bryant, seconded by Cl. Timons, which carried, the proposition was refused as no appropriation had been made in the budget for said advertising this year. I~. Barton recmmuended that in drafting the budget for next year tl~t they should appropriate $00.00 for said advertising for next year and they thanked the Council for their ttmA taken and consideration. CITY Eh~,,~2~APPLIC~IONS: The clerk read letters of application for the office of oityEngineer fro~ the following: Howard D. Sutliff, Chula Vista, Y. A. Wahler, Chula Vista, Arnold F. 0ayser, National City, W. G. Gough, King's Beach, Yoseph F. BHse, V~u Nuys. Upon motion by Cl. Howe, seconded by Cl. Timons, which carried, the applications were ordered filed for the present to be considered at a later meeting. The cl~rk was instructed to inforr~ the~applicauts of the action taken. B .~ CC~i~0N REQUEST: The clerk read a letter from H~ Louis Bodmer which stated that he regretted the fact that the bond issue failed to carry and that he was under the impression that due to the fact that the election was not held Sept. £?th as originally planned but held with the General Election the city h~d expected to save so~e of the cost of the election ~ud that they might be willing to compensate him to some eztent for the large smo~u~t of work he had performed on the plans and specifications. He stated that he did not wish to make an issue of it but if the council saw their way clear to do so he would appreciate receiving some compensation as the ~rk that he did was considerably more than he had anticipated, l~eyor Done stated that I,~. Bodmer had misunderstood the issue regarding compensation. Cl. Howe pointed out that the contract with ~. Bod~r definitely stated that if the propositions failed to receive the necessary vote that he was to receive no compensation whatever. The Oouncil felt that ~. Bodmer had no reason to expect compensation in view of the fact that the bonds failed to pass. GASOLII~ BID~,: The clerk called the attention of the council to the fact that the gasoline contracts would expire ~anuary ~lst and recom~uended that they instruct him to publish necessary notices calling for sealed bids for the furnishing of gasoline to the city for one year beginning Feb. 1st, 19~9, and the council so instructed the clerk. T~X~REQUEST~ The clerk read a letter signed by Oscar F. Weissgerber which ~gain requested a refund of the first half of his 19~8 taxes and the cancella- tion of the second half on the grounds that the $1.0E as set upby ordinance for the general government fUnd did not conform to the state law rate of $1.00per hundred dollars assessed valuation. Cl. Ttmmons again explained the establishment of the rate whereby he showed that the $1.00 rate had not been exceeded for the general fund and as the council had denied the request at the previous meeting, the matter was tabled. The clerk also read a letter from~r. Weissgerber to the city council criticising Cl. Tt~w.ons for signing the demands of the 0hula Vista Building-Loan Association for its insurance business with the city. As this matter had also been re~erred to the city attorney and acted upon at the previous meetLng the matter was tabled. The clerk started to read another c~icationm from k~r. Weissgerber, which was in ~uswer to the report of Cl. Ti~m~as that he gave at the Nov. ?th maetl~g but ~ayor Done inquired of the council if they cared to have the commmmication read and they signified their intention of having it tabled without being read so this matter was tabled~ Upon motion by Cl. Howe, seconded by 01. Bryemt, which carried, the city clerk was instructed to write ~. Sipple requesting a refund of the amount of the discount ~'~hich they felt was due to the city fromm. Sipple on the Sept. purchase of tires and which had not been allOwed. Minutes of regular meeting of City Council, December 5, 1938. i~.,OTEST OF GAS B~ J~; The clerk read a letter from Fred A. Siegler who pro- tested vigorously the size of his gas bill and which requested the council to take some action in behalf of those who are being charged a~ excessive amount. Inasmuch as the council did not have aUthority to act as referee in the matter of gas bills, they instructed the city clerk to refer Mr. Siegler to M~. George Winn of the Gas Company. ATHAVE..CUrVeR, T:, Cl. Howe reported that he had investigated the condition of the culverts on &th Ave. between G and ~Llvarado Streets and had found that on the westerly end of the culvert the dirt had acc~,w.~lated to such an extent that it had backed the water up in the culvert a~d the culvert itself is p~rtially filled with debris; he stated that he was confident that by thoroughly clearning out the culverts and removing the dirt to a lower level on the westerly side of the culvert that it would eliminate any danger of flooding the land lying east of the street. He re- commended that the W. P. A. project approving the proposed culvert at that location be abandoned at least ~util such time as it could be proved that the present cul- verts are not adequate to take care of flood water. The council agreed and it was left for 01. Howe to take care of the matter. SEPTIC TAiIKWA'LI~QLINE: Cl. Bryant brought to the attention of the council the need for a water line to be install~ to the city septic teak and the dog pound at the foot of G St. He reported $~q~tV~he cost of laying a B inch line to the tank but after some discussion it was decided that a I inch line would serve the purpose and it was agreed that Cl. Bryant would obtain a definite price on a i inch meter and cost of installing by the Water Company and submit the prices to Cl. Howe and if Cl. Howe felt that tt~ city street department could install a i inch line cheaper he was authorized to do so, one meter to serve both places. i-EA~LING 0RDINANOE: Chief Kelly pointed out to the council the need of an ordinance regulating house to house solicitors and reccmm~ended that it be stringent enough to discourage the violation of sam~ He also pointed out the need of an ordinance prohibiting the peddling of propholactics especially as the peddlers of same are usually men of very poor character and undesirable to have in our commmmity at any time. He celled attention to the ordinance in effect at Escondido regulating s~ . The Oity Attorney rec(m~ended that he be instructed to investigate the need of the above ordinances and if he felt that present laws did not take care of the situation that he draft some that would take care of the matter. The council so agreed~ WVu~rlNG~AVE.: Chief Kelly reported on the dangerous condition existing for south bound traffic on ~rd Avenue at the point where the curb line on the west side of ~rd Ave. on the corner of Madrona ~t. Juts out into the street. Cl. Howe reported that representatives of the San Diego & Arizona 1~. were drafting a permit whereby the city would be allowed to wide~ the street at that point so that it would taper gradually much further south. AMBULANCE C00~(ATION: 0bier Kelly reported that l~mdy Sc~aoke of the State Highws~ Patrol had requested the cooperation of the city regarding ambulance service outside of the city limits as their facilities are not adequate at the present time. Chief Kelly reported that only on cases of more than one injury has he helped out the Highway Patrol in this respect~ Cl. How~ said that he felt the present practice was proper but that it should be co~fined to that. This seew~d to be the opinion of all the councilman. Cl. Bryant explained the use of the new folding stretcher which would be used in prowl cars, filling the need where more than one is hart in a wreck. It also serves many purposes as a stretcher. He rec,,,.~.,ended that the city purchase same at an approximate cost of $20.00 and the council agx'eed to said purchase. ~ ~TION: City Attorney reported that the request of Mrs. $ohm Y. l~ee for Yeteran's exemption which her husband, ~ow deceased, had failed to apply for could not legally be granted -- l~a~,ch as naither the vetere~ nor his w~dow had made proper application for MATTOON ~m~£.LI~G~VT: The 0ity Attorney reported that of the twenty or twenty-two bonds outstauding the owners of some of the bonds were reportedly going to contest the suit of the county to liquidate theme He recozaaended that if the bond holders would accept ~0 cents on the dollar from the county and 12~ cents on the dollar to be paid with the county delinquent taxes as, if and whom the delinquant county taxes are paid he believed about fourteen or more of the bonds could be obtained and that if all the outstanding bonds were obtained by this method a m~imumof SE~O0.00 of the approximate $7,000.00 d~linquent taxes against the District would be used. The Minutes of a Regular Meeting of the City Council, December 5, 1938 Council seemed to think that a settlement like this would be much better than taking the matter to court and upon motion by Cl. Howe, seconded by Cl. Tizmmns, which carried, they authorized the City Attorney to work along such lines and when a definite agreement could be reached the Council could be called upon to act upon same. PERIODICAL REP0~ .RTS: The monthly report of the City Judge, of the Police and Fire Dep-,-~aents for the month of November and of the City Treasurer for the ~%onth of October, 1938, were ex~rat_ued and ordered filed. PARK WORK: Cl. Howe recomauded that a second $§00.00 be appropriated from the W. Po A. account to be used for work now in progress. The Council agreed that the money was put in the account for that particular purpose and he was authorized to use it as planned. LEAVE OF ABS]~OE FOR ~glYOR:, Upon motion by Cl. Timmons, seconded by Cl. Bryant, which carried, the request of ~or Done that he be permitted to leave the state was grant ed · CLERK'S ~:. Mr. R. T. Conyers presented to the Council three of four letters signed by a n%uaber of prOperty owners which in short requested the Council to pass an ordinance increasing the salary of the City Clerk so that the clerk serving after the next general election would be able to receive such increased salary and also request- ing the Council to pay the present city clerk added compensation for his duties as pur- chasing agent or license collector. M~. Conyers informed the Council that he assumed the responsibility of drafting and circulating said letters and that he and the signers felt that the present salary paid the clerk was not cv~ensurate with his duties, nor was it in line with salaries paid by other cities nor with the e~ployees of this city. He requested that in Justice to the signers some action be taken on the matter and that the fourth petition be accepted when filed with the clerk. Mayor Done reported that the city clerk in Oceanside receives $200.00 per month and the City Treasurer receives $12§.00 per month and that they are deputies of each other but that the clerk's duties there are more responsible than they are in Chula Vista. Cl. Tinnnons reported that the clerk in Escondido receives a total of $137.§0 but that she handles the water col- lections. Cl. Timmons also related the history of the clerk' s salary in Ohula Vista and the work entailed from the time he took office in setting up an adequate set of records necessary for assessments and taxation matters. He reported that for the first year he worked practically every night to get said records in s~ape. He stated that he had been criticined considerably as being the one to have the present clerk removed from the office of deputy tax collector but that the Council and not he were the only ones that could and did approve such action. Mr. Conyers informed Cl. Ti~nous t~mt not only he but the citizens of Ohule Vista appreciated his past services but stated that the present salary paid the clerk, in his opinion and the opinion of the signers, was quite out of line with others. Cl. Bryant brought up the matter of the past discussion of keeping the salary of the City Clerk at $17§.00 per month aud the sslary of ~he Deputy at $?5.00 per month; Cl. Tt~w~ons ~nd Howe, however, stated that this discussion came up after the approval of the budget. Cl. Rowe suggested that the matter be settled at the adjourned meeting to be held December 13th so that they would have more time to consider the matter. ~ Conyers stated that he felt that it w~uld be very satisfactory if some action would be taken at that time.
