The 0ouncil met pursuant to adjournment to adjournment in the council chamber of the City Hall on the above shown dats with Mayor Dons presiding. Meeting called to order at ? o'clock P. M. Present: Mayor Done, Clean. Howe, Tin. one and Bro~. Absent: Cl. Rryant. CANVASS OF VOTE: The 0ouncil proceeded to count the absentee ballots cast for the Special Elect'ion 'b'el'd Nov. 8, 1938 and proceeded to canvass the votes cast at the eight Ohula Vista precincts for the said Speci_al~.~lection. After the coUnt and canvass were made ~1. Broom offered Resolution ,N.c.. 5.~,3., which is a resolution declaring the · result of the said election and which declares the defeat of eaCh of the three l~opositions by the following vote: Proposition No. 1. Yes: 638 No: 1156 Proposition No. 2. Yes: $41 No: 1138 Proposition No. 3. Yes: 931 No: 912 The total vote cast at said election wes 1869. The resolution was read and it set forth that all requirements of law had been had, and the election held in time, form and manner as required by law. Upon motion by01. Brown, seconded by Cl. Howe the Reso- lution was paased aud adopted as read by the following vote, to-wit: Ayes: Clmen. Brown, Done, Howe and Ttw,.ons. Noes: None; Absent: Cl. Bryant. Mayor Done suggested that inasmuch as ~. Bodmer had devoted considerable time to the drawing of the plans and specifications for buildings i'or which special election ~s held and would receive no compensation due to t he failure of their passage that the City Clerk on behalf of the City Council extend to Mm. BoOmer their sincere appreciation for the manner in which he had cooperated with the OoUncil in drawing up said plans and specificatiO~s. Upon $O. LOT~ SEWER: The City Clerk informed the Council that the Minutes did not show that Mr. George Lo~ would be entitled to a refund of the amount of the sawer assesmnent necessary for Lot 12 of Block A of La Playa Vista to buy into the sewer district when and if the owners of said lot bought in and that it was his understanding that it had been the intention of the Council in their agreement with Mr. Lott that if mhd ~en the owner of LOt 1~, Block A bought into the di strict that this assessment should be refunded to ~r. Lott inasmuch as he had paid the total cost of extending the sewer across the front of said lot. Upon motion by Cl. Brown, seconded by Cl. Tt_.w.ons, which carried, this refund was approved if and when the owner of said lot buys into the sewer dis- tri ct. ~IR-PORT: Cl. Howe suggewted that the CoUncil go to LOs Angeles and contact M~. Claut~ei~er of the Santa Fe Railway Company regarding the possibility of getting a certain air p~ns concern which is contemplating locating in Southern California, to locate in Chula Vista. Cl. Brown agreed with Cl. Howe that this contact should be madee Cl. T~wm~ns suggested that 01. Howe and Cl. Brown make said contact inasmuCh as they had had considerabl.v discussion with Mr. Clautfelter over the possibility of air port development here. Upon motion by Mayor Done, seconded by Cl. Tigons, which carried, Cl. Howe and Brown were authorized to contact ~,~r. Clautfelter at their convenience. HUNT ~ A~-~-c~IT: Upon motion by Cl. T~ons, seconded by Cl. B~wn, which carried, the request' "of 'the City 0lark that the weed charge on the Assessment l~ll against Lettie Hunt in the amount of ?$ cents be removed due to the fact that the assessment had been paid and the charge was on the roll in error, was granted. SANAT~'~ W~ ASS~: Upon motion by Cl. Broom, seconded by Cl. Howe, which ca_~ried, the clerk ~as i'~s'tructed to refund to Mrs. $. F. ~edlick the weed assessment in the amount of $4.$0 which she paid August 1, 1938 for the bur~ing of I~t ~, Block $ of Chula Vista Villa Tract No. ~-. This action was taken after careful investigation had been made of the burning of s~id lot, which disclosed that it had nOt been burned. PtrRO~ OF TAX EmmT~ FROM THE COU~£Y: The City Attorney reported that the County Tax Collector had advised him that tax 'd~e'eds from the County to the City covering cer- tain property within the Chula Vista A and I D No. 1 could now be prepared for delivery to the City; that the cost of advertising amounted to $166.17, which together with the $?4.00 consideration according to the agreement between the Board of $upervisors and the City totalled $240.17. The City Attorney requested that a wax~aut be drawn in favor of the County Assessor for such amount and that the City Attorney be authorized to pay said amount to the proper County official when deeds were delivered to him as a representative of the City in a form satisfactory to him under the terms and conditions of the ng~eement with the County. Upon motion by Cl. Brown, seconded by Cl. Howe, which carried, the above stated warrant was authorized to be made ready for payment as requested. Howe, which carried, the request of Mr. Nathan Jack of 151 Second Ave. that he be permitted to build chicken houses on the rear of his property at that address was referred to the Planning Cow,.4ssion for their recommendation. m~'~'HA ~'~2~ ~PX~,., ,Y~?: Street Cozm~ieeioner Howe reca~uended to the Council that due to the fact that the present regular street employees are ~oing to be doing -more of the city repair work and active on the proposed tree survey that two of the extra employees be kept for some time longer as they will be badly needed. The members of the Council all agreed for him to keep the two extra employees as rect-,=-~uded. 01. Howe also recon~ended that the purchase of a second hand battery charger be made to save the city the cost of charging batteries and reported of a goOd bargain that could be obtained for this purpose. The Council also agreed that this would be the wise thing to do. Cl. Howe also reported that the street employees were going to do as ~ch of the vehicle repair wor~ as possible to cut down that expense. W. ~. S. BROWNE CHICKEN HOUSE REQUEST: M~. W. $. S. Bro~ns, real estate agent. on behalf of a prospective buyer requested permission to build chicken houses on a lot on the south side of K St. between 5rd and 4th Avenues. Upon motion by Cl. Brown the City Attorney reported to the Council respecting the written ccmrplaint referred to him by the Council in which complaint the Oity Engineer alleged that 01. Ti~mlons had violated provision of Sec. 866 of Act 5255 of Deering's General Laws of the State of Cslifornia. The City Attorney reported that it was his opinion no evidence had been submitted to the Council showing violation of such secion of law either with respect to him direct or indirect benefit or any wilful violation of the provisions of such section. Upon motion by Cl. T!w..ons, seconded by Cl. Bre~n~ ,~wh~i~c.h~ carried, the claim of O. ~. Weisegerber for refund of his first installmen~ cz -~o. taxes ~inutes of Adjourned Regular I~ieeting of Nov. 14, 19~8 (Cont.) and caucellation of the second installment of 1938 taxes on the Oontention that $1.02 exceeded the State Law for general government purposes, was denied. This action was taken after Cl. Tt~m~ns explained that the amotmt of $1.02 set up for the general gove~uuent amounted to approximately 70¢, the other 32¢ being the amount that would be established for the perk and boulevard fund. I ~ST. I FOS'i'~ AEOITIONI C. V. VILL~ TRAOT NO. 3 0?t?~G: County Supervisor Roy Richards being present was que'stioned by Cl. Howe as the possibility of the city obtaining the use of necessary oiling equipment and drivers fr~m the County of San Diego for the oiling of I Street from National Avenue to B~V Blvd., and Church Avenue, Del Mar Avenue, Twin Oaks Avenue, Elm Aven~e and Alpine Avenue from J Ste to K~earney. t'~r. Richards lnfoz~aed the ~ouncil that he thoUght that the Board of Supervisors would agree to the loaning of said equlpmsnt upon request by resolution f rom the City Council and discussed with the City Attorney as to the best method to use to e~rpedite the matter of obtaining per~sslon from the Board of Supervisors. Cl. T~tn~ons offered ~solution No. 5~.4. which is a resolution requesting the Board of Supervisors to permit the use of said equipment for oiling the above named streets. The Resolution was read and was passed and adopted as read by ~e following vote, to-wit: A~ves: Cl. Brov~, Done, l~we and Tl~aons. Noes: None. Absent: Cl. Bryant. H~I'~. SIG~BOARD: Mr. B~anchard'requested permission from the City Council to erect a sign board on National Avenue advertising the E1 !~'lmero Notel. A~ the general tm.Bression was that this was against the ordinance, l~r. Blenchard was advised to see fha City Attorney and to investigate the ordinance with him to see Just what could or could not be done in this respect. ~0 .U~NE~.: Upon motion by Cl.
