The Council met in regular session in the Council Chamber of the Oity Hall on the
above sho~n date with Mayor Done presiding. Meeting celled to order at ? o'clock

U~RABLE OIX~: Mr. R. Conyers informed the Council of the bad odor comtng tO
the northerly part of Chula Vista, especially during the.vening hours, and requested
that the Council take some measure to ascertain the source of such odor and m~ke an
effort to have the same remedied. He recoz~ended that the prowl car be put on this
task when the odor is next noticed ~ud try to find the source of ssme. The City
Council agreed that the prowl car would be used as above recommended.

Upon ~ion by Gl. B~, seconded by ~or ~, ~ich c~ied, the above ~tters
~ referral to ~he 0ity Attorney.
Vl~l~m~N'S ~ION: A letter from Mrs. Anna M. I~a, widow of the late Job~ J.
Lee, was present~"to the City Council, which related that the Veteran's Exertion
had not 'been give~x to Mr. Lee for the year 1938. She stated that ~. Lee died ca
Ms~ 31st, she knew he had intended to make application for said exemption. However,
she had no receipt showing that he had done ee but felt sure that he had so she did
not make application herself. She stated that she hoped the Council would see their
way clear to allc~ this exemption. Upon motion by Cl. Howe, seconded by Cl. Brown,
which carried, the matter was referred to the City Attorney.
~£E~T OILING: A petition signed by property owners in the Foster's Addition
and in Chula Vista Villa Tract NO. 3 was presented to the Council. This petition
requested that the streets m,~ning through said Tracts be repaired and oiled. Cl.
Howe stated that he had pl.nned on having the matter taken care of in the near future
and the Council decided to leave the matter in the hauds of the Street Co-..~ssioner
to do as he had planned.
FIRE HIDRAI~I SECOND AVE. I AND ~ STS: Upon motion by Cl. Howe, seconded by
Cl. Brown, which carried, a petition signed by property owners in the vicinity of
Second Avenue from I to J Streets requesting the installation of a fire hydrant
on Second Avenue midway between Iend J Streets was referred to the Fi~e Co-.-tssioner
with pOwer to act.
~0ULDER IMPR0V~Z~ET THirD AVE. I TO Jr, A petition signed by property owmers
on Third Ave. between I and $ requesting the City Oouncil to improve the shoulders
upon said street as had been done on Third Ave. between H and Roosevelt Streets, was
presented to the Council. Cl. Howe recommended that the work be done with quarter
cent gas tax money when available, stated that he had t~he liberty to advise variOus
property owners in that vicinity that he would reco~aend such action. The Council
felt that it would be proper when the money was available to do said work and advised
the City Clerk to advise any who might m-ke inquiry to that effect.
HAZARD ~ CITY PROPERTY: The City Clerk drew the attention of the 0ouncil to the
hazard created by the large t~mbers stacked on the property recently leased ~ the
City from the Ohula Vista Gr-wm~r School District. He stated that several property owners
had cell-d his attention to the danger which said timbers might cause to sOm~ of the
school children crawling over the timbers. Upon motion by Cl. Ho.~, seconded by Cl.
Tiz~ons, which carried, the City Clerk was instructed to inform the owner, ~r. S. S.
Niokson, ~ re~m~ve said timbers.
~.-~,~NS' ~LFARE BGARD PROPERTY: A cem~aunication from the Veterans' Welfare
Board informed the Oity of the'ir acquisition of Lot 9. Block C Lu Smailes Park Sub-
division ~ud requesting the City to cancel the 19~ tax against same was presented
to the City Council. Upon motion by Cl. Tirmzons, seconded by Cl. Brown, which
carried, said tax in the amount of ~.BB was cancelled.

KII~?.T.,SUBDIVISION: The reco~uendation of the City Planning Oo~Eission
relative to the proposed subdivision of George Kimball of Lot 10 in Quarter Section
136 was read and ~r. Kimball being present objected to the 50 foot street being nec-
essary throughout the entire easterly westerly direction. After considerable dis-
cussion and upon motion by Cl. Tt-w.ons, seconded by Cl. Howe, which carried, the
proposed subdivision was accepted with changes as shown on the plat made at this meet-
lng.
TR~-~: The recommendation of the Planning 0Ommtesion that the tree deposit
of ~.~rso I~well be not returned until the planting is carried out as rec~-.ended by
the Planning Cow--lesion and approved by the City Council and their recow.n-ndation
that the City Council take steps to have the palm trace removed which were recently
planted on the Moeser property and be replaced with acacias to conform to the rest
of the street were concurred in by the City Council upon motion by Cl. Howe, seconded
by Cl. Brown.
,S~A' ~JI~ENT: Cl. Howe recommended that inasmuch as ~'. Love would be
asS,,,.~ug increased responsibilities due to the resignation of ~. Weissgerber that
his salax.y be increased to $130.00 per month effective Dec. 1, 1938. Upon motion
by 01. Bro~m, seconded by Cl. Tin,nons, which carried, the above reccEmendation was
approved.
CITY PORCI~S,~ING: Upon motion by 01. Howe, seconded by Cl. Brown, which carried,
the City l~rehasing Agent was authorized to use his discretion on matters of purchases
for auto work and t~re and tube business so that more equal distribution can be made but
to keep to the schedule of business as has been established..
f~SSESS~IIT OF HOWE EST~iTE: Cl. Howe in the c~acity of executor of the estate of
Thomas Howe presented a letter to the Council protesting the assessment of Tract A and
Tract B of Howe Subdivision and showed the valuation last year and a higher valuation
this year. He stated that he did not feel that the increase was quite Justified con-
sidering the value of property in that vicinity. The assessment roll having been
adopted by the City Council while sitting as a Hoard of Equalization in August it
not be changed. However, the Assessor informed ~. HOwe that he would make a thorough
investigation of the increased valuation put on same and if his findings showed that the
valuation as established was out of line he would m.ke proper correction.
PERIODIOAL REPORTS: The monthly reports of the City tudge, the Police Department
and the Fire Department for the month of October, 193~ and the monthly report of the
City Treasurer for September 193S a~d the annual report of the Auditor for the fiscal
year ending ~une 30, 1938, were e~c.m~ned and ordered filed.
DOG POND WAT~: Chief Ifelly informed the Council that M~. Rice of the Water
Company recommended to him that some member of the Council should contact him regarding
water installation to the dog pond. Police Commissioner Bryant informed the Council
that he would contact ~r. Rice regarding sene.
TRE~,.~ IN PARK: 01. H~we recommended that pepper and eucalyptus trees be planted
on the northerly line of the new city park to eltm~te the unsightly buildings to the
North. ~e stated that he thought the cost to the City of said pl~uting would be very
nominal and the Council agreed that if the trees could be obtained at a reasonable
cost that the work should be done.
