The Council met pursuant to adjournment in the Council Oh~bar of the City
Hall on the above shown date with ~s~or Done presiding. The meeting was called
to order at 7 o'clock P. M. Present: Mmyor Done, CounciLmen Howe, Tiw.~ons and
Bryant. Absent: Cl. Brown.
0RDIN~kNCE NO. 2?5: Upon motion by Cl. Bryant, seconded by Cl. Howe, which
carrie~, Ordinance No. 275 was placed on its first reading. The ordinance was read
in full. This is a~ ordinance establishing boulevard stOps on Second Avenue at
the intersections of "I'% "K" and "L" Streets.
WOM~'S CLUB FLOV;ER SHQ~4: The Chula Vista ~;om-n's Club by letter informed the
Council that they are planning to have their annual flmver show in Mmy, 1939 and
requested their usual contribution of $75.00 to assist in putting on said show.
Inasmuch as this amount had been appropriated in the Budget for said purpose,
the clerk was instructed to so infOrm the Secretary.
RLqE~STEIN SUBDIVISION: The clerk read a 2attar from the City Planning Com-
mission which ~ec~ended the adoption of a new plan for the subdivision of the
East half of Lot 9 in Quarter section 138, in lieu of the plan ~pproved at the
meeting of September 6, 1938, this change being necessary by the fact that F H A
approval for financing could not be obtained on the original plsm. Cl. Tt~mnons
pointed out the need of proper drainage for said tract and the City Engineer
recommended that side-waLks ~ud curbs be put in at the proper le~els i~ the
street in the center of said tract and upon motion by Cl. Tlmmons, seconded by
Cl. H~we, which carried, the new plan was accepted with the provision that 6 ft.
combination side-walk and curbs be put in at proper levels in the street in the
center of s~ tract.
GEORGE LOTT SEWER;, Mr. George Lott came before the Council to discuss ways
and ~eans of having the sewer district extended to his property, corner of 0~is
and National. The City Engineer informed I~r. Lott that the said extension would
cost approximately One Thousand Dollars ~ud that the most feasible method would
be for the City to have complete charge of the installation but that laborers
on the Job could be mainly selected by Mr. Lott to work out bills due him~
Should any part of the thousand dollars not be used said amount would be refunded
to Mr. Lott at the completion of the Job and should it require more than the said
one thousand dollars l~'m. Lott would have to pay s~me. ~. Lott informed the City
Engineer that he would put up said deposit with the City Clerk around the 27th
of this month so the work could be started soon.
~IESTA PAGEANT: The City Attorney advised the Council ~o authorize the Mayor
to execute a le~s'e' for a period of several days for the sum of One Dollar ($1.00)
to the Ohula Vista Wo~-n's Club for the use of the city park on Second Avenue
South of "C" Street for the purpose of holding the Fiesta Pageant. The said lease
to have necessary insurance protecting the City during the term of the lease.
The Council agreed this would be the best method to be used to protect the Oity
from any liability which might come up.
COMPI~II~TS: At a meeting of this Council several months ago the matter of
issuing complaints was discussed and it was decided by the 0ouncil, upon recoman-
dation of the City Attorney, that the City Attorney be consulted before the issuance
of complaints, except motor vehicle violations end minor co~rplaints on which it
was felt his advice was not needed. However, the City Judge has hesitated to
issue complaints over minor violations without first consulting the City Attorney
and as he is not always available it has caused delay and inconvenience. The
City Attorney advised that the Judge be allowed to draw up complaints on all cases,
but that he consult the City Attorney when he felt it necessary. Chief If~lly re-
co~nended that consultation of the City Attorney be required on complaints citizen~
requested to be issued. The City Council agreed that this was the intention of
their action taken at the previous meeting.
