The Council met in regular session in the Council 0hamber of the City Hall on the
above shown date with Mayor Done presiding, ldeeting called to order at ? o'clock
P.M. Present: All members.

NEW S%IB-DIVISION APPROVAL: Mr. l~Abanstein presented a map of a proposed sub-
division of the East h~lf of Lot 9, Qmarter Section 1~8, for the tentative approval
of the Oity Council. The City Clerk read a letter frc~a the City Pl.nning
which recow..ended the approval of said map with the provisO that 50 foot streets be
considered, one-half of which is to be taken off of the above property, on the con-
dition that side-w-l~ and curb be combined in a width not less then 6 ft. allowing
1 foot for public utility right-of-way inside the side-walk line; provided further
that an 8 ft. easement be granted, together with a circular plot which is to be
public property. Mr. l~Abea~tein informed the Council that he intended to have
this property recorded as a subdivision but wished to have the approval of the
Council before official application. Upon motion by Cl. Brown, seconded by
Howe, which carried, the recomendation of the City Planning Co-..~ssion was con-
curred in.
~ ASSES~M~IT: Mr. ~. C~mp. bell, Attorney for Charles Bresee, informed the
Council that he was going to bring action to clear the preperty of Bresee of the
side-walk, curb and gutter assess~ent which had been erroneously reported by the
City Clerk to the Union Title Comp~uy as being clear of said assessment. He
stated that the owner of the bond, Mr. Haas, was very unreasonable to deal with
smd that it might be necessary to bring action to have the said assessment paid
end that in this case the City and/or the City Clerk might be liable ~ud if so,
he suggested that some sor~ of compromise be made. Upon motion by 01. Brc~n,
seconded by Cl. Ttmmons, the matter was referred to the City Attorney.
SAN DIEGO UNION f~,,~VERTISING: The City Clerk read a letter from Mr. S. O. Rose
of the Union-Tribune informing the 0ouncil of the ?0th Auniversary Edition to be
published this Fall and requesting the Council to appropriate $100 toward the
cost of a full page advertisement of Chula Vista in the special edition. Mr.
Walters of the Union-Tribune spoke in his behalf but was informed by the Coundil
that inam~uch as there had been no money appropriated for said advertising it w~s
imt~ossible to make any such appropriation this year.
~ LOTT SEWER: The City Engineer informed the Council that George Lott
wish~s to have the s~wer extended to his Lots 1, 2, 3 and 4, Block B of La ~aya
Vista and inasmuch as these lots are some 210 feet from the present sewer main,
Mr. Loft has agreed to pay for the necessary pipe and material and to furnish
necessary labor to install same to his property. The question of the City's
liability in case of accident to his men or in case of accident to motorists on
the high-way who might have an accident through negligence on the part of the
workers was brought up~ The City Attorney advised that proper liability insurance
could and should be obtained. The Council wishing to allow Mr. Lott to come into
the district, upon motion by Cl. Brown, seconded by Cl. Done, which carried, in-
structed the City Attorney and the City Engineer to prepare the necessary resolution
and have same ready for the next meeting.
ORANGE aVE. IMPROV~NT: $~. R~y Warren and Mr. August Winks, property owners
on Orange Ave., urged the '~ouncil to grade the North half of Orange Avenue from
National to Woodlawn and to oil the full street after it had been graded. Mr.
Warren stated that considerable traffic is diverted over this street due to the fact
that D and Chula Vista Ave. have light paving and c~uot bear heavy truck traffic.
The City Engineer reported that he would be able to get to the said grading possibly
the latter part of this month but in no case later than 30 days ~nd that he and
Cl. Howe were working on a street oiling program and would have same ready for the
Council's consideration at a future meeting.

O, RDII~CE NO. 27t: Upon motion by Cl. Brown, seconded by Cl. Ttmmons, which
carried unanimously, Ordinance ,No,. ,27t was placed on its first reading. The ~din-
anco was read in full. This is an ordinance culling and providing for and giving
notice of a special election to be held on Tuesday, the a?th day of September, 19~$,
for the purpose of submitting to the qualified voters propositions to incur bonded
indebtedness for certain municipal irmprovements. Clo Howe objected to the 5%
mum rate of interest as being too high as he felt that it would hurt the credit of
the City. However, the other councilmen pointed out that this was the ~f~mim rate
and that the prospects of receiving ~r} to t% interest rate were very good.
~I.~.~Tf I~.~ROVI~, ,fl~T: ~ petition signed by property Owners adjacent to the alley
· .~ning from Davidson to F St. and between Third Ave. and Church Ave. was presented
to the Council. Said petition requested that the said alley be graded and oiled
as the drainage was very poor and during heavy storms water runs into the buildings.
Cl. Howe recommended that the alley be graded but that no alley should be oiled until
unoiled streets had been oiled. Upon motion by Cl. Brown, seconded by Cl. Tt~w~ens,
which carried, the petition was referred to the City Engineer and Street Commtesioner
ORDII~J~CE NO. ~-?$,: Upon motion by Cl. Bryant, seconded by Cl. Bro~, which
carried, 0rdi~a~o® No, ~?~ was placed on its second and final reading. ~he ordinance
was read in full, wes in the exact form as given at its first reading at the ~aeeting
of this Council held August 8, 19~8. It was passed, adopted and apprOved as read
by the following vote, to-wit: Ayes: Clmen. Timmons, Brown, Bryant, Done and Howe.
Noes: None. Absent: None.
Wi~ECR'MCG ¥~aRD: Upon motion by Cl. Brown, seconded by Cl. Bryant, which carried,
the recommendation of the City Planning Commission that the City Attorney msWe an
addenda to the Zoning O~dinance to cover wrecking yards was approved.
~ GAS Tflx ACCU'~JI~TION: A Memorandum of Agreement between the City of Chula
Vista and the Department of Public Works authorizing the accumulation of the ~ gas
tax for streets of major lmportanas for the~fiscal year ending ~une 30, 1959 was
read. Cl. Brown offered Resolution No. 5aO, which is a resolution approving the
said I,~iemorandum of Agreement. The resolution was read and was passed -~a adopted
as read by the following vote, to-wit: Ayes: Clmen. Brown, Bryant, Done, Howe and
Tlmmons. Noes: None. Ab sent: None.
TREE SUR~: The City Engineer reported that while the W-PA Application for the
tree survey had been approved he had been notified tibet due to lack of men qualified
for said work the project would have to be held up until qualified men ware available.
N Y, A PROJ~,~CT: The City Engineer reported that the proper officials had
approved the transfer of the N Y A Project from the Sunior High School grounds to the
new City Park and that the City's contribution would consist mainly of water and seed
bills and he requested the Council's approval of the expenditure of money in the
t~PA account for expenses which might be incurred through this project. The Council
stated that th.ey had intended the money set up in the WPA account to be used for
px~Jeo~°~$ City ~a supported by I~PA, N Y A, etc. and they did not intend to
have it confined to the IfPA exclusively. The City Engineer outlined the need of ex-
tending the culvert further to the West and the land-soaping to be done around the
proposed recreational courts.
~ ASSESS~IENT: Upon recc~uendation of the City Engineer and upon motion
by Cl. Howe, seconded by Cl. Bryant, which carried, the 1958 Weed Assessment against
Mr. George Kimball on Lot l0 Q~arter Section 136 was cancelled.
~T,:STA PJ~GEANT: Cl. Howe reported that the Fiesta Co~mzittee had requested per-
mission tO use the city park West of Highland Avenue, South of C Street to hold their
pageant for this coming Fiesta with the intention of placing bleachers e~ound the
sides of the hill and placing a platform at the base of the hill. The Street De-
partment would be required to spend about one day grading the road from C Street to
the location of the platform. The City Attorney advised that evidence of the execu-
tion of insurance to cover the City be obtained before permit be granted and upon
motion by Cl. Howe, seconded by Cl. Bryant, which carried, the City Attorney was
instructed to obtain said evidence of execution of inSurance to cover the City before
the permit be granted and the Street Department was instrUcted to grade the roadway
from C Street to said location of s~age.
