REGULAR MEETING OF THE CHARTER REVIEW COMMISSION

Public Comments: Public comments may be submitted to the Charter Review Commission in the
following ways:
In-Person comments during the meeting. Join us for the Charter Review Commission
meeting at the time and location specified on this agenda to make your comments. Please
visit www.chulavistaca.gov/boardmeetings for current mask requirements and other safety
protocols.

Submit an eComment. Visit www.chulavistaca.gov/boardmeetings, locate this meeting,
and click on the comment bubble icon. Click on the item you wish to comment on, and
then click on "Leave Comment." The commenting period will close one hour before the
meeting. All comments will be made available to the Commission and the public.

The Commission will enact the Consent Calendar recommendation by one
motion, without discussion, unless a Commission Member, a member of the
public, or staff request that an item be removed for discussion. If you wish to
speak on one of these items, please fill out a "Request to Speak" form and
submit it to the Secretary prior to the meeting. Items pulled from the Consent
Calendar will be discussed immediately following the Consent Calendar.

Recommended Action:
Review minutes and consider for approval.

Persons may address the Commission on any subject matter within the
Commission’s jurisdiction that is not listed as an item on the agenda. State law
generally prohibits the Commission from discussing or taking action on any
issue not included on the agenda, but, if appropriate, the Commission may
schedule the topic for future discussion or refer the matter to staff. If you wish to

5.1 Selection of Chair and Vice Chair for Fiscal Year 2023-2024
Recommended Action:
Nominate and elect Chair for Fiscal Year 2023-2024.

5.2 Discussion and Action to Appoint A Charter Review Commission Member
and Alternate Charter Review Commission Member to Serve on an
Interview Panel for Current and Upcoming Vacancies on the Board of
Ethics
Pursuant to Chula Vista Municipal Code Section 2.28.050(A), the Charter
Review Commission will appoint one Charter Review Commission
Member to assist in reviewing Board of Ethics member applications,
interviewing selected applicants, and recommending to the City Council
one applicant for each available seat on the Board of Ethics.
Recommended Action:
Appoint Charter Review Commission member and alternate Charter
Review Commission member.
5.3 Discussion of a Qualifications and Vetting Process for Elected Officials
Vacancies
Discussion of a potential qualifications and vetting process for
appointments to fill elected official vacancies.
Recommended Action:
Commission discuss the issue and take action as appropriate.
5.4 Presentation and Discussion Regarding Rank Choice Voting in Other
Jurisdictions
Commissioners present and discuss examples of the rank choice voting
processes and outcomes in other states and cities.
Recommended Action:
Commission discuss the information presented and take action as
appropriate.
5.5 Presentation Regarding the Nature of Council District Representation
Presentation by commission members regarding their research into the
nature of council district representation in jurisdictions that have full-time
City Council members.
Recommended Action:
Commission discuss the information presented and take action as
appropriate.

1. CALL TO ORDER
A regular meeting of the Charter Review Commission of the City of Chula Vista
was called to order at 6:01 p.m.

5. PUBLIC COMMENTS
Public Comment: Delia Dominguez-Cervantes, Chula Vista, emailed proposed
changes in support of tightening the appointment process for filling vacancies for
elected officials.
Public Comment: John Moot, Chula Vista, spoke in support of changes to the
Chula Vista Charter specifically to the powers of the Ethics Commission and
changes to municipal code enforcement.
6. ACTION ITEMS
6.1 Presentation Regarding Special Election and Appointment Options
to Fill Elected Office Vacancies
City Clerk Kerry Bigelow provided a presentation.
Public Comment: Cheryl Perez, Chula Vista, expressed her concern
regarding our current appointment process.
There was a consensus of the Commissioners to agendize an item for the
next Commission meeting to discuss a vetting process for elected official
appointments.

6.2 Report on Presentation to City Council Regarding Ranked Choice
Voting Concept
Vice Chair Buddingh presented feedback received from City Council
regarding the Rank Choice Voting Concept.
There was consensus of the Commission to agendize an item for the next
Commission meeting to discuss ranked choice voting in other jurisdictions.
Commissioners agreed to bring examples of other states and cities that
have adopted Ranked Choice Voting Concept.
6.3 Consideration of Changes to the Commission's Regular Meeting
Frequency
Motion to change the schedule of regular monthly meetings to quarterly
meetings starting August 9, 2023.
Moved by Commissioner Inzunza
Seconded by Commissioner Hopida
Motion passed.
Resolution No. CRC2023-001 was signed on July 12, 2023 to change the
schedule of regular monthly meetings to quarterly meetings starting
August 9, 2023.

6.4 Consideration of Proposed Annual Report for FY2022-23 on Charter
Review Commission Activities
There was consensus of the Commission to send the FY2022-23 Charter
Review Annual Report, with minor modifications as necessary by Chair
Scofield to City Council.
6.5 Presentation Regarding the Nature of Council District Representation
There was consensus of the Council to move this item to the next
Commission meeting.

Could you also submit this as public comment for the upcoming Charter Review as well and
that I have requested it be added to the Ethics Commission agenda as a public comment as well
.
“Currently the Ethics Commission does not have Charter status. Section 504 of the Charter
provides for an Office of Legislative Council to give advice to the Board of Ethics, but its duties
are not defined and subject to being added by ordinance . The Ethics Commission like the
Planning Commission , Civil Service Commission and Parks and Recreation Commission
should have an independent function with defined responsibilities and powers in the Charter
including the power to retain independent counsel with subpoena power . I am recommending
the Charter Review Commission and the Ethics Commission have a joint meeting to discuss
such a Charter Amendment and the Current Campaign Ordinance under the Ethics Commission
jurisdiction to address changes to Charter and Campaign Ordinance to better address
how ethics complaints are investigated and reported out to the public.”
