Brown, seconded by Cl. NOwe, which carried, the racom-e-darien of the 0ity Planning C~-:ssion that Mr. George M. Eex~h be granted per- mission to remove a small stu~ed pepper tree from the park~ in front of his home at 485 E Street and to replace with two pepper trees was approvede .TREE ~A'A'~G: The P1-_n~ing Commission at their last meeting of 2uly 1Bth commended that~ 1~. P. A. help be secured to assist in watering and taking care of the palm trees on Third Avsaue. After considerable discussion by the City Council and the City Engineer it wqe decided that the City Eagineer would see that the trees were properly watered -nd kept up. ~g~N~CI~..A~, BLDGS. AND ,REC~EATI, 0~ ~,~.~: Mr. Bodmer presented redraf~ed plans of proposed municipal buildings and recreatiamal center which included the following: A city hall, ccm~bined police .r~t fire depax'tme~t building, graxld stand for ball pe~k, a pool, tennis, quoit, shufflehonm, d and horse shoe coua. te. He proposed that of the to, al $104,415.15 should be done through p 1~ A and the $5,000 balance should be done through W. P. A~ with a total cost to the City of $59.2~8.35. He stressed the ~ortanoe of having the tentative plans euBzxitted at the earliest possible ti~ae as Septemxher let is the last date for receiving applications. Cl. N~we stated that he did not feel that the tax payere of Chula Vista would or could support such a heavy bond issue inasmuch aa they are at the preeent t~w~ paying off a large ~unt of school bonds and pavi~g bonds and that the initial bond issue would not be the ~ increased expense. Mr. Bo~m-r had elected to re- draft the origi.al to the present plan~ for which the Council had informally given hi~ the privilege of dx~pping the matter for the estimated cost of the election or of the above said redraf~ inasmuch as they felt the original plans had very ~.-]1 cha~e of being approved By the tax payers. He, however, requested the Council to officially approve the redrmf~ed plan~ as submitted. Upon ~tion by Cl. Brown, seconded by Cl. T~wm~as, which carried with Cl. Eowe voting "No" Mr. Bodmer was instructed to prepare the necessary application based upon the plans as submitted at this meeting amd have said application mailed By August 12th. The City Attorney assured Mr. Bodmer that he wo~ld cooperate with him to the fullest extent in having the necessary information available. I~ ,~XNG ~-~m~.~a~e~T FO~ 19~8-3~: 01. Brown offered Besolutio~. ,~;o. 5~§, which is a resolution adopting the report of the City Engineer requesting that the lighting assee.~nents for the 1958-$9 fiscal yea~ be the s~ne as of the 19~6-~7 fiscal yea~ and directing the City Assessor to levy said aases~.~uts accordingly. F~IOD~CAL RE!~0RTS: The ---ual report of the City Library Board for the past fiscal year and the monthly reports of the City ~udge and the Police and Fire Departments for the month of tuly and the report of the City Treasurer for the months of ~ttue and Yuly were e~-mtued and ordered filed. ,~, ,,AL ¥0U~, AI~,~I,,ST~A, TI~: Cl. ttowe recozauended that the City Council approve the request of the National Youth Administration and allow them to use a portion of the new City Park for the pleating and g~owimg of shrubbery as a large share of that groom could be use~ f for the beautification of the City Park and as the project was a very worth~ one. The only cost to the city would be for seeds and this would be a very small amount. Upon motion by Gl. Brown, seconded by Cl. Bryant, which carried, the above recc~maondation was approved. ~lnutes of a Regular Meeting of the City Council, Held A~gust 1, 1935 T~ AVenUE S~x~ Mayor Done reported that he had received a cc~plaint from a member of tho F~adericka H~ae regarding the new side w~lV on the East side of ~hird Ave. between E .n~ Davidson 8treats as the drive-ways cut into the side walk did not leave sufficient room for pedestrians to walk along said side walks with safety especially after sun-down. He reported that he had taken the matter up with ~A~s. Sailor prior to said con~laint and that appro~mtely 3 feet of level ~ide walk was available for pedes- trians. It was decided that nothing could be done about the matter. MA~20~ S~TI~NT l~q: The City Attorney reported that the Board of Super- visors had accepted the Sales Agreement as submitted by the City for the purchase of tax deeded lends in the Matt.on District in Chula Vista. This, however, is subject to approval by the ~tate Cont~oller R.~ should it be approved by hi~ the matter of tax relief on linquent property, on that five years delinquent and more than five years delinquent, would have to be worked out. At this time Mr. Eugene Adrian questioned the fairness of allowing relief to those property owners who were mOre than five years delinquent a~d not allowing relief to those property owners who were less than five years delinquent. He felt that it was placing a penalty against those property owners who had attempted to assist the City of Chula Vista by paying their taxes to tho City rather tha~ having them go delinquent at earlier years. The City Attorney explained that recent legislation permitted relief if given as above stated but that it did not permit relief to be given those who were not delinquent for the five year period. However, the fact that the dis- trict would be settled en~ the property put back on a salable, taxable basis would be to the ult~_~te benefit of all concerned ~nd that property not situated in the Mattoc~ Districts were in reality being discriminated against by having to carry the burden of taxation not only for thc.selves but for those properties located i~ said Matt.on districts and in his estimation this was the most feasible method of settling the district and that the final approval would be up to the Board of ~upervisors. Mr. Ad~ian stated that he felt that tho Matt.on settle- merit w~s being held up so that relief could be given prOperty Owners as above stated and that he had been informed that the settl~nt could have been closed at a much earlier date under different methods. The City Attorney roquested to have that p~rticular state- ment recorded in the Minutes,which is as follews~ ~Mr. Adrian muds the state, cut that he had been informed by a party who had been informed by the District Attorney that the Matt.on District of Chula Vista deft-!tel~v should be cleaned up with~, thirty end sixty days fx~ea tuly let and with this party's pex~isaion he will reveal hie name; also he said that Mr. X~ infoxuaed him that the Matt.on District could be cleaned up within sixty days from the early pert of June.' ~. Adrian stated that he was not definitely convinced that this was the Case but that was the i~reeelon he was under ~ he had come to this meeting so that he could question the means and methods and try to learn the circumstances so that he would be able to draw more definite conclusions. Mr. Ad~ian questioned the City Attorney as to whether other Eattoon districts in the O~unty have used tax relief methods in settling tHeir dis- tricts. The City Attorney informed him that that was not the casa in all the other districts but in those districts where it had not been used the property o~mers had raised the amount of cash required by the bond holders over and above that amount as set up by the 0ounty end in the ease of tho Chula Vista District the property owners were not being called upon to raise a cent. The City Attorney thanked Mr. Adrian for bring- Lug to light the fact that rub. rs ware being circulated to the effect that he was purposely holding up the Matt.on settlement.se that he could explain the methods that he has used and so that the Council could decide whether or not the method ha had proposed was best or not · BW~-q PA~D: Upon motion by Cl.
