The Council met in special session, in the usual place of holding meetings,
in the City Hall, on the above shown date, with Mayor Done presiding. Neetlng called
to order at 9:00 o'clock A. M. l~esent: Ail members. This meeting was held in
compliance with a call fOr a special meeting, issued by the Mayor, which is as follows:

"You and each of you is hereby notified that a Special Meeting of the
City Council of the City of Chula Vista, California, is called to meet in
the usual place of meeting in the City Hall, in the City of Chula Vista,
California, at 9:00 o'clock A. M., Monday May 23, 1938.

Bo.I~, "Letter of Retainer": Cl. Brown introduced I~r. H. Louis Bodmer to the
members of the Council and Mayor Done informed the council that ~. Bodmer, a licensed
architect of San Diego, had offered to draw up the necessary plans and specifications
for proposed buildings ~nd improvements to be built in the city perk and on the proper-
ty recently leased from the Ohula Vista G~.mm~ School District for submittal to the
proper PWA officials for their acceptance, with the condition that should the PWA
accept a loan or loan grant application fro~ the City of Ohula Vista and should the
citizens elect to vote the necessary monies that 1~. Bodmer be retained as architect
and supervisor for the said improvement at a commission of 6~ for that s~a~e of the
work for which he draws the said plans and specifications. Mr. Bodmer informed
the Council that this 6% would take care ef all the expenses incurred by him in the
drafting of the necessary plans and specificationm and the supervision of the work
pe~taining thereto but ~euld not include any expense incurred should it be necessary
for him to m~ke out of tow trips relative to the said project. Cl. Howe protested
the agreement, of the City for any expense other than the 6% co~maission. As it was
e~plained that the probability was very small as to Mr. Bodmer having to leave the
city in respect to said project, the City Attorney informed the Council that the 6%
coEEission was a very fair figure as in most cases a figure of 8~ was charged.
L~. Bodmer explained to the Council that no one at the present time knows exactly
what type of loan may be procured through the pending legislation but that he was under
the im~ression that a 50 year loan would be obtainable and in a~l probability the
sponsors would have to p~y §~% of said loan and the other 45% would be in the nature
of a grant. Just ;~at interest rate would be charged no one at present knows.
D~. Bodmer requested that the City Council designate him as architect by giving him
a "Letter of Retainer" so that he could cO~nence the drafting of the preliminary
plans and specifications and get the application under way°
The City Clerk read to the Council a letter from ~Ir. Bocl~er which listed a number
of na~es from whom references could be had regarding the qualifications of Mr. Bodmer.
The members of the City Council all felt that now was the time to really get this
application under way and upon motion by Cl. Timmons, seconded by Cl. Brown, which
carried unanimously, the following was approved: That a letter be transmitted from

Bodmer that the city has, aud it does hereby, accept his offer to render all necessary
architectural services required by the city in connection with the City's application to
the PWA for funds for buildings and improvements on the City's perk playground, end for
m~uicipal building sites, consisting of swimming pool, buildings and accessories thereto,
cit~ hall, police staion, fire station and street department building; such architectural
services to be rendered the city without auy cost to the city unless and u~til such
PWA application has been accepted, the agreement ~etweem the PlA ax~ the ~ity executed,
and the contract or contracts for the perfor~qnce of work in accordance with such agreement
made; that then and thereupon for such architectural services, together with necessary
architectural supervision during the contract period, the city to pay the said architect
a sum equivalent to 6~ of the accepted contract bid or bids concerning buildings and
improvements for which the said architect had rendered such services; provided, that
such contract of employment shall be executed in writing and in a form satisfactory
to and approved by the City and said architect; the City to be in no way liable to said
architect until execution of said contast with him° It was decided that one application
was to cover the entire project under PWA.
The City Attorney suggested that inasmuch as tentative plans had been forwarded to
~,~r. Godwin, that he and the City E~gineer be instructed to ascertain just what procedure
to follow now so that nothing ~uld dela~ the application, which is to include plans
and specifications as drafted by ~o Bodmer,and upon motion by Cl. Brown, seconded by
~yor Done, the above recormuendation was approved.
~r. Bodmer expressed his appreciation to the Council for their confidence sho~ in
him and for their authorization of the Letter of Retainers
