OF CHUIJ~ VISTA, C~J~IFORNIA, HELD MAY 17, 1938.
The Council met pursuant to adjournment in the O~ncil Chamber of the City Hall on
the above shown d~te with Mayor Done presiding. Meeting was called to order at 7:00
o'clock P. M. Present: Mayor Done, Councilmen Howe, Brown and Bryant. Absent:
Councilman Timmons.
TREE REQUESTS: Upon reco~mmendation of the City Planning Comission the request
of Elwyn Hatz for permission to remove three d~ palms from in front of his resi-
dence at 832 Third Ave. and to replace with two Cocos Plumosas was granted.
The Council concurred in th~ recommendation of the City Plan-
ning C~tssion that the request of Mrs. Eitzen for the removal of four olive trees
in front of her residence at 138 Third Ave. be tabled until the recomendation of
the contemplated tree sUrvey is received.
The Council approved the reco~endation of the City Planning
Commission in regard to the request of Mr. Chase, Principal of the Sunior High
School, that they be allowed to remove the Westerly tree on the SouI~ side of G St.
at this time and that the other two trees, one on G and one on let. Ave., be left
in until such time as the pepper trees they are now planting have grown so that
the removal of the other trees would not be so noticeable.
The Council approved the recon~nendation of the City Planning
Commission regarding the request of Mr. S. P. I'&~rch of 237 Church Ave. that should
trees be planted in front of his residence that they should be Black Acacias and
not 0ceos Plumosas as requested inasmuch as the other trees on this particular
street are Black Acacias.
TWO HO,UR, ,,PAREI~..G: ~r. Neil Skinner and Mr. B. Ross, representatives of the
Chula Vista Merchants' Association, informed the Council that the said Association
in trying to work out ways ~ud means of making more available parking space for
customers had passed a motion to request the City Council to have the two hour park-
ing ordinance enforced and to see if it were possible for the Council to pass an
ordinance eliminating some of the Red Zones in the business district to ~-~e more
parking space. They inquired if it were possible for the Coun%~s~e~S anything
in r~gard to having the employers and employees of the differe~nt%~8~se~ park their
cars off the main street. As not all of the merchants belong to the said Associa-
tion it was imDossible for them to get the whole-hearted support of all the merchants
in this respect. Chief Kelly pointed out in detail the hazard of eliminating any
of the present red zones and the Council felt that they should be left as they are
rather than to eliminate a portion at the possible risk of a serious accident.
Cl. Bryant stated that in his opinion a friendly suggestion to the various employers
and employees of those concerns who are not members of the Association ~uld bring
the desired results and stated that he and Chief K~lly would contact the various
employers and employees and urge them to assist in this campaign to create more
available parking space.
YAW~ ROAD: Mr. Yawger by letter informed the City Council of the proposed
subdivision of his § acre lot on 6th Ave. and It St. v~lth the implication that the
0~y accept the Easterly part of the Northerly 30 ft. of his property and that the
60 ft. strip crossing the Westerly part be accepted by the City for street purposes.
He pointed out that he had sold two lots on the Northerly part of this tract and at
the present time two new residences were built there. He submitted a sketch of the
proposed subdivision and pictures of the two homes referred to. The City Planning
Commission, while approving the proposed development, hesitated to recommend the
acceptance of the street by the City Council. The City Engineer expressed his
opinion that inasmuch as the grade of the street along the Northerly part of the
said lot is high it would need a retaining wall and guard rail to offer proper pro-
tection, especially as it would be only a 30 ft. street, and also recommended that
the necessary culverts be installed before acceptance is considered. Upon motion by
Cl. Howe, seconded by Cl. Brown, which carried, the City Engineer was instructed to
see Mr. Yawger and i~form him that a retaining wall, necessary barricades and cul-
verts would have to be installed before the stress could be accepted by the City.
P ,LANIIING C0~E~ISSI. O.N CLEP~.: Upon motion by Cl. Brown, seconded by Cl. Howe,
which carried, the action of the City Planning Commission in employing Miss Betty
Bethge as clerk for said Commission at a salary of $2.$0 a meeting and that her
employment be retroactive to the meeting of April 18th was approved.
P. W. A. TREE SURVEY: The City Engineer presented to the Council proJect~?~
applications 'for a fi'e'~d survey and complete census of the shade trees in the ~ity
of Chula Vista, said survey to determine the species, size, condition and exact
location of all trees in city streets and to plot their location on maps with
appropriate notations; the ~. P. A. to assume the entire cost of said project.

The City Pl~Bning 0onw.~ssion having been informed by Mr. Weissgerber that this said
project would be submitted tonight recormuended that it be accepted° Upon motion by
Clo Brown, seconded by Cl. Bryant, which carried, the Mayor and the City Cler$~were
instructed to fill out the necessary blanks.
WOMAN'S CLUB PALM TR~q: The Chula Vista Wo~-n's Club by letter congratulated
the City Council on the work in improving the new park and development of the new
street and offered to donate to the City ten (10) palm trees nOw growing in front of
the Club House. providing the city would remove them and rearrange one of the three
remaining palms. Upon motion by Cl. Brown, seconded by Cl. Bryant, which carried,
the City Engineer and the Street Department were instructed to make arrangements for
the said removal and to contact Mrs. Frank Dupree in regard to the rearrangement.
ORDINANCE ,NO. 271,: Upon motion by Cl. Brown, seconded by Clo Bryant, which
carried, Ordinance No. 2~1 was placed on its second and final reading. The ordinance
was read in full and was in the exact form as given at its first reading at the
meeting of this council held May 2, 1938. It was passed, adopted and approved as
read by the following vote, to-wit: AYES: Councilmen Howe, Brown, Bryant and Done;
NOES: None; ABSENT: Councilman T~n~ons.
COUNTY TAX D~.:~D LANDS: Cl. Bryant offered Resolution No. 518 and the City
Attorney explained that said resolution authorized the City to maWe an offer to the
Board of Supervisors of the 0ounty of San Diego to acquire by purchase all the right,
title and interest of the State of California to the parcels of property in the City
9f Chula Vista which are delinquent prior to 1932 for $1.00 per parcel and authorized
the Ms, or to execute the Sales Agreement to effect said purchase on behalf of the
said City and instructs the City Attorney to submit said proposal to purchase, to-
gether with the said form of Sales Agreement, to the Board of Supervisors for their
consideration. The City Attorney further e~plained that this was a necessary step in
the program of clearing the Mattoon property in Chula Vista. The resolution was
read and was passed and adopted as read by the following vote, to-wit: AYES:

PR~P~,~,, t~ ~ A l~:'A'he City Olerk presented to the Council applications
received fr~ 'P. W. A. Headquarters at San Francisco as a result of the tentatiVe
application made at the last meeting. However, these applications specified that
the sponsor was to ps~ 55% Of the total cost of the project. The City E~gineer
informed the Council that an interested party had informed him that he was under the
impression that soon 100% lo-~a or grants would be made and that Mr. Kaspar, District
Representative of the P W A, would keep in touch with him in regard to the said 100%
project, should it materialize. It was decided to do nothing until further word was
receiVed from Mr. Kaspar.
TAX ORDINANCE REVISIC$1: The City Attorney informed the Council that the
LeagUe of Municipalities, after having been requested by so ~ny Mauicipalities in
the State for a model tax ordinance, had devoted much ti~ and had employed tax
specialists to assist in drafting a more up to date tax ordinauce but not being able
to recognize fully the sitUations as they exist in the various Sixth Class Cities
have decided to have a meeting of representatives of as many of the cities as
possible some time soon in Los Angeles. The City Attorney advised that inasmuch
as the City Clerk's duties bring him into more direct touch with these problems
and aS he, the City Attorney, was f~r. tliar with the present tax ordinance and the
difficulties that exist, it might be wise for the City Clerk end the City Attorney
to attend the meeting in Los Angeles whe~ it is held. Mayor Done stated that
Louis Burke was to be present at the next County League Meetingto be held in San
Diego and that he could be contacted at that time regarding the tax ordinance
development. Re suggested that the City Council decide at a later date in regard
to the Clerk and City Attorney attending said meeting.
AMBULANCE STA~'~ AND ~IRE EXTINGUISHER: Upon recommendation by Cl. Bryant
the Council authorized the Police Department to have the ~son Garage inspect and
repair the starter on the ambulance and also authorized the purchase of a fire
extinguisher to be kept in said ombulance.
LA PLAYA ~iSTA SEWER DISTRICT: The City ~gineer reported that only six
property owners in the La Pls~a Vista Subdivision attended the proposed sewer
district meeting. It was discovered that quite a nur~ber of the property owners in
said district were not interested at the present time in having the sewers install-
ed at their places. It was decided that should all the property o~ers in One
particular Block agree to stand the cost of having sewers extended to that particu-

STREET OILING: The City ~gineer reported that he had graded 6th Ave. from
F St. to H St. and was now grading H St. from 4th to $th ~nd inasmuch as the
Board of Supervisors had not officially approved the resolution authorizing the use
of County equipment, he asked the Council for their authorization to purchase the
necessary oil at the best possible price upon receiving the acceptance of the
said resolution from the Board of Supervisors. Upon motion by Cl. Brown, seconded
by Cl. HOwe, which carried, said request was granted upon said condition.
W.~.~!, CUT'IEE: The City Engineer recommended the purchase of a weed cutter
at a cost of $233.§0 with extra bladeo He advised that this would reduce the cost
of weed burning and would consequently save on the assessment s against properties
for weed burning It could also be used in other work inthe Street Department.
Upon motion by Cl. HOwe, seconded by Cl. Brown, which carried, the above purchase
was authorized and was to be charged to the Weed Burning Account.
,REPLACE, TRACTOR: The City Engineer informed the Council that one of the
tractors is prne$t~l.~; worn out and if anything is to be realized fx~m it on a
turn-t- basis it must be exchanged soon. He suggested that inammach as the Budget
for the present year does not allow for such an expenditure that the City buy one
on a rental basis as this is being done by several other cities. Mmyor D~ne
suggested that the City Engineer and Street Commissioner Rc~e make the necessary
inquiry and investigation as to cost etc. of a new or second hand tractor and
report at the next meeting and it was so decided.
