The Council met in ~gular session in the Council Chamber of the City Hall on the above showm date with Mayor Done presiding. Meeting called to order at ? o'clock P. M. Present: Mayor Done, Councilme~ Ti...ons a~d Brow~. Absent: Councilm~n Howe and Bryant. ~ OF PREVIOUS m~.?DING~: The minutes of the regular meeting of April &th aud the adjourned regular meetings of April 15th and April lSth, 19~, having been prepared and mailed to each member of this Council by the City Clerk were approved as prepared and mailed after C1, Tl.w. ons offered a correction of $125 per quarter mile i~stead of $125 per square mile under the heading "Proposed Street OilLug" in the minutes of the regular meeting of April 4th, which correction the City Clerk advised had been made. GOAT N0-ISANOE: Mr. l~m. Bradley, owner of an auto coU~t on National Ave. and Ohula Vista Street, complaine~ to the council of the go~t nulaance created by the goats that are kept near his court. He stated that he had a l~rge investment in his auto court and that his guests were continually complaining of the "blatting# of said goats. He felt that the council should enact an ordinance prohibiting such an~-~ s in Chula Vista. The City Attorney advised that in his opinion the City of Ohula Vista would not be able to enact an ordinance prohibiting goats but stated that he had previously conferred with ~. Bradley in x~gard to the said nuisance and after determining the ~w~ers of the lots on which the goats were pastured had suggested to Mr. Bradley that he, the City Attorney, would write to the owners informing them of the said difficulty aud possibly they could be elt~mtu~ted by that method. He asked the City Council's authorization to mail said letters. The City Attorney than explained the means that could be used in trying to abate this nuisamce but inasmuch as Mr. Bradley did not care to swear out a complaint against the owners the City was powerless to do anything further than to act in the capacity of mediator. Cl. l~.yaut took his seat at this time. ~fter considerable discussion over the goat situation the 0ouncil informed Mr. Bradley that the officials would do ell they could to help eliminate this nuisance. CITY PAR~ DGNATION: The City Clerk informed the Council that he had received a check for $100 to be used' for the new city park development from the San Diego County Celery Growers' Association and upon motion by 01. Brown, seconded by Cl. Bryant, which carried, the City Clerk was instructed to write a letter of th.nk~ to said Association for their generous donation. HEAI.TH C0~IONER: Mayor Done nominated Cl. Bryant for Health Co~m~ esioner. Upon meti6n by Cl. Brown, 's'econded by Cl. T!mmons, which carried, the above nomination was confirmed. PLANNR~G CO~IS~ION wm~ER: Ms. er Done haVimg been a m~mber of the City Plamuing Commission and having b'een elected to the City Council at the last election, offered his resignation from said Planning Co~mtssion. Upon motion by Cl. B~o~, seconded by Cl. Bryant, which carried, Mayor Dome's resignation ~rom the Planning Commission was accepted. Mayor Done thereupon nominated C. A. Butler as a member of the Pl-~ing Co,m~lssion and upon motion by Clo Brown, seconded by Cl. Tin,nons, which carried, said no,.fnation was confirmed. ~ CLEI~['S BOND AND VAULT COMBINATION: The Clerk informed the Council that his bond and the eombinat'ion to the vault, which in a sealed envelope, had been transferred from Cl. Brown to Mayor Done for his keeping. FLOW~Y.R ~0~: The Executive Board of the Ohula Vista Flower Show by letter tendered their thanks and appreciation to th~ Council for their assistance and cooperation in ~taging the recent Flower Show. LUDWIG LETI'~.: Upon motion by Cl. Brow~, seconded by Cl. Tt~ww. ons, which carried, a letter from O. C. Ludwig dated April 22, 1938 was laid on the t able. ORDINANCE NO. 271: Upon motion by C1, Tire,nons, seconded by Cl. Brown, which carried, Ordinance No. 271 Was p'l'~ced on its first reading. This is an Ordinance ~tug First Ave. e boulevard at G Street smd at H Street and ,,~lctng Second Avenue a boulevard at F Street, at G Street and at ~ Street. w~,~ p~ AND LA PLAYA VISTA S~IgER: The City ~agineer offered a report whereby he advised the Council that he had salvaged approximately ES0 feet of ~ inch amd LSO feet of i i~ch water pipe from the park property on Second Avenue, which he will lay in the new park on Alma Street and stated that with the addition of a few fittings that this woul~ provide sufficient water main until funds could be provided for in the next year's budget. The report also stated that preliminary estimates had been worked out for the sewer in La Playa Vista Subdivision end that Ns~ 10th at ?:~0 P. M. had been set by the City Attorney and himself for a meeting of the property owners and that th~ esult of sold meeting would be forwarded to the Council for their consideration at a later meeting. Minutes of ~eeting of May 2, 1938, continued. T~LIRD AVE. WiDENING: The City Engineer advised the Council that a memorandum of agreement between the City of Chula Vista and the Division of Highways pertaining to the Third Ave. widening had been returned as approved and he requested the Council's authorization to start the work of improving Third Ave. from Davidson St. to E St. as in said agree~nt. Upon motion by Cl. Ti~m~ons, seconded by Clo Brown, which carried, the City Engineer was instructed to begin the Third Ave. widening as per agreement. ,P~O, POSED P. W. A. PROJ~,CTS: The City Engineer presented to the Council preliminary plans and estimates of proposed improvements for their approval in connection with proposed Government funds to be loaned to municipalities through P. W. A. The City Attorney advised the Council to instruct the City Clerk to transmit a telegraphic request to Mr. Harold Ickes, Publi~ Works ~mtnistrator, for a grant to be utilized as specified. Upon motion by Cl. Brown, seconded by Cl. Bryant, which carried unanimously, the follow- lng motion was adopted: That the preliminary plans and estimates for the improvement of the City Park located on Lets 2§ and 26, Quarter Section 137 in the City of Chula Vista, California, the improvement of the City Playground located on the easterly three hundred feet of Lot 17 in Quarter Section 137, and the improvement of the remainder of said Lot l? for municipal buildings be approved and accepted; that the said City Park plans call for improvements in the following particulars: Sw~m~tng Pool $25.000. Tennis Courts $2§00, Q~ts. Horseshoe and Shuffleboard Courts $1000; Comfort Stations and Tool House $2,000; Concrete Culvert $4,000. Landscaping and Playgrounds $4500; Total, $39,000; that the improvement of said Pls~ground called for improvements in the following particulars: Grandstand $6,000, approximate ground floor area 437§ square feet; that the said municipal building site calls for improvements in the following particulars: City M~ll $30.000. approximate area 7200 square feet; Street Department Building $5.000. approximate area 6000 square feet; Fire Department Bldg. $8.000. approximate ground floor area §000 square feet; Police Dept. Building $12,000. approximate ground floor area 3§00 square feet- a Total of $5§,000. approximate ground floor area of 21.700 square feet. making a Grand Total of $100,000.00. That application be made forthwith to the Federal ~mt~istrator of P~blic Works, WashingtOn, D. C. through proper ch~n~ls for projects to cover each and all of such projected im- provement s; That the City Clerk be and is hereby instructed to transmit such an application to said Federal Ad,,tuistrator together with three certified copies of such engineer's plans and estimates and three certified copies of~ extracts from the minutes of the City Council having to do with said projects to the said Federal A~mtuistrator. ,~AGE SET BACK: Mr. R. T. Conyers, Chairman of the City Planning Commission, in. for~ed the Council that the Planning Cozm~ission had studied the situation regarding the set-back on garages and recommended thnt the city adopt the specifications of the City of San Diego regarding garages, which allows said buildings to be built on the property line where the wall on the line is plastered and is one hour fire resisting. The Building Inspector reported that he had received numerous complaints regarding our present regulation, which requires garages to be built three feet from the property line; due to the fact that the drivewe~y in nearly every case is adjacent to the property line the garage having to be built three feet away makes it necessary to curve the rear of the drive to enter the garage. Upo~ motion by Cl. Bro~, seconded by Cl. Ti~aons, which carried, the recorm~endation of the Planning Commission waw concurred in. STREET 0TLTNG: ~,~r. Roy E. Richards, Supervisor of San Diego, and Nr. Cole, County Road Foreman, informed the council that the county wo~ld be willing to cooperate in oil- ing $th Ave. from F St. to Y St., H St. from ~th Ave. to $th Ave., and L St. from ~rd Ave. to Bay Boulevard to the extent of furnishing labor and equipment necessary for the said oiling, if the city would provide the necessary oil. ~r. Richards pointed out that the county could do this inasmuch as said streets are of general cOunty and city use. D~r. Richards informed the council that the District Attorney had advised the Board of Supervisors that it would not be proper to assist in furnishing materials for road im- provement inside of cities and assured the council that this had not been done in other cases. ~r. Cole outlined the methods that the county uses in road oiling and gave specific ax~apAes of the amount of oil used per square yard in various places in the county and stated that one gallon per square yard had proved the most successful in most cases. However, the percentage of "fines" in the granite determines to a great extent the amount of oil necessary to make a good road. He emtimated that by usSng one gallon per square yard it would cost approximately $3§0 per mile for the necessary oil. The council as a body felt the need of oiling the above listed streets and after examining the appropriate accounts expressed their intention of passing the re~olution which the City Attorney informed them had been framed and was ready for their approval. Mr. C. H. 2,~artin and 2~r. De Wolfe, residents of Sixth Avenue, personally th.nked the Council for their above premised approval. Minutes of la~etinE of ~ a, 19a8, oontinued. HIGHI~ AVE. BRIDGE: M~. l/ichards then outlined the work being done by the County in building the bridge at the Northerly side of Sweetwater Valley on H~ghland Ave. and showed the proposed grade which will be lifted several feet above the present grade from the ~outhern end of the bridge to the Northerly limits of Ohula Vista. He pointed out that a large culvert or small bridge should be installed Just ~outh of the Northerly limits of the city line on said Avenue to take care of flood waters end should the 0ity put in the necessary culvert or bridge he assured the 0ouncil that the Cottuty would do the necessary filling to raise the road bed to the proposed level. The 0ity Engi- neer stated that in his opinion the bridge should be Just North of the City Limits as the natural flow is at that point and due to the fact that the road bed blocks the natural flow it backs up to the South and goes through the small culvert at that point. ~l~e question having been brought up upon recoz~aendetion of Supervisor Richards it was decided to have the County and 0ity Engineers and Mr. Cole get tOgether, m~n the necessary levels end make reoozm~ndation upon said findings so that proper action could be takemt as to the exact location of the flow of flood waters. 0IL 6th. Brown offered R, esolution No. 52!, which is a resolution reqUesting the Board of Supervisors to modify their resolutic~ of August $, 1937, which prOposes to oil certain streets in the City of Ohula Vista and in lieu t~he~of oil 6th. Avenue from F St. to $. St., H St. from 4th Ave° to 6th Ave., and L St. from ~A~I. AVe. to Bay Boulevard. The resolution was read and was passed and adopted as read by the following vote, to-wit: AYES: Councilmen Brown, Bryant, Done and T//maem.. NOES: None. ABSENT: Councilmen Howe. HAT~Z ~ ~OVAL REQUEST: Elwyn Hatz requested the Council for permiaeion to remove three date p~lm~ from in front of his home on Third Ave. He was advised to m=ke written application to the City Planning Commztssion for their permission. Cl. Brown left at this time. SCHOOL, ,PROPERTY LF_JtSES: The City Attorney presented and explained the leases he had drafted between the City of Chula Vista and the Chula Vista Union School District for the playground property and the propos, e~d municipal building property, after which Clo Timmons offered Resolution No. 51.~. which is a resolution approving the respective leases and authorizing and directing the Mayor to execute the same for and on behalf of said City. The resolution was read end was passed and adopted as read by the following vote. to--wit: AYES: Oouncllm~u Ttmmons. Bryant and Done. NOES: None. AP-~W~T: Councilmen Brown and Howe. NATTOON DEI~.LOPMENT: The City Attorney reported that practically all the ccmvey- ances in the' Mattoon 'District had been procured and hoped to obtain the few outstanding in the near future. He explained the method he is pursuing in regard to tax deeds and the difficulties encountered with respect to obtaining s.-~ as three classifications of property in respect to taxes are involved. He read a letter from District Attorney Abbey which stated that in his estimation he was pursuing the only course left in the solution of the Mattoon settlement and offered the cooperation of his office to the fullest extent possible. The City Attorney stated that he would inform the Oouncil from time to time as to the progress made and the obstacles encountered. A letter fre~ Associated Assessment Engineers, Los Angeles, relative to the re-assessment under the provisions of existing refunding legislation not being applicable to Ohule ¥ista was filed. ~ RAD ,IA~OR: Chief Kelly reported that the radiator of the ambulance had become plugged and needs blowing out but inasmuch as there are no funds set up for the upkeep of said ambulance he requested the Council for permission to have the necessary work done on the radiator. Upon motion by 01. Bryant, seconded by Cl. Ttmmons, which carried, it was ordered to take the ambulance to the radiator specialist for repair. PERIODIC.
