HomeMy WebLinkAboutReso 2023-054 DocuSign Envelope ID: BC06EE7D-DOEO-4C6B-9B95-1 BDE00455D1 D RESOLUTION NO. 2023-054 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE SIXTH AMENDMENT TO THE AGREEMENT WITH THE ACCOUNTING FIRM OF LANCE, SOLL AND LUNGHARD, LLP TO PROVIDE AUDIT SERVICES WHEREAS, Section 1017 of the Chula Vista Charter requires an annual independent audit of the City: and WHEREAS, in 2014 the Finance Department posted a Request for Proposal (`RFP") to provide auditing services to the City for Fiscal Years 2014 through 2018. Based on that solicitation the City Council approved the agreement with Lance, Soll and Lunghard, LLP (LSL); and WHEREAS, due to time constraints and conflicting priorities caused by staff changes, the Finance Department requested, and the City Council approved to contract with LSL to complete audit services for Fiscal Years 2021 and 2022; and WHEREAS, due to the Finance Department transitioning the preparation of the Annual Comprehensive Financial Report (ACFR) by LSL to the Finance Department internal staff, the Finance Department is requesting approval to contract with LSL to complete audit services for Fiscal Year 2023; and WHEREAS, in accordance with Municipal Code Section 2.56.1 10.H.2, the Purchasing Agent has determined that the City's competitive bidding requirements are impractical with respect to this agreement, and that the City's interests would be materially better served by continuing to utilize the services of LSL pursuant to the prior RFP. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, that it approves the amendment to the agreement between the City and Lance Soll and Lunghard, LLP, in the form presented, with such minor modifications as may be required or approved by the City Attorney, a copy of which shall be kept on file in the Office of the City Attorney, and authorizes and directs the City Manager to execute same,and that it waives the competitive bidding requirements with respect to the retention of LSL for this work, as complying with such requirements would be impractical and the City's interests would be better served by waiving those requirements.
