The 0ounoil met in regular session, in the Oouneil 0hasher of the 0i~y Hall, on the above date, with Me, or Done presiding. Meeting called to c~dar at 7:30 p. m. Present~ ~or Done, Councilmen Howe, Lyons~ Brown, 0onyere. ~ OF PI~EVIOD~ ~,m~TINO~: The minutes of the last regular meeting of l~sbx~,Avy 8, 1934, having been mailed to each member of this 0oun~il, and no corrections found necee- sary~ were approved as prepared. DOGS A~D DOG EEI~-' William MCDonald, addressed the 0ouucil in the matter of a license for maintaining dog kennels. H~ presented a San Diego ordinance severing this subJeot~ which was read, and the 0ity attorney was instructed to prepare an amendment to our present dog ordinance, covering and authorizing a license fee for dog kennels. The clerk brought out the q~stion of obtaining permission of neighbors before a license ia issued; ales, as this is a business, it should be in the business zone; no action to these proposals. Then he obtained the consent of this 0ouncil, that a license for a dog kennel could only be issued by permission of this 0ouncil. This action taken upon motion by 01. Howe, seconded by 01o Brown, which carried. 01. 0onyers info~-~,d this 0ounoil with reference to three fete dogs owned and kept by B. S. Dockstader, National Aventw and I~ Street, that ~. Dockstader was willing to pay a license of $1o00 on e.~ch of his dogs~ instead of ~.00 each as provided by ord- inance, his dogs being confined by fence to a five-acre tract of land. No action. FL0~.~ Stt0~: ~rs. ~arcella Darling verbally asked this Council for an expendi- ture of $50.00 to assist the flower show to be held here in the nea~ future. She was succeeded by John W' ~Aon~oe~ who urged this grant, stating mu~h publicity would result from the flower show, particularly in the matter of Iris cultivating. Glo Brown vigor- ously protested the granting of this recAuest, on the grounds that the city is now bor~ rowing money, and paying interest thereon, ~nd could not afford the gift of this mone~ He urged that some steps be taken to n~e the flower show self supporting. Upon moti~ by Gl. Oonyers, seconded by Cl. Howe, the re,Hast WaS o~ranted, 01. Brown vot,ng No. ~i ~IOIPAL ELECTION~ In the matter of conducting the municipal election to be ~ April 9, 1934, Ol. Lyons offered P~solution No. 3f~, which is a resolution appointin~' ~ election office~s and giving hours polls will be open and where election booths will '~ be lo,ted. The resolution was read and Was p~ssed and adopted as read, by the follo~[~ vote, to-wit: At~ES~ Cl. 0onysrs, Done~ Howe, Lyons, Brown. NOF~: None. AB~T: None~,--~ D~DGIN~ IN S. D. HARBC~: · letter from thc S. D. 0hasher of 0ommerce was read, ~ in which this city is urged to approve the dredgin~ of a yacht basin in San Di~go harbor. No action. FRANOBff~ PAY~ The clerk presented an affidavit from the San Diego C~as and · lectrtc Gompany, together with a check for $596.99, which had bean submitted to him in pey~uent of the *nn,,,1 franchise tax due from the company. This payment for years past has ranged from twelve to th~-rtesn hundred dollars~ and the clerk stated he had not oeptad the above mentioned. The city attorney adivsed that thc amount of this check was the amount the company is claiming is the an~,,~! dues, in the suit now pending be- tween this city and the comDany; he reconnnended that the matter be returned to the eom- pany; that if it is accepted, it would be a breach of the provisions of the franchise; that the form of the affidavit is not satisfactory. Upon motion by 01. Lyons, seconded by 01. ~rown, which carried the clerk was instructed to reject this proposed payment and return all papers to the company. STATE LEAGUE OF ~Ji~ICIPALIT?Z~: The clerk read a circular letter from the State League of ~xnicllmlities, in which the Advisory 0ouncil of that organization asks the cities to consult with them on city matters, not purely local matters. 01. Howe stated that ~. Allen H. W. right, city clerk of San Diego, is a member of the Advisory Oounoll, ~ud that he is attending a conference of the Oouncil shortly. ~1. Howe moved, seconded by Glo Brown, which c~rried, that the clerk be instructed to cc~anun- ioate with ~r. Wright, and presemt matters considered important to this city, for presen- tation to the ~Ivisory 0ouncil, viz: Urge the reccmmendation of cities receiving one cent of the Stqte Gasoline tax; relieve cities, counties and state from paying state sales tax on supplies purchased; relieve cities, counties and state from the state gasoline t~x on gasoline used in public vehicles. PERIODICAL REPORTS: The monthly reports of the chief of police, fire chief and city Judge, for February~ 1934, were~presented an~ ordered filed. M~etlng of ~ch 6, 1934. FINANCIA~ CONDITION OF CITY: The clerk informed the Council that he had reg- istered all the warramts covering payments for February, 1934, except the two pay rolls. T~is action was necessary on account of lack of city funds to make the pay- ments. In this connection the clerk was instructed to hold all warrants signed at this meeting~ until the ma-mger of the 0hula Vista B~anch of the Bank of America advised that the bRnk is ready ~o receive them. EXTEI~SION OF THIRD AVENUE: The city engineer informed this Council that ~r. F. E. Damren will deed a right of way through his property for the extension of Third Avenue, n~rth of D Street, if the city will grade a drive to §-Acrs Lot 10, ~-Section 136. The city engineer was instructed to close the deal under the above set forth conditions, upon motion by Glo Lyons, seconded by Cl. Conysrs, which carried. BILLS PAID: Upon motion by Gl.
