HomeMy WebLinkAboutReso 2023-043 DocuSign Envelope ID:6D8ABBAA-058F-4889-9620-BEEEC485B574 RESOLUTION NO. 2023-043 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE INFRASTRUCTURE, FACILITIES, AND EQUIPMENT EXPENDITURE PLAN AND AMENDING THE FISCAL YEAR 2022/23 CIP PROGRAM BUDGET THEREFOR WHEREAS, on November 8, 2016, Chula Vista voters approved Measure P authorizing a temporary 1/2 cent sales tax increase on retail sales within the City for a period of ten (10) years to address failing high priority infrastructure projects; and WHEREAS, Section 2.56.160 of the Chula Vista Municipal Code authorizes the City to contract for Public Works; and WHEREAS, on August 7, 2020, the Department of Engineering and Capital Projects solicited bids for the "Traffic Signal Modifications (Measure P) (TRF0408)" project in accordance with Chula Vista Municipal Code section 2.56.160.A; and WHEREAS, on September 2, 2020, the Director of Engineering and Capital Projects received six (6)bids for the "Traffic Signal Modifications (Measure P) (TRF0408)"project; and WHEREAS, on October 6, 2020, City Council awarded a construction contract to HMS Construction, Inc for CIP TRF0408; and WHEREAS, during construction differing site conditions caused by utility conflicts when installing the new traffic signal foundations led to project delays and additional costs to relocate utilities and foundations; and WHEREAS, due to differing quantities and additional items of work encountered in the field as compared to the construction contract, actual costs to the project will exceed the approved contingencies; and WHEREAS, staff recommends appropriating an additional $250,000 above the originally approved amount for construction change orders with HMS Construction, Inc., and associated consultant and staff costs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that it approves the amendment to the Infrastructure, Facilities, and Equipment Expenditure Plan. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it appropriates $250,000 from the available fund balance of the Measure P Fund to CIP TRF0408. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that in accordance with Chula Vista Municipal Code section 2.56.160.C.2, the City Engineer is authorized to approve change orders up to the remaining available CIP budget for the Project.
