The City Council met in the Council Ob.tubers of the City Hall on the above date, with Mayor Keithley presiding. The meeting was called to order at 7 o'clock PoMo, Present: Councilmen Keithley, ournside, Riesland, Kidder, Chase. Absent: None. OAh~ OF VOTES: The council proceeded with the canvass of votes cast at the General Municipal Election, held Tuesday, April 9, 1946, according to the procedure as set forth in the Statutes. RESOLUTION N0.742: Councilm~u Burnside offered Resolution No,742. This is a Resolution desisting results of a General I~nicipal Election held April 9, 1946. The Resolution was read in full end was passed, adopted and approwd by the following vote, to-wit: ~yes: Gouncilmen Burnside, Kidde~, Rlesland, ~eithley, Chase. Noes: None. ~bsent: None. RESOLUTION N0.743: oouncilm~ Kidder offered Resolution No.7~3. This is a Resolution declaring result of canvass of election returns of the Special Bond Election he~ ~pril 9, 1946. ~e Resolution was read in full and was passed, adopted and approved by the following vote, to-wit: ~yes: Councilmen Kidder, Rlesland, Keithley, Chase, Burnside. Noes: None. ~bsent: None. SEATEG OF i~ COUNCIt~m~: ~t this time CounciLmen Elect Koester and Dyson, were admin~$tered the oath of office by the clerk, ~nd after greetings by the council, Councilman Chase and Councilman Burnside retired, and Councilmen Koester and Dyson took their resl~ective places at the council table° ~t this point, Mayor Keithley relinquished his seat as Mayor, end turned the meeting over to the city clerk for the conducting of the appointment of ~iayor for the newly formed council. ~PPOIN~2NT OF ~AYOR: It was moved by Councilman Keithley, seconded by Councilman Dyson, and carried,una~imous~v, that M~oLorenz ~.Koester, be appointed Mayor. ~hereupon, after congratulations and posing for the press, L~yor Koester took his place ~d proceeded to conduct the ~ffairs of the council. 0RDI~!ANCE N0.358: On motion by Councilman Keithley, seconded by Co,~acilm~n l~idder, ~hich carried, Ordinance No.358 was placed on its first reading° This is an Ordinance repealing Ordinance NO.JAS, creating the office of City ~L~nager. RESOLUTION N0,744~ Counci~n Riesland offered Resolution No.744o This is a Resolution approving agreement between the city Engineer and the County Surveyor. The Resolution was read in I'ull and. was passed, ~dopted and ~pproved by the following vote, to-wit: ~yes: Councilmen Riesland, Koester, Keithley, Dyson, Kidder. Noes: None. Absent: None. RESOLUTION N0.?4§: CounciLman Kidder offered Resolution NOo745. This is ~ Resolution suspending work under ~rchitect'~s contract. The Resolution was read in I~ll and was passed, ~dopted and ~pproved by the following vote, to-wit: ~yes: Councilmen Kidder, Riesland, Koester, Keith-ley, Dysono Noes: None. ~bsent: None° The clerk was instructed to trsna~t a copy of this Resolution to ~k'. UoS. 0oBUILDING: City %ttorney Higgs having been requested to render an opinion as to the legality of stopping negotiations to purchase the U.S~Oo building, stated that, in his opinion, the City of Chula Vista had a right to revoke its offer to purchase at ~ny time prior to the acceptance of the offer by the United ~tates Government. It was thereupon moved by Councilmen Dyson, seconded by Councilm-~ Riesland, ~nd carried, that the matter be postponed to a later date in order to allow time for study end discussion° ROBERT~ PALE{ UNITS N0.2 end 3: The Planning Cmmmission having approved the Tentative Map of Units No.2 and 3 of Roberta Park Subdivision, council likewise approved the tentative map as presented, subject to the filing of a surety bond or other security, satisfactory to the council, securing the installation of all improvements. The approval was made by the following vote, to-wit: Ayes: Councilmen Riesland, Koester, Keithley, Dyson, Kidder° Noes: None° ~hsent: None. SEWER DISTRICT PR0~URE: By request, upon motion by Councilmzzu Koester, seconded by Councilr~ Keithley, which carried, City ~ttorney waS ~uthorized to investigate, from a leal standpoint, the various methods bywhich sewers might be installed in the city, and' report his findings as soon aS possible to the council. Petitions signed by numerous property o~mers on "F" Street west from Fourth Avenue and in ~mailes Park Subdivision, requesting the fonnation of a sewer district, were formally filed with the council, and, on motion by Councilman Kidder, seconded by Council~.~ Riesland, which carried, were referred to the city attorney for advice. ~ 'V]'T.T~..~ SU2~IVI~ION: ~ tentative m~p of Haynes Villas Subdivision was presented for council approval, and, it having been formally approved by the Planning Commission, on motion by Councilman Riesland, seconded by ~' Councilman Koester, and cerried, was approved by the council, subject to filing of safety bond or other security satisfactory to the council, securing the installation of improvements. YANITOR SEl~VICE U.S.0: ~r.Love, street superintendent, reported that he was using two of his street men for approximately three hours each d~y for janitor service at the U.S.0, and stated he could not long continue this practise as the men were badly needed for important work at the septic tank, aud other vital places. ~r.Love was asked to continue temporarily until the matter could be studied end a definite conclusion reached.
