The Council met in Regular session in the Council Oh.tubers of the Oity W. ll,
on the above date, with Ms, or Koester presiding. The meeting was called to
order at ? o'clock P.M., Present: Councilmen Koester, Dyson, P. iesland, EA~der.
Absent: 0ounc~lm~ ~ithleyo Councilm"~ Eeithley's resi~etion having becomes
effective on September 9, 1946, was not present.
Minutes of meetings held August 12, and August 26, 1946, having been read by
each member present, were approved.
It was moved by Councilm~ I~lesland, seconded by Oouncilman Dyson, that Mr.
H.D~dley Naahold, who resides at 544 "G" Street, Chula Vista, California, be appointed
to the council to fill the vacancy created by the resignation of Ralph Eeithley,
September 9, 1946. The motion was passed by the following vote, to-wit. Ayes:
Couucil~*u ~iesland, E~ester, Dyson, Kidder. Noes: None. Absent: ~one.
Mr. Nashold bet~ present then c~-~ fo~w~l and the Oath of Office was

On motion by Council~- Dyson, seconded by Councilm~ KoeSter, which carried,

Nashold, permission was granted, subject to the approval of the Planning Commission,
aud subject further to revocation at eny time by the City ~Ouncil.
REQUEST F~ PA~gNT GF DAMAGE: I~everemd Clive Williams, PastOr of the C~ula
Vista Nazarene Church, presented a bill for damages caused by sewer stoppmge and
flo~img of ba~ememt. On motion by Councilman Kidder, seconded by Council~.~-
Nas~old, which carried, the claim was refereed to the City Attormey and City Engineer
for report back at next meetimg.
C1TT ~MP: Mr. E.O.Linthic~un made a request that he be allowed to operate
city dum~ in retuxla for salvage. On motion by OoUncilm~ Eoseter, seconded by
Councilw~u Kidder, which carried, the matter was referred to ~he City Attorney for

1WJRCHASE OF SAI~) SPREADER: On motion by Councilm~ Rieslend, seconded by
Councilman Nashold, which carried, the clerk was authorized to purchase Sand
Spreader for the Street Department at a price approximating $264°00.
TA~ REFUI~tS: City Assessor Bryant requested authority to m~e the following
refunds:- On Lot A-D, Quartersection lA9 - double assessment of $?00.00 -
reftmd $11.90, and on Lot 1A-H, Quartersection l§0 - Veteran's Exemption not
credited on account of error - request refund $17.00; Lot 3§ in ~Aartersection

On motion by Councilman Koester, seconded by Councilm~ Nashold, ~ich carried,
assessor was authorized to make the above refunds.
ZONE VARIANCES: It was moved by Councilman Koester, seconded by Councilman
Rleslaud, and carried, that in the fature all applications for Zone Variances,
be first presented to the Firs Chief smd Building Inspector, whose duty it will be
to recow,~And or deny the application, statt-g their reasons in writing.
CAPITAL OUTLAY FUll): City Attorney Htggs ruled that monies now invested in Bonds
and held for Capital Outlay purposes, c~nnot be used as matching money to
secure aid from the State for additions to our s. ew~r plant. The city attorney
also advised the method by which sewer districts and lighting districts might
be fl~rmad ·
~i-~TT ~TI~y: ~r. Hlggs reported that if the city wished to start condemnation
~roceedings in order that the alley~nding north fre~ ~avidson Street and west
on Third Avenue, might be opened, it would first be necessary to have the land
appraised, and suggested Mt.Edwin A.M~,ellar, State Inheritance Ta~ Appraisor
be hired for this purpose. On motion by Councilman Nashold, seconded by
Councilman Ries±and, which c~rried, the city attorney was authorized to secure
the services of Mr.M~eller for this purpose.
~ PLANS: Upon motion by Councilman Riesland, seconded by Councilmen Nashold,
which carried, city engineer was instructed to prepare pl~n~ for necessary
addition to the sewer outfall plant and collector mains, up to an estimated ~mount
not to exceed $90,000.00 ~n cost for construction.

RESOLUTION N0.765: CITY BUMP: Mr. Linthicum presented an sgreem~nt to operate
the city dtump under certain te~-~ and conditions, whereupon Councilman Riesland
offered Resolution NOo765. This is a~esolution accepting Agreement of
Linthicum to operate the dump and authorizing the Mayor ~d City Clerk to execute
same. The Resolution was read in full and was passed, adopted and approved by
the following vote, to-wit: A~es: Councilmen Riceland, Koester, Nashold.

CLAIM FOR DAMAGES: ~ 01~t~, for ~ amages was presented by the Nazarene Church
in which it was stated that their casement was flooded due to faulty sewer
construction° The matter was referred to the city attorney for recommendation.
