HomeMy WebLinkAboutcc min 1947/10/14 MINUTES OF REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF GHULA VISTA, 0AiIFORNIA Held October 14, 1947 The 0ity 0ouncil met :in the Cotuucil Chambers of the City Hall on the above dates with the following members present: Councilmen Koester, Nashold, Dyson, Kidder, Riesland. Absent: None° Minutes of the previous meeting haVing been mailed to each member of the Council, were approved as prepared and mailed. Minutes of the Planning Oomnission meeting held October 6, 19~7 were approved° Report on Sewer Plant: The Clerk read a letter from Mr. Yames Carwile, reporting progress on plans for Sewer Plant° The report is on file in the City Clerk's office. GOULD C(~mLAIItT: Mr. Gould appeared before Council and protested agalnst the action of the Police in not restraining Mr. Herbert Tompkins from driving his car following an ascident in which the cars belonging to Mr. Gould and Mr. Tompkins collided. Mr. Gould stated that in his opinion Mr° Tompkins was in no condition to drive a ear, but was allowed to do so without interference from the Police Department° Officers Lee and Feeney reported that they did not actually see the accident, and that they were acting as referees onlyo After discussion, Chief-of-Police Lofthouse stated that in his opinion the officers acted in their best Judgment, and advised Mr. Gould that he had the right to ciVil action if he so desired. No further action was taken. FIRE HALL:ADi'ERATIONS: A few minor changes being necessary in the construction of the Fire Hall, the City Clerk was authorized to notify the contractor to proceed with the specified changes under Sub-section "0" of Section 20 of Standard Provisions. The motion was made by Councilman Dyson. seconded by Councilman Riesland, and carried. ~ No. 6§74: Payment to F. E. Young contractor for the construction of the new Fire Hall for accrued costs to date were authorized and the City Clerk instructed to make payment for same under Warrant No. 6574. It was moved by Councilman Kidder seconded by Councilman Riesland, which carried City Clerk be authorized to cash sufficient Wet Savings Bonds to pay the above warrant. STREET LIGHTS: Mr. G. S. Kimball of the San Diego Gas and Electric Co. appeared before Council to discuss the matter of mtreet lights. It was moved by Conncil~ Kidder, seeonded by Councilman Nashold, and carried that the Clerk be authorized to order the change-over of approximately 91 street lights from 2§00 lumens to 6000 lumens, and to order approximately 40 new street lights. The exact number to be decided after an actual survey was made and presented to the Council. H. Logan Mueller asked that a light be placed at Fifth Ave. and Flower St. and was told that this location has been plased in line as one of the new lights to be in stalled o GROUP INSURANOE: On motion by Councilman Kidder, seconded by Council~n Nashold, and carried, the Council authorized the payment by the City of fifty percent of the premium charge on each employee participating in Group, Health, Accident, and Hospitalization Insurance, providing the City Attorney finds same to be legal. WA~ER AUTHORITY CONTRACT Arthur Lyes gave a brief report on the progress of b'~inging water from the Metropolitan Water District to Sweetwater Reservoir. He stated that it would be necessary to make some temporary arrangement for transport of water through the City of San Diego mains in order to tide the City over a very critical dry spell° He asked that the City Attorney, Administrator ,i~ Bryant, and Mr. Arthur Lynd~s the City's representative on the San Diego County Water Authority be appointed a committee to enter into negotiations for transport of water through the City of San Diego mains with the California Water and Telephone Company° Mayor Koester then appointed the above men to serve and on motion by Councilman Kidder, seconded by Council~u Riesland the appointments were confirmed. SEt~ER LINE: GRIFFIN PA~K: The Clerk read a letter fram the Chula Vista Development Con~pany requesting a contract to be negotiated between their company and the City of Chula Vista whereby the City could collect and pay to the Chula Vista Development Company for future connections to the Sewer main connecting 9tiffin Perk with the present system by people who did not share in the cost of laying' the said mains. Reference wes mede to new legislation whereby such contracts are now legal. On motion by Councilman F. idder, seconded by Councilman Rieslend, which carried, the matter was referred to the City A~%~%~/ Administrator Bryant and the City Attorney Boyer to negotiate with the proper offieal of the 0hula Vista Development Company. SANIT~ATION DISTRICT: The matter of the formation of a sanitation district in the County Area adjacent to the City on the East was discussed. On motion by Councilman Riesland, seconded by Councilman Dyson, which carried, the City Attorney, City Administrator, Mayor Koester, and City Engineer Algert were appointed a committee to investigate the matter and report at a later date. CITY RETI~m~NT: On motion by Councilman Kidder, seconded by Councilmsm Koester, which carried, the Oity Clerk was instructed to proceed with the procure~ent of a survey by the state ih order that 0ouncil might know the cost involved should the *-~ City elect to participate in such retirement for its employees. WHITT ~TJ~I~y: On motion by Councilman Kidder, seconded by Councilman Nashold, which carried, the City Clerk was authorized to pay Mr. Whitt the sum of upon receipt of dedication Deed from Mr. Whitt. BIT~2 PAID: After examination by the entire Council, warrants Nos. 6482 to _ 657§ with bills attached were ordered paid by the following vote to-wit: Councilmen Riesland, Koester, Nashold, Dyson, Kidder. Noes: None Absent: none HALLOWEEN PAI~: Mr. J. D. Peters ~%%~/ appeared before Council requesting financial aid in the amount of $~0.00 for putting on a Halloween Party for the children at large in the City. On motion by Councilman Nashond, seconded by ~ouncilm-~ Kidder, which carried, the City Clerk was authorized to pay through the Recreation Co~uission an amount not to exceed $50.00 for this purpose. P~BOLUTION No. 8~: A Resolution authorizing the City Clerk to advertise for Bids for the supplying of plant mix on Third Avenue° Councilmen Kidder offered the above Resolution, which was read in full, passed, adopted, and approved by the following vote to-wit: Councilmen Kidder, Rlesland, Koester, Nasho~, Dyson. Noes: none Absent: none. 0RDINAN~E No. ~84: An Ordinance esteblish$~g Boulevard Stops. On motion by Councilman Riesland, seconded by Councilman Nashold, which carried, Ordinance No. was read in full and placed on its first reading. RESOLUTION No. 8~:. A Resolution authorizing Reconveyance of Trust ~eed (Thomas~ Councilman Kidder offered the above Resolution, which was read in full, passed, adopted, and approved by the following vote : Ayes: Councilmen Kidder, Rieslend, Koester, Nashold, Dyson. Noes: none Absent: none. CERTIFIOATE OF COMPLETION: The Clerk read a certificate of completion of all improvements in Robert~-Park No. 2 according to plans and specifications signed by City Engineer Algert and S~pt. Love. RES0LTUION NCo 8~5: A Resolution authorizing Reconveyance of property to Steele. Oouncilmen Nashold offered the above Resolution~ which w~s read in full, p~ssed, adopted and approved by the following vote to-wit: Ayes: Councilmen Nashold, Dyson, Kidder, Rieslend, Koestero Noes: none Absent: none The Clerk read the Resignation of City Attorney DeWitt A. Higgs, who stated that due to increased duties in his private business he found it necessary to tender his resignation. Councilm-~ Rlesland moved that the resignation be accepted effective November 1st, and expressed his deep regre~s that Mr. Higgs found it necessary resign° Oouncl~man Eoester seconded the motie~ with the statement that Mr. Higgs resignation was a great loss to the Cl~y. The motion was carried and followed by statements of regret from the entire Council. In Mr. Hlgg's resignation he recow,,ended that Mr. Boyer be appointed as City Attorney whereupon it was moved ~y Councilmen Riesland, seconded by Councilman Nashold, and carried, effective November ls~ Mr. Bayer be employed as City Attorney at a salary of $300,00 per month. EESIG~ATION 02 CITY ENGINEEI~: The Clerk read a letter of resignation fr~n Algert City Engineer, to be effective at the pleasure of the Council. No action was taken at this time. RESOLUTION No. 856: A Resolution authorizing the City Clerk to advertise for bids for supplying plant mix on Park Bow~ ~alke. Councl]~n Kidder offered the above Resolution which was read in full, l~assed, adopted, and approved by the following vote to-wit: ~es: Kidder, Riceland, Koester, Nashold, Dyson. Noest None Absent: NOneo Koester, which carried. mower for the park° A motion by Councilman Nashold, seconded by CoUncilman The City Clerk was authorized to purchase a new lawn NEW OAR FOR S'~'l~mm'z' ~.~2: Mr. Love, Street Supt. having requested authority to purchase a new ear for his use in the street department, it was moved by Councilman Dyson, seconded by Oouncilman Kidder and carried that the matter be tabled to the next meeting. VANCE STREET: The Clerk read a letter from the Moran Construction Company requesting permission to install a sewer main on the north side of Vance Street. It was moved by Councilman Riceland, seconded by Councilman Kidder , end carried, that permission be granted to make the sewer in the center of the street, but not on the north side.
