On September 16, 2022, we submitted comments on behalf of SWMSRCC stating objections and concerns regarding the Project and the MND. We are pleased to report that, as a result of direct discussions with the Applicant, the Applicant has agreed to implement environmental measures adequately addressing our concerns in a legally enforceable settlement agreement. Moreover, independently, the City’s response to comments also adequately addresses our concerns such that we agree the MND and the Project comply with all local, state and federal laws. Due to the fact that SWMSRCC concerns have been adequately addressed, SWMSRCC hereby withdraws its comment letter and renounces its status as an interested party for purposes of any administrative or judicial appeal. SWMSRCC respectfully requests that the City approve the Project and certify the MND without delay or further revision. Please let me know if you have any questions. Sincerely, Mitchell M. Tsai, Esq.
