If you wish to speak on one of these items, please fill out a "Request to Speak" form and submit it to the Secretary prior to the meeting or submit an electronic comment per the instructions on page one of this agenda. 5.1 Design Review and Conditional Use Permit for Medical Office Building Expansion for the Sharp Rees Steay Medical Office at 1400 East Palomar Street Environmental Notice: The Applicant submitted a Mitigated Negative Declaration ("MND") (IS21-0005) resulting from a determination that the proposed development, known as Sharp Rees-Stealy Otay Ranch Expansion, may potentially have significant environmental impacts; however, use of the MND and an associated Mitigation, Monitoring, and Reporting Program ("MMRP") would reduce impacts to a less -than - significant level 2022-12-14 PC Agenda Page 2 of 5 eri�"f Mi!=—F—;=9 Conduct a public hearing and adopt a resolution (1) adopting and approving the MND and MMRP (IS21-0005), (2) approving Design Review Permit DR21-0029, and (3) approving Conditional Use Permit CUP21-0019 for construction of 58,788 -square foot medical office building expansion and 43,793 -square foot detached parking structure 5.2 Design Review for a 97,310 -Square foot OffloeNVarehouse Building in the Otay River Business Park Located at 2995 Faiwe Street Environmental Notice: The Project was adequately covered under a previously adopted Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program (IS15-0005/MPA 15-0022) for the ORBP Specific Plan. Recommended Action: Conduct a public hearing and adopt a resolution approving Design Review Permit DR21-0036 for the construction of 97,310 -square foot office/warehouse building with associated parking on a 6.08 -acre site, within the PA -3 zone of the ORBP Specific Plan and located at 2,995 Faivre Street. 5.3 Design Review Permit to Construct 267 Units Within the Otay Ranch Village Eight West at La Media Parkway and Main Street Environmental Notice: The Project was adequately covered in previously certified Final Environmental Impact Report (FEIR 10-03) (SCH #2010062093) for the Otay Ranch Village Eight West Sectional Planning Area Plan, certified on December 17, 2013. . .. a uR�'TT"--TiCi�GiniG711 Conduct a public hearing and adopt a Resolution for the development of 267 market - rate, multi -family residential units, based on the findings and subject to the conditions contained therein. 5.4 Consideration of an Amendment to the Otay Ranch Village Two Development Agreement between the City of Chula Vista and Baldwin and Sons, LLC. Environmental Notice: The Project was adequately covered under a previously adopted Final Supplemental Environmental Impact Report (FSEIR 12-01) on November 4, 2014 for Otay Ranch Village Two Sectional Planning Area. Recommended Action: Conduct a public hearing and adopt a resolution recommending the City Council approve an ordinance authorizing the First Amendment by and between the City of Chula Vista and Baldwin and Sons, LLC. 2022-12-14 PC Agenda Page 3 of 5 5.5 Consideration of Amendments to Chula Vista Municipal Code (CVMC) Environmental Review., The Director of Development Services reviewed the proposed legislative action for compliance with the California Environmental Quality Act (CEQA) and determined that the action qualifies for the "common sense" exemption under State CEQA Guidelines Section 15061(b)(3). The action involves only updates, modifications, and organizational changes to the CVMC relating to City Department names and staff titles, section numbering, hearing and appeal processes for zoning decisions, additions of definitions, and Code enforcement processes and actions. Furthermore, the action of updating and modifying the CVMC with procedural and clerical changes will not result in an intensification of uses or a change in development potential within the City above what already is permitted under the existing land use and zoning policies of the CVMC that are being updated. Based on an analysis of the nature and type of these procedural and clerical changes to the CVMC, there is a certainty that there is no possibility that the action may have a significant effect on the environment. Recommended Action: Conduct a public hearing and recommend the City Council of the City of Chula Vista adopt an ordinance amending CVMC Title 2 (Administration and Personnel), Title 6 (Animals), Title 9 (Public Peace, Morals, and Welfare), Title 10 (Vehicles and Traffic), Title 12 (Streets and Sidewalks), Title 13 (Sewers), Title 14 (Watercourses), Title 15 (Buildings and Construction), Title 17 (Environmental Quality), Title 18 (Subdivisions), Title 19 (Planning and Zoning), and Title 21 (Historic Preservation). 5.6 Consideration of a Second Amendment to the Otay Ranch Eastern Urban Center Development Agreement Between the City of Chula Vista and McMillian Otay Ranch, LLC. Environmental Notice: The Project was adequately covered in previously certified Final Second Tier Environmental Impact Report (EIR 07-01) — SCH No. 2007041074 for Olay Ranch Eastern Urban Center (EUC) Sectional Planning Area (SPA) Plan and Tentative Map, Recommended Action: Conduct a public hearing and adopt a resolution recommending the City Council approve an ordinance authorizing the Second Amendment to the Development Agreement by and between the City of Chula Vista and McMillin Otay Ranch, LLC. 6.
