CITY COUNCIL
OF THE CIT~ OE CHULA VISTA, CALIFORNIA, HELD TUESDAY,
MAY 18, 1948.
The council met in the Council Chambers of the City Hall on the above date, at
7 o$clock Pe~., with the following members present: Councilmen Nashold, Dyson,
Kidder, ~oester, Riesla~io Absent: Nonce
The m~nutea of meetings held April 6, 1~s 20 and 27, 1948, having been given to
each Counc~m-~, were approvedo
Mrs DeWitt Higgs and Mr. A1.Poulter appeared before Council requesting passage
of Resolution No°S, allowing California Water & Telephone Company to use the credit
for water now held by the City of Chula Vista. City Attorney Boyer having given his
opinion that it undoubtedly was the intent of the contract that the California Water
and Telephone Company should ~y whatever the city was charged under the temporary
agreement, and Nr.Higgs having stated that if any party should sue the city, and this
action on the part of the city was determined in error, that the California Water
and Telephone Company would also be a party to the suit. The Resolution was
passed; adopted and approved by the following vote, to-~it: Ayes: Councilmen
Koester, Riesland, Nashold, Dyson, Kidder. Noes: None. Absent: None.
OLSON CO~FLAINT: The clerk read a letter from Mrs.Olson in which she stated that;
inasmuch as the Mayor had appointed the present Building Inspector to investigate her
complaint, she was taking other steps. The clerk read a letter he had sent to Mrs.
Olson advising her that the City Attorney and City Engineers as w~ll as the Building
Inspectors had been instructed to investigate.
RESIGNATION OF BUILDING INSPECTOR: The clerk read the resignation of Mr.Frank
~ W~]]its as Building Inspector, effective as of June l, 19~8. It was moved by
Councilman Riesland, seconded by Councilman Kidder, and carried, that the resignation
be accepted.
GARDNEE AND ~EADOR SUBDIVISION: Mr.Jack Gardner and Mr~Meador appealed to council
for relief in the matter of inst-11 ation of sidewalks in a portion of their subdivision
which had been presente~ to the Planning Compression. After discussion it was moved
by Councilman Rieslar~s seconded by Councilman Dyson, and carried~ that councLl
resommend to the Planning Commissions acceptance of this Subdivision without installa-
tion of sidewalks on National Parkway and "J" Street.
E~OVAL OF PALM TREES: The clerk read a letter from several property owners i~. the
one hundred block on Cypress Street requesting the removal of date ~,a]m trees mn the
parking area. Inasmuch as these trees ware a hazar~ to sidewa~ks~ sewers an~
dangerous to ohLldrens it was moved by Coune~lmau Riesland, seconded by Councilman
Kidder, and carried~ that the Park Superintendent be instructed to remove these trees
replacing them with Cocos Plumosa PaLms~
ST~EET DECORATIONS: The clerk read a letter from the Foley Advertising Company,
offering to ~ decorate the city as they had last year for the Fiesta, for the
~sum of $325e~. It ~as moved by Councilman Kidder, seconded by Oo~¢~lman Nasholds
and carried~ that Administrator Bryant be authorized to enter into a contract to pay
the Foley Advertising Company $325~O0 for decorations this year. The decorations
to be the same in number and character as last year,
~REQUEST OF SAN DIEGO CALIFORNIA CLUB: The clerk read a request from San Diego
California Club for a donation of $5~.~. ~t was moved by Councilman Riesland,
seconded by Councilman Nashol~, and carried, thatthe request he denied, and the clerk
so advised the clubs
1911 ACT - SE~S: The clerk read a letter from James G.Carwile, in which he stated
that the one factor which was holding up procedure of the 1911 Act Sewer Installation,
was the procurement of all the easements necessary. MroBoyer and City Engineer Foster
e~olained what they had bee~ doing to obtain these easements, and decided on a more
vigorous campaign to secure the easements at an early date. ~
SMOKE NUISANCE: A~m~-istrator Bryant reported that he had received several
complaints regarding the smoke and soot from the Fredericka Home Power Plant
Staek, and Comnc51ma~ Kidder advised council that he would again contact Mr.
Burkholder and investigate the matter.
~LORADO RIVEEWATER C~.~:RRATION: It was moved by Councilman Kidder, seconded by
~Councilman Riesland, and carried~ that the City Administrator be authorized to
spend, not to exceed $100.00 for the cityts share in the water celebration held
May ~,19~8a
It was moved by Councilman Kidder, seconded by Councilman Nashol~, and carried,
that Warrant No.7213 in the amount of $8a75 be paid.
VOLUNTEER FIREMEN: After discussion relative to recognition of the Volunteer
~,iremen for their past services, it was moved by Councilman Nashold, seconded
by Counc~3m~n Kidder, and carried, that an expenditure, not to exceed $60e00,
be authorized for the purpose of holding a dinner in the Fire Station and issuing
certificates to the Volunteer Firemen for their splendid services in the past.
RESOLUTION N0.889: Councilman Kidder offere~ Resolution No~889~ authorizing
~The execution of agreement with Santa Fe Lands for purpose of Sewer Plant Site.

RESOLUTION N0~883: Councilman Nashold offered Resolution NoeS~3~ approving
agreement with SanDiego & Arizona and Eastern Railway for Sewer easement~
The Resolution was read in f~l and was passed~ adopted and approve4 by the following
vote, to-wit: Ayes: Councilmen Nashold, Dyson~ Kidder, Ko.stet, Rieslande
Noes: None. Absent: Nonee
RESOLUTION NO. ~85: Councilman Dyson offered Resolution No.885~ authorizing
~xecution of termination of use of U~S~Ae portion of "D" Street~ The Resolution
was read in full and was passed, adopted and approved by the following vote, to-wit:
Ayes: Councilmen Dyson,Kidder~ Koester~ Riesland, Nashold. Noes. None. Absent.

RESOLUTION N0o886: Councilman Kidder offered Resolution No.886~ accepting
~edication of alley (Huntington). The Resolution was read in full and was passed,
adopted and approved by the folloeing vote, to-wit: Ayes: E&unc~lmen Kidder~
Koester, Riesland, Nashold, Dyson. Noes: None. A~sent: None~
RESOLUTION N0.887: Councilman Koester offered Resolution No.887~ accepting
dedication of alley (Scaggs)o The Resolution was read in full and was passed,
adopted and approved by the following vote, to-wit: Ayes: Councilmen Koester,
Riesland, Nashold, Dyson, Kidder. Noes° None. Absent: None.
RESOLUTION N0.888: Councilman Riesland offered Resolution No.888approving
agreement with the San Diego Arizona and Eastern Railway for crossing at "J" Streete
The Resolution was read in full and was passed, adopt.4 and approved by the following
vote, to-wit: Ayes: Councilmen Riesland, Nashold, Dyson, Kidder, Koester~ Noes:
None. Absent: None,
O~DINANCE N0.390: It was moved by Councilman Kidder, seconded by Councilman
Dyson, and carried~ that Ordinance No.390, providing for Substitution of Al,,mtuum
Pipe for Cast Iron Pipe, be placed on its second reading. The Ordinanc~ being in
its exact form as when place~ on its first reading, and the title having been read
in full, it was moved by Councilman Kidder, seconded by Counc~lma~ Koester, and
carried, that further reading of the text be waived. The Ordinance wa~ passe~
adopted and approved by the following vote, to-wit: Ayes: Councilmen Kidder~
Koester, Riesland, Nashold, Dyson. Noes: None. Absent: Nonee
BOOKKEEPEr: It was move~ by Councilman Nashold, seconded by Councilman Rieslan~,
~and that the City ABm~istrator be authorized to hire a bookkeeper at a
carried~
salary not to exceed $20Oe00 per month.
RESOLUTION NO.8$&: Councilman Koester offered Resolution No.88~ authorizing
~agreement with the schools (Recreation). The Resolution was read in full
and was passed, adopted and approved by the following vote, to-wit:
Ayes: Councilmen Koester, Riesland, Nashold, Dyson, Kiddero Noes° None.
Absent: None.
ADJOURNMENT: The hour being ll o~clock P.M., it was moved by Councilman
Riesland~ seconded by Councilman Koester~ and carried~ the meeting be adjourned
sine die.
