The Council met in regular seeelon, in the Council Chamber of the City Hall, on the above shown date, with Mayor Brown presiding. Meeting called to order at ?:00 o'clock, p. ~. Present: Mayor Brown, Councilmen How~, Rite and Boltz. Absent: Councilman Lyons. MINUTES OF...l~0gB I~.. ~'ING: The minutes of the regular meeting of December 7, 19~6, having been prepared and mailed to each member of this Council by the City Clerk, were approved as prepared and mailed. FIRE ~ARTMENT' .BA~: The clerk read a letter, from Pat Robiso- who is Chairman of the Fire Department D~uce Cormmtttee, requeating permission to hang a street banner across Third Avenue Just North of F Street for a period of ten days prededing Yanuary 2~rd which is the date o~ the Fire Department's Annual Dance. Upon motion by Cl. Howe, seconded by Cl. Boltz, which carried, the request was granted. ORDINA~,,OE No. 2§9: Upon motion by Cl. Boltz, seconded by Cl. Rife, which carried, Ordinance No. 2~$ was placed on it's second ~n~ final reading. The Title of the ~rdin- anee was read and the (~rdinance was in the exact form as when given it's first reading at the meeting of this Council, held Decmnker 7, 1956. It was passed adopted and appr- oved, as read, by the following vote, to-wit: ATES: Gl. Howe, Rife, Boltz and Brown. NOES: None. ABS~: Cl. Lyons. Cl. Lyons entered the Council Meeting at this time. STATE RE(NYLAT,ION AND CC~TROL OF , ,S~RDIN~, Fr.~mm~y: Upon motion by Cl. Howe, seconded by Cl. Boltz, which carried, this Council endorsed the initiative measure to be submitted to the Legislature, designed to re-establish the State's Constitutional right to regulate and control the sardine fishery. ~'S ANNUAL REI:ORT: The clerk read the Annual Report of the League of California Monicipalities' whieh pointed out the more important services that the League had ran&areal. The opinion of the Oouncil seemed to be that the League was doing a very good service to the Cities and that this City should continue to participate as a member. FIRE ,HYDRANT ON ,I ST.. B~.wm~u~ 5TH & STM. The clerk read a letter from Re L. L~Aeller requesting that when a fire hydrant be placed on I Street that it be placed half way between §th and $th Avenues instead of at the corner of 6th Avenue and I Street, due to the fact that it would be nearer the houses for which it wou~d serve and also be mash higher for better force. Upon motion by Cl. Howe, seconded by Cl. Rife, which carried, the matter wes left to the Fire Co~,.~ssioner with power to act. DIP AT SEO. OND A?ENUE AND Y ~'~=~,.: Cl. Rife reported that the culvert at second avenue and $ street is not ~large enough to take ca~e of the run-off of said streets when a heavy rain comes and recow..~nded that a dip be put across ~econd Avenue to better hand~le run-off and as Y street is a Stop street it would not interfere with traffic. Upon motion by Cl. Bolt~, seconded by Cl. Lyons, which carried, the matter was left to the Street Ccm~uissioner with po~r to act. FLETCHER AND ,~A'F.~AM C ,00?~, ~-','H L~.GUE P~AQ~ATIV~-q: Cl. Lyons offered Wd Resol~ti. qn No., .4~. which is a resolution requesting Hon. Fletcher and the Hon. Charles W. Stream to give their freindly co-operation and support in hearings, consultat- ions and proceedings having to do with the interests end needs of the city of Chula Vista. The Resolution wes read and upon motion by Cl. Boltz, seconded by Cl. Lyo$s. was passed and a~opted as re~d by the following Vote, to-wit: AYES: Cll Boltz, Brown, Howe, Lyons and Rife. NGES: None. Lyons offered Resolution No. 465a, which is a resolutEon accepting, for street purposes for Third Avenue, the following property: the Easterly 10 feet of LoS 10 in Block D of Thompscm's Subdiv- ision from Mae H. Soper, the Easterly 10 feet of Lot 9 in Block D of Th~pson's Subdivision from Marcia E and Hex'lan P. Thon~son, The Easterly 10 feet of the Northerly 50 feet of the Southerly 195 feet of the Easterly 125 feet of Lot 7, Qua~ter Section 1~? from $. Calvin and ~-~gie May Lauderbach. The Resolution was read and upon motion by Cl. Boltz, seconded by Cl. Howe, was passed and adopted as reaA by the following vote, to-wit: AYES: Cl. Boltz, Rrown, Howe, Lyons smd Rife. NOES: None. ABSENT: None. / CHANNEL 0~G ,APPROVED: Theclerk read an agreement between the owners of the East one-half of the Southwest one-quarter of Quarter Section 16~ amd the City of Ohula Vista, said agreement specified that the City is to cut a channel through said property from the culvert on H Street to the culvert across the right of way of the ~an Diego & A~izona Railway; said ditch to be a plain, open ditch without any masonry, pipe, concrete, or tther ~mDrovement whatsoever; and all material removed from said ditch to be deposited on the South side of said ditch for its entire distance; the City not to be responsible in any way whatsoever and the owner to maintain said ditch in good repair from and e_eter its completion. Cl. Lyons offered ,Resolution No~ 469, which is resolution approving the above agreement. The Resolution wes read and upon motion by Cl. Boltz, seconded by Cl. Howe, was passed and adopted as read by the following vote, to-wit: AYES: Cl. Boltz, B~own, Howe, Lyons and Rife. NOE~: None. ~: None. (~OUP,, ~: The City Attorney gave his opinion on the legality of City Group T~aU~ance in California and stated that ~e felt that, even though it had not been taken to the courts, that it would be held legal as long as none of the elective officers participated, and as long as ?5% of the eligible employees participated. Mr. M~rrill, of the Travelers InsuranoA Co. stated that the rates that he had quoted would be guaranteed for a period of five years. The Council instructed Mr. Merrill to sign up as many applicants as possible and to get the exact rate and present the data at the next meeting of the Council by which time the Council would have had time to give the prop- osition thorough consideration. LICE~S~: The City Attorney gave a report on our present license ordinances and pointed out ceetain had features that existed with the present fees and mentione~ other businesses that were not covered by our ordinances. Geneeal discussion, by the Council and City Attorney, brought to light other bad features that existed and that should be corredted. The City Attorney, with the consent of the Council, stated that hewould draw up a new ordinance broadening the scope and equalizing the licenses. · PA RESOLUTION No. 2: Cl. Rife brought to the attention of the Council a request frc~ the League of California l~Anicipalities for the Council's endorsement of Resolution No. ~. on I~PA which request the federal govornm~ut to re&ognize its responsibility for the relief of the mmemployed . Cl. Howe stated that he felt that as long as everyone was urging the federal government to balance it's budget it would not be feasible to urge or expect them to put into effect the said resolution. The concensus of opinion seemed to he the same with the other Council~n and the matter was tablede ~IODICAL REPORTS: The monthly reports of the City tudge, the Fire Department and the Police ~epartment for the month of December and the November and December report of the City Treasurer were ex~mfued and ~rdered filed. CITY ENG~ REPORTS: The City Engineer reported that hte street sign at National Avenue and E Street was being turned on by the Police and that the clock had been retatrned to the Copper Shop. He also stated that the Airport work was still progressing end would have more information for the Council at the ne~t meeting. SCHOOL BI~ RE~E~-A'w.,,: The clerk read a letter from Y. Calvin Lauderbaoh stating that the Board of Trustees of the Chula Vista Union ~chool had rejected all bids and had withdrawn the property from sale. LIGHT TRUCK Bi'D: Upon motion by Cl. Lyons, seconded by 01. Howe, which carried, the Street Department was authorized to purchase a pick-up model trnek within one- half ton ranges the City Clerk was instructed to advertize f~ same with said bids to be filed with the city clerk on or before 4:~0 P.
