Councilmen Riesland, Nashold, Kidder. Absent: Councilmen Koester end Dyson. Mayor Koester being absent frc~ the meeting, it was moved by Councilman Kidder, seconded by Councilm-n Nashold, and carried, that Councilman Riesland be appointed Mayor pro tempore to serve during the absence of Councilman Koester. PEP~ISSION TO LEAVE STATE - Councilman Kidder 0ouncilman Kidder requested permission to leave the State fram September 21st through September 2$th, 1949. It was moved by Councilm~n Nashold, seconded by Council- man Riesland, and carried, that permission be granted. ~RESOLUTION NO. 1064 - Filing of Charter Offered by Councilmsu Nashold, read in full, passed, adopted, and approved by the following vote to-wit: AYES: Councilmen Nashold, Kidder, Riesland. NOES: No n e. ABSENT: Councilmen Koester and Dyson. T. A. FORBES The City Engineer had been instructed to investigate the sewer in an easement in the rear of Mr. Forbes property, and report back to the Council. Mr. Gierlich re- ported to the Council that the only way to determine whether or not settling is being caused by a hole in the sewer pipe, would be to dig down to the sewer pipe and check. The estimated depth of the sewer is 16 feet. Mr. Gierlich suggested that 4 feet of the top material should be taken out and tmnped with heavier material. It was moved by Councilman Nashold, seconded by Councilman Kidder, and carried, that the City Engineer investigate the feasibility and determine the cost of connecting the Parkway sewer with the 1911 District sewer now being installed at Fifth Avenue and Parkway. DIVISION OF RIGHNAYS - Acquisition of property for Montgomery Freeway Mi', John Co Putzer, Right of Way Agent for the Division of Highways, appeared be- fore the Council to request ~hem to authorize the proper officials of the City to exe- cute a grant deed end contract attached to a map and letter from him. After discuss- ion, it was moved by Councilman Kidder, seconded by Counc~lm~n Nashold, and carried, that the proposed contract between the State Highway and the City of Chula Vista be approved and the City Clerk end ~ayor authorized to execute same when the City is pre- sented with an easement ingress end egress connecting the City Dump Property with D Street in exchange for an easement to be granted by the City of Ohula Vista to the Santa Fe Land Improvement Company over the City Dump Property. RECORD OF SURVEY - Twin Oaks Avenue Mr. Lawrence, representing Mr. B. Phelps, presented a record of survey with the changes as suggested by the Council at their last meeting. It was moved by CouncilmA~ Nashold, seconded by Councilm~u Kidder, and carried, that the record of survey be ac- cepted subject to the approval of the City Engineer end subject to the execution of the usual contract for improvements with an escrow deposit to be substituted instead of a surety bond° ~TnmATR~ GUILD - Financial report Mr. Keith Atherton presented the financial report of the Theatre C~ild, which indicated the Theatre Guild had gone into the red $108.00 on the Rose of the Rancho production. It was suggested that Mayor Koester appoint a cc~mnittee from the various veteran's organizations to determine the location, design, and names to be inscribed on the pla- que at the Memorial Bowl. ~COVARriLL0 TRACT SEWERS The City Engineer stated to the Council that on the original plans, I~r. Morris was to construct sewers in the rear of the lots on First Avenue between H Street and I Street. Since Claire Vista Subdivision is running a line in the center of First Avenue, Mr. ~,~orris weuld like to hook onto that sewer and then run the sewer on down First Avenue from between H Street and I Street on down to H Street. It was moved by Councilman Nashold, seconded by Councilman Kidder, and carried, that the subdivider of Covanillo Unit No. i be granted permission to change the position of the sewer abutting lots 29 to 38 inclusive from the rear of said lots to the center of the ad- jacent street. HOES: None. ABSENT: Councilmen Koester and Dyson. ~RESOLUTION NO. 1067 - Accepting Notice of termination of lease to State of California, Armory Site. Offered by Councilman Riesland, read in full, passed, adopted, and approved by the following vote to-wit: LYES: Councilmen Riesland, Nashold, Kidder. NOES: None. AB~f: Councilmen Koester and Dyson. ~RESOLUTION NO. 1068 - Submitting to the Electorate an Ordinance to amend the initia- tive Civil Service Ordinance of the City of Chula Vista Offered by Councilman Nashold, read in full, passed, adopted, and approved by the following vote to-wit: LYES: Councilmen Nashold, Kidder, Riesland. NOES: None. ABSEnt: Councit~n Koester and Dyson. POLICE DEPARTmenT - Employment of two new officers It was moved by Counc~l~n Kidder, seconded by Councilman Nashold. and carried, that the hiring of Bart Kendall and lames Walker by Chief of Police Taylor be confirmed. CHAMBER OF COI~IERCE - Request for funds The City Administrator read a letter from the Chamber of Com~nerce requesting funds from the City. It was moved by Councilman Kidder, seconded by Councilman Nashold, and carried, that the matter be referred to the City Attorney to draw up a contract between the Chamber of Co. narcs and the City providing for payment by the City to the Chamber of Cormnerce of $3,600.00 for one year in consideration of services by the Chamber of ~o~mnerce for promotion and advertisement of the City of Chula Vista. ORDINANCE NO. 410 - Amending Ordinance No. 371 - Sales Tax It was moved by Councilm~n Kidder, seconded by Counc~l~n Nashold, and carried, that Ordinance No. 410 be placed on its first reading. The Ordinance was thereupon read in full. ~~ORDINANCE NO. AC9 - Regulating Auctions It was moved by Councilman Nashold, seconded by Councilman Kidder, and carried, that Ordinance No. 409 be placed on its second reading. The title having been read, and the Ordinance being in the same form as when placed on its first reading, it was moved by Councilman Riesland, seconded by Councilman Nashold, and carried, that the reading of the text be waived. The Ordinance was passed, adopted, and approved by the following vote to-wit: AYES: Councilmen Riesland, Nashold, Kidder. NOES: None. ABSENT: Councilmen Koester and Dyson. The City Administrator read a letter from the Chamber of Commerce recom- mending passage of the above Ordinance. ~EWE,RS - Tx.,~k Line After examination by the entire finance cormmittee and approval of the Council, it was moved by Councilman Kidder, seconded by Councilman Nashold, and carried, that ~arrant No. 1326 in the amount of $7,298.71 to Charles J. Dorfmen be paid. SAN FRANCISCO LEAGUE C01~EI~ION It was moved by Counc~lw~n Riesland, seconded by Councilm~ Nashold, and carried, that the City Attorney and Mayor Koester be authorized to attend the League of Calif. Citi~e convention in San Francisco. ~t'HANGE 0RI~R NO. 4 - Trunk Sewers Administrator Bryant explained to the Council that when the C Street pumDi~g plant was installed by Mr. Dorfman, the City thought it advisable to have a casi=g installed in order that the stream of water exposed by the excavation might be eon- vetted into a well for future use. The City agreed to pay a reasonable cost for this extra work which is covered by this Change Order No. · in the amount of $200. It was moved by Council=~n Kidder, seconded by Council~n Nashold, and carried, that the above change order be authorized.
