HomeMy WebLinkAboutcc min 1948/12/14 MINUTES OF REGULAR MEETING OF TME CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA - Held Tuesday December 14, 1948 The Council met in the Council Chambers of the City Hall on the above date, at ?:00 o'clock P. M. with the following members present: Councilmen: Riesland, Nashold, Dyson, Kidder. Absent: Councilm~ Koe stet. Mayor Koester being absent, it was moved by Councilman Riesland, seconded by Counci!~.B Nashold, and carried that Councilman Kidder be appointed as Mayor pro tempore to serve during the present absence of Councilman Xoester. BNJM PAID After examination by the entire Oouncil and approval of the finance cormnittee, warrants ~66 to §42 were voted to be paid to-wit: AYES: Councilmen Riesland, Nashold, Dyson, Kidder. Noes: None. Absent: Council~n Koester. RESOLUTION NO. 981 Councilman Rieslemd offered resolution no. 9@1 accepting easement fromM rs. Virginia Black for a portion of Gerrett Street for street pur- poses. The resolution was read in full, passed, adopted and approved by the following vote to-wit: AYES: Councilmen Riesland, Nashold, Dyson, Kidder. Noes: None. Absent: Councilman Koester. RESOLUTION NO. 982 Councilman Nashold offered resolution no. 982 accepting an easement for sewer lines (Perry). The resolution was read in full, passed, adopted and approved by the following vote to-wit: AYES: Councilmen Riesland, Nashold, Dyson, Kidder. Noes: None. Absent: Councilman Koester. k~RESOLUTION NO. 983 Accepting deed for street purposes (Raney). This reso- 'lution was offered by Counci~n Riesland, read in full, passed, adopted ~nd approved by the following vote to-wit: AYES: Councilmen Riesland, Nashold, Dyson, Kidder. Noes: None. Absent: Councilman Koester. RESOL~i'ION NO. 98~ Accepting dedication of property for the westerly pro- longnation of Chula Vista Street (Scott). This resolution was offered by Council- man Riesland, read in full, passed, adopted and approved by the following vote to-wit: AYES: Councilmen Riesland, Nashold, Dyson, Kidder. Noes: None, Absent: Oouncilman Koester. ~RESOLUTION NO. 985 Councilman Kidder offered resolution no. 985 rejecting claim for refund for certain taxes (B. nk of America et all. The resolution was read in full, passed, adopted and approved by the following vote to-wit: AYES: Councilmen Riesland, Nashold, Dyson, Kidder. Noes: None. Absent: Councilman Koestero BRIGHTWOOD ~VJ~Ey CLOSING There having been a request to close the alley lying on the easterly side of Brightwood Subdivision and City Engineer Foster having been requested to investi- gate same, the Clerk read a recozmmendation from Mr. Foster, in which he stated that in hi~ opinion the alley should not be vacated. After discussion it was thereupon moved by Councilman Nashold, seconded by Councilman Kidder and carried that the report be tabled. Mr. Bryant read 2 letters to the Council from the Fire Chief requesting auth- ority to install three new fire hydrants end move one fire hydrant. It was moved by Counci]m,~ Riesland, seconded by Councilman Dyson and carried that the request be granted. ~KEARE~EY ~I'HEET Mro Bryant read a letter to the Council from Robert E. Tyson requesting the City to oil a Z0 foot strip south of Kearney Street running east of Second Avenue and accept some as a street providing the property owners would install concrete curbs emd gutters and deposit with the City a sum of money sufficient to pay for the necessary oil. It was moved by Counc~l-~n Rieslaud, seconded by Councilman Nashold and carried that the request be granted according to the terms of Mr. Tyson's letter. Mr. Bryant read a letter to the Council from Mr. Arthur L. Lynds, representing Hobart Homes, Inc., requesting the City to waive the requirements as set forth in the improvement plan of Tecumseh Park for the paving of the 8 foot strip between existing pavement and gutter. If the City would grant this request then ~r. Lynds stated that they would deposit with the City a sum of money suf- ficient to pey for the oil providing the City would oil the street at the most convenient time. It was moved by Councilman Nashold, seconded by Ooomcilman Dyson and carried that the request be granted and that the City agree to oil the street in accordance with Mr. Lynds request. AZTEC TRANSIT LINES - NOTICE 0F HEARING City Attorney Boyer advised the Council that a public hemming would be held by the Public Utilities Comission on December 16 to hear interested panties for or against the formation of the Aztec Transit Lines. After discussion, it was moved by Councilman Nashold, seconded by Councilman Dyson and carried that the Council go on record es favoring the establishment of such a public service. DEL ~&~_RAVEIEIE 0PEggiNG Administrator Bryant requested the authority to proceed with the acquirement of that undedicated portio~ of Del N~r Avenue lying t~m~diately sOUth of "E" Street. He stressed the danger of the narrow street as it exists and explained that negotiations thus far had failed. It was moved by Councilman Nashold, seconded by Counc~lm~n Riesland and carried that ~. Bryant be authorized to proceed with negotiations and condemnation if necessary. CARD ROC~APPLICATION Mr. Nathan Peters requested permission to move the Card Room from its present location on National Avenue to a location on Center Street in the Ferrantelli Building. The Clerk was instructed to notify the Pastors of the Churchs in thet vicinity in order that they might enter any protest if they so cared. The matter was deferred until the next meeting. Councilman Rlesland left at this time 8 P. ~. ~WATERPi~NG City Attorney Boyer advised the Council thet he had attended a public hearing of the Public Utilities Conm~ission at which a request for services of water from the Sweetwater Lake by a farmer had been considered. M~. Boyer stated on behalf of the City he had protested the granting of such a service on the grounds that it would come from water rightfully allocated to the City of Chula Vista. After discussion it was moved by Councjlm~n Nashold, seconded by Councilman Dyson and carried that Mro Boyer's action be ratified. WARREN TRAILER COURT Mr. R. Warren of Orange Avenue appeared before the Council to protest the action taken by the Planning Commission in denying his application for a trailer court on his property. A number of property owners of the vicinity were present and a lengthy discussion followed which wo~Rere~ far away from the issue at hand. City Attorney Boyer stated that apparently nothing was to be gained from discussion at this time and that Mr. Warren had the right of appeal to the Council at a later date if he so desired. lmER~T~SION TO LEAVE STATE City Attorney Albert C. Boyer requested permission to leave the State for fourteen days beginning Dec~mber El, 1948. It was moved by Counc~l~-n Dyson, seconded by Councilmau Nashold and carried that permission be granted. PLANITING C01~ISSION MINUTES Deferred to next meeting. ADJOUR~NT: Upon motion by Councilman Nashold, seconded by Councilman Dyzon, which carried, the meeting was adjourned to ? P.
