HomeMy WebLinkAboutcc min 1948/12/22 MINUTES OF AN ADJOURNED REGULAR MEETING of the CITY COUNCIL OF THE CITY OF 0HULA VISTA, CALIFORNIA - Held Wednesday December 22, 1948 The Council met in the Council Chambers of the City Hall on the above date at 7:00 o'clock PoM. with the following members present: Councilmen: Eoester, Rlesland, Nashold, Dyson, Kidder. ~Cg.RD RO0~APPLIC~.TION Mr. DeWitt A. Hlggs, representing Mr. Nathan Peters, asked the City Council to delete certain sections of Ordinance No. 369 pertaining to Card Rooms. It was pointed out by Mr. Higgs that moving the Card Room from National Avenue to Center Street would not increase the number of Card Rooms in Chula Vista but only have them more centrally located, thus simplifying the policing problem. Mr. Higgs said that upon personal contact by ~. Peters with the surrounding Churches, there had been no objection on their part of a card room going in the location on Center Street. Mr° Fr~k lmadgett, operator of the Pastime Card Room, objected on the grounds that when he invested in the store he now owns it was with the understanding that the City had an Ordinance protecting him against other card rooms opening up in the immediate vicinity. Council- man Koester pointed out that our Ordinances are made to protect businesses and citizens and if we are going to constantly be changing them there is no real reason to have them in the first place. After much discussion pro and con, motion wag made by Oouncil~ Koester, seconded by Councilm~n Riesland, and carried, that the request be denied. Councilman Kidder stated that he did not went to vote. BIVJ~ PAID ~ftar examination by the entire Council and approval of the finance cormmittee, warrents 544 through 547 were voted to be paid to-wit: AYES: Councilmen Koester, Riesland, Nashold, Dyson, Kidder Noes: None Absent: None BIDS FOR CURB AND G~TTER ON BEECH ST~T ~ity Engineer Harold Foster submitted bids for the construction of approximately 290 feet of standard curb and gutter on the westerly side of Beech Street immediately north of "F" Street. The bids were as follows: John B. Henry $ 1.50 per lineal foot Glen Gilbert $ 1.50 " " " Roland Lozano $ 1.25 " " " Upon motion made by 0ouncilman Riesland, seconded by Councilman Dyson, and carried, that the lowest bidder be given the contract for these curbs and gutters. Mr. Foster was instructed to notify Mr. Lozano of the Councils decision. BONITA PARK N0. 2 - Final Map Mr. Henry Algert submitted a final map of Bonita Park~e~nd, on motion by Council- man Nashold, seconded by Councilman Riesland, and carrl~d~ject to execution of an a~eement with the subdivider and filing of a bond sufficient to ensure the performance of improvements. Streets are not to be put in until approved by the City Engineer. ~RESOLUTION NO. 986 - APPROVING AGHE~NT FOR THE CONSTRUCTION OF I~PROVEMEh~S (Bonita Park No. 2) Councilman Nashold offered resolution no. 986. The resolution was read in full, passed, adopted, and approved by the following vote to-wit: AYES: Councilmen Nashold, Dyson, Kidder, Koester, Riesland Noes: None Absent: None MARIE M. HATZ SUBDIVISION - Tentative Map It was moved by Councilman Dyson, seconded by Councilman Koester, and carried, that the tentative Map of Marie M. Hatz Subdivision, heretofore approved by the Planning Cormnission, be approved subject to improvements required by Section 7 of the Sub- division Ordinance and moreparticularly set forth on an improvement plan for said subdivision on file with the City Engineer. NAP~EM. HATZ SUBDIVI~ION - Final Map It was movsd by Councilman Rlesland, seconded by Councilman Nashold, and carried, that the final map and improvsment plans of the Marie M. Hatz Subdivision be ac- cepted upon the execution by the owner of a sontract with the City of Chula Vista for the installation of improvements and the posting of a bond guaranteeing the perfonmance thereof which contract and bond shall be first approved by the City Attorney as to form and legality. ~'REsoLUTION NO. 98? - APPROVING AGF~EI~ENT FOR THE CONSTRUCTION OF IMPROV~ENTS (Marie M. Hatz Subdivision} Councilman Kidder offered resolution no. 98?. The resolution was read in full, passed, adopted, and approved by the following vote to-wit: AYES: Councilmen Kidder, Koester, Riesland, Nashold, Dyson Ncc s: Non · Ab sent: None NO. - ACCEPTING DEDICATION FOR STREW1' PURPOSES, ~CH ST~T RESOLUTION 988 (Chula Vista Investment Company) Was offered by Councilman Koester, read in full, passed, adopted and approved by the following vote to-wit: AYES: Councilmen Koester, Riesland, Nashold, Dyson, Kidder Ncc s: None Absent: None %RESOLUTION NO. 989 - ACCEPTING DEDICATION FOR ~r~T PURPOSES, GAR~rT AVENUE (Leach) Councilman Dyson offered resolution no. 989, it was read in full, passed, adopted, and approved by the following vote to-wit: AYES: Councilmen Koester, Riesland, Nashold, Dyson, Kidder Noes: None Absent: None %HESOLUTION NO. 990 - ACCEPTING DEDICATION FOR STREET PURPOSES, ~?J.Ey (Samuel Copeland,Jr.) Councilman Nashold Offered resolution no. 990, it was read in full, passed, adopted, and approved by the following vote to-wit: AYES: Councilmen Nashold, Dyson, Kidder, Koester, Riesland Noes: None Absent: None RESOLUTION NO. 991 - APPROVING AGt~mm,~ENT FORM~2~fENANCE OF STATE HIGHWAY Was offered by Councilman Riesland, read in full, passed, adopted and approved by the following vote to-wit: AYES: Councilmen Riesland, Nashold, Dyson, Kidder, Koester Noes: None Absent: None /AG~Ek~ FOR OILING (Lee and Leschorm) Mr. Bryant read a letter from Lloyd L. Lee with reference to finishing the unpaved portion of streets bordering the property on the northwest corner of First and "J" Streets. They requested permission to pay the City for oil needed before their bond expired. Motion was made by Councilmen Riesland, seconded by CouncilmanDyson, and carried, that the Council go on record as being favorable to such au agreement. ~[OHANGE ORDERS - SEWER TREATI~NT PLANT ~City Engineer Harold Foster read a letter from Kistner, Curtis & Wright requesting changes to the original plans and original contract price. It was moved by Council- man Riesland, seconded by Councilman Nashold, that City Engineer Harold Foster, be authorized to sign a change order to conform with above mentioned proposal. ~iCHRISTMASAND NEW YEAR'S HOLIDAY Motion was made by Councilman Nashold, seconded by Councilman Dyson, and carried that City employees be granted 1/2 day leave December 24th and 1/2 day leave December 3lst. ADJ Upon motion by Councilman Nashold, seconded by Councilman Rtesland, which carried, the meeting was adjourned to 7:00 o'clock P.M. January ll, 1949.
