U. with the following members present: Councilmen Koester, Riesland, Nashold, Dyson, and Eidder. ABment: None. ~TJTPATIVE MAP - Grihalva place Yt was moved by CouncilmA- Riesland, seconded by Council~- Dyson, and carried, that the tentative map of Grihalva Place Subdivision, heretofore approved by the P]~-~ing Commission, be approved subject to improvements requ~rad by Section 7 of the Subdivision Ordinance. It was noted that the conditions required by the Planning Oo~niasion had been cemplied with. SEWER CONTRACT - Sewer Plant ~he City Clerk read a letter from Kistner, Curtis & Wright rec~mnending the acceptance of the new Sewer Plant and requesting an extension of time to May 31, 1949. The Sewer Plant was accepted by Resolution No. 1029 hereafter referred to, and extension of time to complete work was extended to Suns 6, 1949. The City Clerk read a letter from $. W. ttuntley, Contractor of the Sewage Disposal Plant requesting that the City accept the Job. ~i~SOIX2PYON NO. 10~.9 - Accepting work of Contractor in the Construction of a Sewage Treatment Plant and directing the exeantion of a notice of completion, and ex%ending time for completion to Yune 6, 1949. Resolution No. 1029 was offered by Counci~m~ Nashold, read in full, passed, adopted, and approved by the following vote to-wit: AYES: 0ouncilmen Neshold, Dyson, Kidder, Koester, Riesland. NOES: None. ABSENT: None. CH~zH~-~ OF C~R~E - Request for money from the City of Chula Vista to meet their 1949 proposed budget. Mr. William Eckhart, President of the ChAmHer of Commerce, presented a proposed budget for the Council' s study° The ~,,mher of 0onm~rce will need appro- ximately $6,000.00. The Council told ~. ABSENT: None° NO. 1030 - Bonita Park Sewer Reimbursement 0ontract. Approving contract between Arthur Do Uecker and Fern D. Uecker and the City of Chula Vista providing for reimbursement for a portion of the costs of installation of certain laterals. No. 1030 was offered by Councilman Riesland, read in full, approved by the following vote to-wit: Riesland, Nashold, Dyson, Kidder, Koester. Mr. Ac D. uecker r~quested that the Council make a definite co-~tment as to the policy of the City regarding the acceptance of the ~E~ Street booster line East of Second Avenue. The Council agreed to make a decision, after further investigation, at the regular meeting of Yune 14, 1949. HESOLUTION NO. 1031 - Denying claim for damages of Gladys Mathews. Resolution No. 1031 was offered by Oounci~"~- Koester, read in full, passed, adopted and approved by the following vote, to-wit: AYES: Councilmen Koss,tar, Riesland, Nashold, Dyson, Kidder. NOES: None. AB~: None o Br~.TR PAID Warrants 977, 980 and 981 having been approved by the Finance Cc~m, fttee, were examined by the entire Council and ordered paid by the following vote, to-wit: AYES: Councilmen Kidder, Koester, Riceland, Nashold, Dyson. BAY VISTA STIBDA¥iSION The City Clerk read a letter from Mr. Warren Thomas requesting an exten- sion of time to Sune 1, 1950, for the installation of improvements in this sub- division, for the reason that it is expected that sewer facilities will be avail- able by Yune, 1950. Motion was made by Counc~l~.-~ Kidder, seconded by Councilm~- Dyson, end carried that such extension be granted. NOES: None. ABSENT: None. RESOLUTION NO. 1025 - Naming Flower Street. Resolution No. 1025 was offered by Councll~n Nashold, read in full, passed, adopted, and approved by the following vote, to-wit: AYES: Couneilmen Nashold, Dyson, Kidder, Koester, Riceland. NOES: None. ABSENT: None. SANITARY SEWER WORK (1911 AOT) Mr. H. C. Vanden Bossche presented Plan No. 1-1949, Specifications No. 1-1949 and Map of Assesament District No. 1-19Ag, together with his letter of transmittal containing estimated coot of work. RESOLUTION NO. 1026 - Approving plans and ~pecifications for sanitary sewer work. Approving assessment district map, end requesting recommen- dation of Health Officer. Resolution No. 1026 was offered by Oounci~m~u Koester, read in full, passed, adopted, and approved by the following vote, to-wit: AYES: Councilmen Koester, Riesland, Nashold, Dyson, Kidder. NOES: None. ABSENT: None. FINDINGS OF HEALTH 01~FICER The Council ordered the following letter to be set forth in full in the minutes. Sune ?, 1949. Chula Vista, California Gentlemen: I, the undersigned, Health Officer of the City of Chula Vista, California, am familiar with the plans, designated "Plan No. 1-194~," and the specifications, designated -Specifications No. 1-1949," and "Map of Assessment District No. 1-19497 all as heretofore approved by the City Oounail of the said City of Chula ViSta. I understand that proceedings under the "Improvement Act of 1911," Division 7 of the Streets and Highways Coda of the State of California, are~eow- templated for the construction of sanitary sewers, as shown on said plans and specifications. I am familiar with the territory to be served by the proposed sewer system shown on said plans and specifications. Said territory is in dire need of sanitary sewers and the public health requires that sanitary sewers be constructed to serve it. ~ finA and reco~mnend as follows: 1. That the construction of sanitary sewers, as shown on said plans and in accordance with said specifications, is necessary as a health measure. 2. ABSENT: None. ~ESOLUT~0N NO. 1028 - Declaring its intention to order the construction o~ certain sanitary sewers and appurtenances end appurtenant work in the City; Declaring the work to be of more than local or or- dinary public benefit; Describing the district to be bene- fited by said work and to be assesasd~to pay the cost and expense thereof; Detez~nining that bonds s~all be issued to represent assessments to be levied; and fixing the time and place for hearing protests and objections to said work or the extent of the district to be assessed, or both, ~nd giv- ing notice thereof. NOES: None. AI~'E~: ~one. EX~EE~ION OF $~D AVENU~ MI'. C. B. 0fferman appeared befor~ the Council to suggest ch~n~as in the plans for the proposed 3rd Avenue extension. After discussion, it was suggested by Councilman Koester that the City Engineer, the 0ity Council, a~d Mr. 0fferm~,~ look at the proposed street together, ~ONOIEANCE N0. 402 - Streets - relating to cutting of streets, procedure for posting bond, franchises, and other matters. It was moved by Councilman Eidder, seconded by Counci_l~n Dyson, and car- ried that Ordinance No. 402 be placed on its second reading. The Ordinance being in the exact form as when placed on its first reqding, and the title having been read in full, it wes moved by Councilman Dyson, seconded by 0ouncilman Eldder, and unanimously carried that further reading of the text be waived. The Ordinance wes then passed, adopted, and approved by the following vote, to-wit: AYES: Councilmen Dyson, Kidder, Koester, Riesla~d, Nashold. NOES: Nane. ABSENT: None. ~OI~DINANCE NO. 403 - Parking limited on certain streets. It was moved by Councilman Nashold, seconded by Councilman Riesland, and carried that 0rdin~nce No. 403 be placed on its second reading. The Ordinance being in the exact form as when placed on its first reading, and the title having been read in full, it was moved by Oounc~lm~ Kidder, seconded by Counci~m~ Riesland; and unanimously carried that further reading of the text be waived. City Attorney Boyer asked if the Council would be in favor of buying a transcript of the last water rate hearing before the Public Utilities Ocmw. tssion. He had bean advised by Mr. S. B. Robinson, Attorney, that it wauld probably be worthwhile to have this transcript, in case there are further proceedings in the rate matter. Motion was made by Councilr~n Riesland, seco~ed by Councilman Kidder, and carried, that the transcript be purchased. ~2~MISSION TO ?.W~E STATE Counci~ma~ Kidder requested permission to leave the State from Yune 15th to Yuly 10th, 1949. It was.moved by Councilman Dyson, seconded by Councilman Nashold, and carried, that pax-mission be granted. The City Clerk read a letter from the City E~gineer enclosing petitions for an improvement district for Gerrett Street signed by interested property Owners. After discussion, the matter was tabled.
