The Council met in the Council Chambers of the City Hall on the above date at ?:00
o'clock P. M. with the following members present:
Councilmen Koester, Riesland, Nashold, Dyson, Kidder.
Absent: None.
It was moved by Councilm-m Nashold, seconded by Counc~lw~ Rleslend, end carried,
that the minutes of Council Meetings held Suns 14th, 21st .r~ 2Sth, be approved.

The Nayor announced at 7:30 o'clock P. M. that this is the time end place fixed by
the City COuncil for hearing objections o~ protests, if say, concerning the sanitary
sewer work or improvement and proceedings under the Resolution of Intention, Resolution
No. 1037, adopted on Sune 14, lg49. He also asked that the City Clerk present affida-
vits of publication, posting and --f. ling in such proceedings. The City Clerk presented
affidavit of re.t ling notice respecting such prOceedings, affidavit of posting notice re-
specting such proceedings and affidavit of publication of said Resolution of Intention,
Resolution No. 10~?. It was then regularly moved by Councilman l~eslend, seconded by
C~ncilman Dyson, anti carried, that the affidavits as presented be approved and placed
on file.
The Me, or then asked the 0ity Clerk if any w~itten protests or objections had been
filed regarding said work and proceedings under Resolution No. 1037. The City Clerk pre-
sented all the written protests or e~ications which had been filed with hi~. Written
protests of objection were read from Oscar F. Waisgerber, C. B. Offers-n, Mr. -~ Mrs.
Lloyd A. Wells, Mr. and Mrs. Marvin R. Waveman, Mr. and Mrs. Leroy M. Yones, and Lt.
Charles L. Coleman for Donald H. Col~.~. After the reading of each protest the Mayor
asked if anyone present wished to be heard in support thereof. No one indicated a desire
to be heard in support of the protests. The Mayor then asked if there were say verbal
protests, or if anyone desired to be heard respecting said proceedings or work, or on say
matter relating thereto.
No one offered a protest or objection hilt the following persons made statements or
asked questions.
I~. Watkinenn, 164 ~not Avenue. I would like to know whether the sewer is going to
come in the alley between 2nd and ~not and Minot Avenue. I do not went to pay for ~wo
sewers. The question was referred to City Engineer Foster.
Cdr. Farrell, ~81 D Street. How deep is sewer going to be in D Street? Ans. 8 feet.
lit. Tumey, 69 llinot Avenue. I have Just recently put in new cesspools. We pay the
assessment for the sewers but is it necessary to hook onto the sewers iz~aediately? Ams.No.
Mrs. Y. P. ,~m~th, Casse~m-- & ~mlth Streets. The new sewer is cc~ing down .~mtth
Street and Oasselw~n Street. Will I be assessed on both Streets? Ans. You will be asses-
sed for your total frontage less the average percentage of the depth of all l~ts in the
assessment district.
Mr. Michal Valen, 456 E Street. How will this assessment be put into effect? Does
everyone have to pay for the frontage, or over a general tax fund? Ans. You are given a
time limit to pay, then it is turned into a bond. Approximately $4.00 per front foot.
Is there any saving by paying cash? Ans. If it all goes cash, it will be quite a
bit cheaper. You will save approxin~taly 6 months interest.
Mr. Barton. We are having a hearing tonight on whether or not the work should he
done. The Council will hear any protests. Assuming they decide to go on and order the
work, they will let bids. The bids will be let to the lowest responsible bidder. That,
with the incidental expenses will be combined end an assessment over the entire assesimaent
district and each share will be assessed for the benefit that each parcel will get. Then
e hearing will be held on the e~ou~t of assessment. Then the assessment is made final
recorded. At that time, they may pay in cash and if not in cash in $0 days, it will then
go into bo~xl. Bonds will bear the rate of 6~ interest and be payable semi~-ually. It
will bear the description of the property and interest. The bond will go over a period of
10 yee~s with payments of principal paid each year. The first payment will probably be
~anuary 2, 19~1. Bonds will be payable semi-sn~ually, interest of 6%. You can come in
any time and pay off the 1~11 -mount of the bond sad next maturing interest if paid in full
before due. The only advantages you gain in paying cash, you waive the lien off and then
property is free sad clear. If you dc~,t pay that, whenever you pay off you have to pay
the next maturity coupon.
Mr. Foster° Why 6% interest? Ans. Under the Improvement Act of 1911, the interest
is 6~ -~nually - payable semi--~ually.
Mr. Valen. Do yOu tear into the street if you hook onto the sewer after the line has
already been put in? Ans. The City will m,~s the cOnnection from your property line.
Mr. Berger. TS the fee the same regardless of the height level of your ground?Ams.Yes.
Mr. Tumey, 6g ~not Avenue. Is there any financial advsmtage to hooking up to the
sewer now rather then later? AnSo No.
Mr. Valen. I was told it would come out of a General Fund of the City. Will it ever
be revised so that it will come out of the General Fund? Ans. No, that is the case of
trunk sewers.
Mrs. Collins. When sewers are established in other sections of the City was it through
General Funds or by assessment district? Ans. Assessment district.
Ail the written protests were referred to the representative of the Engineer of Work
and to the City ~ngincar, who reported that the approximate percentage of area of assess-
able property in the assessment district for said work represented by protests as compared
to the total area of assessable property in the district was one per cent (1%) and that
protest had not been made by the owners of one-half of the area of the property to be as-
sessed for the work.
~RESOLUTION N0. 1044 - Resolution of the 0ity Council of the City of Chula Vista, California,
· ,=~ing findings and overruling protests and objections.
WHEI~EAS, this City Council by its Resolution No. 1037, adopted on the 14th day of Suns,
1949, declared its intention to o~der the construction of certain sanitary sewer work under
the Improvement Act of 1911, Division ? of the Streets and Highways Code of the State of
California, and in said resolution fixed the l~th day of Yuly, 1949, at the hour of ?:00
o'clock 1% M. in the Council C~-mhere of this City Council, as the time and place for the
hearing before this City Council of protests and objections; and
w~I~zAS, said Resolution No. 10B? was d~ly published, and notices of the passage there-
of were duly posted and mailed, and affidavits of publication, pesting amd mailing have been
duly filed; and
W~ERF~.S, at the ti~ and place fixed in said R~molution No. 1037, a hearing was duly
held by this City Council at which all written protests or objections were duly presented
and read and all persons desiring to be heard thereon were heard, and this City Council
gave all persons present an opportunity to be heard in respect of any matter relating to
thw work proposed in said Resolution No. 1037 or the boundaries of the assessment district
described therein, or in any way relating to the proceedings proposed by said Resolution
No. 1037; and
WHEEEAS, all persons desiring to appear and be heard have been heard, and this City
0Ouncil has taken evidence relating to said proposed work, the boundaries of the proposed
asses~nt district and the benefits to the property to be included in the proposed as-
esmnent district, and is fully informed in the premises:
NOW, THEREFORE, the City Council of the City of Chula Vista, California, DOES
R~SOLVE, DETEI~NE AND ORDER as follows:
Section 1. That protests or objections have not been made by the owners of one-half
of the area of the property to be assessed for said proposed work.
Section 2. That all protests and objections are hereby overruled and denied.
Section 3. That no changes are to be made in the boundaries of the proposed assess-
ment district or in the w~rk proposed to be done, and the boundaries of the assessment
district are defined and established as the boundaries described in the resolution of in-
tention, to-wit: Resolution No. 1037, and the work proposed to be done is likewise defined
and established as the work described in said Resolution No. 1037, and reference is hereby
made to said Resolution No. 1037 for a full and complete description of seid work and of
the assessment district and for further particulars.
Section 4. That this resolution shall be entered upon the minutes of this City Council.

It was moved by C~uneilmau Kidder, seconded by Counc~l~n Nashold, and carried, that
the C~uncil recess for the purpose of convening as a Beard of Equalization as stated in
notice of ~eting publi~he~ euly 8, 1949.
~otion was made by Councilman Kidder, seconded by Councilmsu Nashold, and carried,
that the Council, sitting as a Board of Equalization, adjourn and resume regular session
as a regular Council meeting.
ORDINANCE NO. AC6 - Levying Taxes for 1949-1950.
Motion was made by C~unci]w~u Dyson, seconded by Council~n Riealand, and carried,
that Ordinance NCo 406 be placed on its first reading. The Ordinance was thereupon read
in full.
PLAY GROUND~
Mrs. Rath Collins requested that some type of supervised playground be furnished fc~
the children in the City of chula Vista. There was lengthy discassion and Mr. Bryant told
Mrs. Collins that a ~pervised playground is now being worked out to be located at Eucalyp-
tus Grove and that it was the hope that this playground would solve the sand lot problems
in her neighborhood.
~k-. Kimball, frc~ End and Kearney Street, stated that they would like to have Officer
Cook stop by ahd spend at least 15 mind, es a day with the children as all ball games and
activities had ceased. Mr. Bryant suggested that Mr. Kimball contact the Chief of l~olice
regarding this matter.
SEWER CONTRACT - Sewer Tm,~ Lines and Pumping Station.
It was moved by Councilman Riesland, seconded by Council-~u Kidder, and carried,
that the Contractor, Mr. Charles Dorfman, be granted an extension of time to eo~olete
work from Sune l§th to Yuly 15th.
The City Clerk read a letter from Kistner, Curtis and Wright rec~mehding the ac-
ceptance of the Trunk Sewers and a Sewage Pumping Station. Refer to Resolution No.
1048 which follows~
A~ ~'~/WOLUTION NO. 1048 - Resolution accepting work of c~ntractor in the construction of
Sanitary Sewers for the City of Chula Vista and directing the
execution of a notice of completion.
