OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA, CALIFORNIA
Held~ June 1, 1950
The Council met in the Council ChAmbers at 7:00 o,ciock P.M. on June 1,
1950, with the following members present: Councilm-n Kidder, Rlesland, Logan
and DeWolfe. Absent: None.
At 7:00 P.M. Mayor announced that the hour of ?:00 o'clock P.M. having
arrived, this is the time and place fixed for hearing protests, objections or
appeals concerning that certain sanitary sewer work done under the Improvement
Act of 1911 and Resolution No. 1037 of this Council.
The Clerk presented the following documents to the Council:
(a) Affidavit of posting notice of filing of
assessment for said work.
(b) Affidavit of mailing of such notice.
(c) Affidavit of publication of such notice.
Motion was made by Councilm~u Riesland, seconded by Councilman Logan,
and unanimously carried that said affidavits be approved aed placed on file.
A large crowd of persons desiring to hear and be heard had assembled.
The Council Chamber was inadequate to accomodate such persons. The Mayor
stated that arrangements had beenmade for holding a portion of the hearing
at the F Street Gr~mm-~ School Auditorium in the City of Chula Vista.
Said Auditorium is within five minutes walking distance of the City Hall.
Motion was made by Councilman Logan, seconded by Councilman Riesland,
and unanimously carried that the following order be adopted:
ORDER OF CIT~ COUNCIL CONTINUING
HEARING
WHEREAS, at the hearing in the Council Chambers of this Council at
7:00 o'clock, P.M., June 1, 1950, on the assessment to cover the cost and
expenses of the sanitary sewer work described in Resolution No. 1037 an
unexpected crowd~as appeared and the City Council Chamber in which the
hearing is being held is filled with persons interested and desiring to hear
or be heard, and additional persons interested are crowded into the areas
adjacent thereto, and persons present have requested that the hearing he
adjourned to some convenient place where all can hear the proceedings; and
WHEREAS, the number of persons who desire to hear or be heard at said
hearing is presently far more than the Council Chamber or City Hall facilities
will accommodate and an emergency exists which requires the continuation of
the hearing outside the City Hall; and
WHERF~S, arrangements have beeh made for the use of the F Street
Grammar School Auditorium located at Fourth and F Streets, in said City of
Ch,,l~ Vista, which is a near and convenient place to the City Hall and will
accommodate the persons desiring to be present at said hearing;
NOW, THEREFORE, the City Council of the City of Chula Vista DOE~
HEREBY O~)ER that the hearing on the assessment made to pay the cost and
expenses of the sanitary sewer work under Resolution No. 1037 be adjourned
to and continued in said F Street Gra~w School Auditorium in the City of
Chula Vista at 7:30 o'clock, P.M., of this date, June 1, 1950, ~n~ that
such hearing in said Auditorium be adjourned and continued to such further
time or times as this City Council may order and announce during the
course of said hearing in said Auditorium; and
IT IS FURTHF~ ORDERED that following the portion ~ such hearing
held in said Auditorium prior to 2:COo'clock P.M. June 2nd, 1950, the
hearing will be resumed, taken up, and continued in the Council Chambers
of this City Council in the City Hall at the hour of 2:00 o'clock P.M.,
June 2nd, 1950,
All persons who have filed written appeals or protests and all persons
otherwise interested in the proceedings are hereby invited to attend either
the portion of the hearing to be held in said Auditorium or the further
hearing to be held in said Auditorium or the further hearing to be held in
the Council Chambers of this City, Council in th~ City Hall as above oredered,
or both~ as said persons may desire. All persons entitled to be heard in
the matter will be heard,
The Clerk is hereby instructed to cause this order to be read imediately
to the persons assembled within the Council Chambers, and in the adjacent
areas where any persons are assembled. He is further instructed to cause
a copy of this order to be posted on the door o~ the Council Ch=tubers and a
sign to be placed on the Council table in the Council Chambers showing that
said hearing is being held in said Auditorium, and to keep said sign on said
Council table during all of the time the hearing tonight or as continued is
being held in said Auditorium. The Clerk shall likewise cause this or~er to
be read at the opening of the hearing to be held tonight in said Auditorium.
The City Clerk is directed to place an employee of the city on duty
in the Council Chambers at the City Hall and to keep a city employee on duty
therein at all times during which the hearing tonight or as continued is
being held in the said Auditorium, and said employee shall be directed te
instruct any and all persons who come to the Council Chambers in said City
Hall for said hearing that the hearing is being held in the said Auditorium
and to direct said persons to said Auditorium. He is also directed to l~:-
form such persons of the time of said hearing will be resumed and continued
in the Ci~ Council Chamber in the City Hall.
The Clerk read said order in accordance with its terms and other provis-
ions of the order were carried out.
Motion was made by Councilman Riesland, seconded by Councilman Logan
and unanimously carried that the meeting be continued and adjourned to
7:30 ~,clock P.M., June 1, 1950, at the F Street Grammar School Auditorium
in the City of Chula Vista and that a i'urther adjourned meeting be held in
the Council Chambers in the City Hall at 2:00 o'clock P.M. on June 2, 1950.
The Council met in the AuditoriUm of the F Street Grammar School at
Fourth and F Streets in the City of Chula Vista at the hour of 7:30 o'clock
P.M., June 1, 1950, with the following members present: Councilman Kidder~
Riesland, Logan and DeWolfe. Absent: None.
The Council assembled at 7:30 o'clock, P.M., approximately twenty
minutes after the next foregoing adjournment. The Mayor announced that, the
hour of 7:30 o'clock, P.M. having arrived this is the time and place fixed
for the hearing on the assessment for the sanitary sewer work under the
Improvement Act of 1911 and Resolution No. 1037.
Pursuant to its terms the Clerk read the order of adjournment which
was adopted in the Council Chambers on this date.
The M~or explained generally the method of procedure to be employed
in the hearing. Phillip W. Knights of the office of the Engineer of Work
for said work was introduced. He explained the assessment. Robert M. Barton,
attorney, of O'Melveny & Myers, also made a statement regarding the work
and the procedure required by law in connection therewith.
Certain ~ ritten communications or appeals were read aloud. Following
the reading of each the person filing it or his representative was given
an opportunity to appear and be heard. Among the communications which were

An opporttmity to be heard was given to all persons who felt that
they could not conveniently be present at the hearing in the Council Chambers
to be held at 2:00 P.M. on June 2, 1950. Such persons were heard.
Motion was made by Councilman Riesland, seconded by Councilman
logan and unanimously carried that the hearing be continued to 2:00 o'clock,
PeM., June 2, 1950, in the Co,moil Chambers in the City Hall.

DeWolfe ~nd unanimously carried that this meeting be continued and adjourned
