HomeMy WebLinkAboutcc min 1951/02/13MINUTES OF A REGULAR ~EETING OF THE CITY CGUNCIL OF THE CITY OF CHULA VISTA, CALIFORNiA Held Tuesday~ February 13th, 1951 The Council met in the Council Chambers of the City Hall on the above date at 7:OO o'clock P.N. with the following Councilmen present: Kidder, Riesland, Logan, Hobel. Absent; DeWolfe. Also Present: City Clerk Campbell, City Attorney Boyer, City Engineer Floyd, Asst. Engineer Wheeler. Appointment of Mayor The Mayorahaving previously tendered his resignation, it was moved by Councilman Kidder, seconded by Councilman Logan, and carried, that the resignation be ac- cepted and that the Office of Nayor be declared vacant. Councilman Kidder nominated Councilman Riesland for Mayor, but Councilman Riesland declined because of other commitments. He thanked the Council for the confidence placed in him and expressed his regrets that he could not accept the position. Councilman Riesland then nominated Councilman DeWolfe for Mayor, and Councilman Kidder nominated Councilman Hobel for Eayor. At this point, 7:05 P.M., Councilman DeWolfe arrived. An election was held since there were two nominations, and Councilman Hobel was appointed Nayor by a majority vote. It was moved by Councilman Kidder, seconded by Councilman DeWolfe, and carried, that the minutes of the City Council meetings held January 9th, 16th and 23rd, 1951, be approved as mailed.~.:~tb~ It was moved by Councilman DeWolfe, seconded by Councilman Kidder, and carried, that the minutes of the Planning Commission meetings held January 22nd, and February 5th, 1951 Oe approved as mailed with the following recommendations for the FeDruary 5th meeting: Councilman DeWolfe stated that in the future more study should be given to variances in multiple dwelling areas. The independent action taken by the members of the Planning Commission (not acting as a 'Board) approving a zone variance for Anna Church and ~dward J. Frodyma was ruled illegal by City Attorney Boyer, such action being not approved by the Council and to be reconsidered by the Commission at its next meeting, February 19th, 1951. /Gasoline Bids Bids for supplying the City with gasoline for the coming year were opened. It was moved by Councilman Hobel, seconded by Councilman DeWolfe, and carried, that the bids be referred to the City Attorney and the Engineering Department for study, and for a report of their recommendations at the next meeting, Feoruary 27th, 1951. Rosebank School Street Problem It was moved by Councilman Riesland, seconded by Councilman Kidder, and carried by a unanimous vote, that in the event the School District will grade the proposed Flower Street and install curds and gutters on the South side, and the property owners adjacent will buy the oil and dedicate the necessary street easements, the City will finish and improve the street, without curbs and gutters on the North side. y°rseshoe Court The Park Superintendent appeared before the Council to request additional horseshoe courts in the City Park. Councilman Hobel recommended that the matter be tabled until the next meeting, February 27th, 1951. -2- Civil Defense ~r. Walter Davis, Assistant Director of Civil Defense, appeared before the Council to request an appropriation of $2,000.00 to be used to purchase Com- munications equipment. It was moved by Councilman Logan, seconded by Councilman Kidder, that the expenditure be recommended, providing that the City Administrator determines that funds are available. The motion was carried by the following vote, to-wit: AYF~: Councilmen Logan, Kidder, DeWolfe, Riesland, Hobel. NO~: None. ABSENT: None. Halferty Letter - re: Sewer Refund It was moved by Councilman Kidder, seconded by Councilm=n DeWolfe, and carried, that the letter be referred to Nr. Love and the Engineering Department for study and brought before the Councilmen at the next meeting, February 27, 1951. Howe Letter - re: Tax Refund It was moved by Councilman DeWolfe, seconded by Councilman Kidder, and carried, that the request be referred to the City Attorney for a study of the T&x Ordinances, his findings to be brought before the Council at the next meeting, February 27, 1951. ~Resolution No. 1203 - Quitclaim Deed - Griswold Property Offered by Councilman Kiddsr, read in full, passed, adopted and approved by the following vote, to-wit: AY~: Councilmen Kidder, DeWolfe, Logan, Riesland, Hooel. NOES: None. ABSENT: None. .~"Resolution No. !204 - Dedication of Flower Street - Louise Pray. Offered by Councilman Logan, read in full, passed, adopted and approved by the following vote, to-wit: AYES: CounciLmen Logan, DeWolfe, Kidder, Riesland, Hobel. NO~: None. ABSENT: None. Ordinance No. 428 - Licensing of Dogs It was moved by Councilman DeWolfe, seconded by Councilman Kidder, and carried, that the dog ordinance be discussed at the next meeting. Ordinance No. 429 - Sidewalks It was moved by Councilman Kidder, seconded by Councilman DeUolfe, and carried, that the Ordinance be placed on its first reading. It was thereupon read in full. /Fredericka Home - Repayment of Taxes It was moved by Councilman DeWolfe, seconded by Councilman Riesland, and carried, that the City be authorized to refund the first installment in the amount of $577.55, and cancel the second installment of the 1750-51 taxes due, also that the City Attorn$y answer the complaint. AYES: Councilmen DeWolfe, Riesland, Kidder, Logan, Hobel. NOES: None. ABSENT: None. %~ Garrett Avenue - Hulbert Fish Offer It was moved by Councilman DeWolfe, seconded by Councilman Kidder, that the City put in curbs and gutters on the Fish, Ralph Jack and Robert Jack properties, fronting on Garrett Avenue, in lieu of paying the appraised value, in order to -3- obtain land needed for finishing up Garrett Avenue. The motion was carried by the following vote, to-wit: AYES: Councilmen DeWolfe, Kidder, Hiesland, Logan, Hobel. N(~S: None. ABSENT: None. Gas Tax - 1951 It was moved by Councilman Logan, seconded by Councilman Riesland, and carried, that the tentative plans for the l?S1 Gas Tax program as submitted by the City Engineer be approved, and that the Engineers go ahead with their recommendations. At this point, 10:23 P.N., Councilman Riesland left the meeting. Davidson Street Dedication - C. C. Alley Mr. Alley agreed to deed the Davidson Street property between Fig and Fifth Avenues to the City and buy the oil for street improvement, also pay for sidewalks, curbs and gutters, in return for which the City will do the grading and oiling. It was moved by Councilman Logan, seconded by Councilman DeWolfe, and carried, that the City will accept the deed when ~.~r. Alley has deposited $2,800.00 to cover the above-mentioned improvements. Civil Service Commission It was moved by Councilman Kidder, seconded by Councilman Logan, and carried, that Section 7 of Rule II be amended to include Captain - Police Dept., and that an amendment be added to Section 3-D of Rule II as recommended by the Civil Service Commission to have retroactive effect as of January l, lWS1. Authorization for Purchase Order It was moved by Councilman Kidder, seconded by Councilman DeWolfe, and carried, that Major Floyd b, authorized to buy a clock at a cost of $25.00 or $30.00 for the lobby of the City Hall. Pay Bills After examination by the entire Council and approval of the Finance Committee, it was moved by Councilman DeWolfe, seconded by Councilman Kidder, and carried, that Warrants No. 3166 to 329~ be approved for payment. AYES: Councilmen ~eWolfe, Kidder, Logan, Hobel. NO~: ~ons. ABSENT: Councilman Riesland.
